HomeMy WebLinkAboutR-95-0658J-95-784 8/21/95 RESOLUTION NO. 9 5 A RESOLUTION, WITH ATTACHMENT(S), TRANSFERRING PORTIONS OF THE RIGHT-OF-WAY OF NORTHEAST 37TH STREET WITHIN THE CITY OF MIAMI, FLORIDA, TO THE JURISDICTION OF THE STATE HIGHWAY SYSTEM IN CONFORMANCE WITH SECTION 337.29, FLORIDA STATUTES; FURTHER AUTHORIZING THE FLORIDA DEPARTMENT OF TRANSPORTATION TO RECORD A RIGHT-OF-WAY MAP OF THE SUBJECT ROAD IN THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA. WHEREAS, Northeast 37th Street Is a dedicated public right- of-way within the City of Miami, Florida; and WHEREAS, the Florida Department of Transportation is finalizing plans to Improve vehicular safety on the Airport Expressway (1-195) and Its entrance ramps between Northeast 2nd Avenue and Biscayne Boulevard; and WHEREAS, a component of the Florida Department of Transportation plan includes widening of the westbound travel lanes adjacent to Northeast 37th Street and widening of the westbound entrance ramp at Biscayne Boulevard; and WHEREAS, the Florida Department of Transportation desires to Include portions of the right-of-way of Northeast 37th Street In the State System to accomodate the proposed widening of the expressway and entrance ramp; and ATTACff��p N TA H .CITY COMMISSION MEETING OF 5 E P 1 4 1995 Resolution No. ��- 658 . , � � WHEREAS, In conformance with Section 337.29, Florida Statutes, a r|ght-of-way map of the subject road, more accurately described on the attached legal descriptions, has been prepared and will be duly recorded /n the Public Records of Dade County, ! Florida by the Florida Department of Transportation; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE ' CITY OF K4|AM|, FLORIDA: Section 1, The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and Incorporated herein as If fully met forth In this � Section. Section 2. Portions of Northeast 37th Street within the City of Miami, Florida, together with all public right-of-way � adjacent thereto, as described on the attached legal descriptions are hereby added to the State Highway System and transferred to . State of Florida Jurisdictional responsibility In accordance with � Section 337'29, Florida Statutes.. Section 3. The Florida Department of Transportation Is hereby authorized to properly record a right-of-way map of the subject road In the Public Records of Dade County, Florida. � Section 4. Containing an area of 179.5 square meters (1932 square feet) more or less. A critical component to this plan includes the widening of the westbcuna travel lanes of the expressway west of 813caynu BuuIovard and the widening arW Improvement of the wootbound entrance ramp at Blocayne Boulevard to meet current Intearntate safety guidelines. in order for the F.D.O.T. to complete their expressway Improvement plans, It Is necessary that portions of public right of way on the south Side Qf N.E. 37 Street be transfarrcd to the Jurisdiction of the State Highway System so that the F.b.O.T. may assume reconstrtic-tion and maintenance responsibility of the Improved expressway and entrance ramp, The F.D.O.T. has been working with the Clty's Upper Eas><tside and Little HA1tl N.b.T. Service? Centers and with the property uwners abutting N.E. 37 StrwesL to ensure that proper access and traffic flow Is maintained to ail proper t i stA adjacent to the remainder of N.E. 37 Street. The State has prepared the necessary right-of-way map Cif the subject area to be Lransfarred and , w i I 1 be rgpcons3 i b l e for all costs to conotruct the expressway Imrpovements.
