HomeMy WebLinkAboutR-95-0651J-95-796 8/28/95 RESOLUTION NO. 15r A RESOLUTION SCHEDULING A PUBLIC HEARING FOR SEPTEMBER 28, 1995, AT 4:30 P.M., TO TAKE TESTIMONY REGARDING THE FLAGLER/CORE AREA SECURITY DISTRICT SPECIAL IMPROVEMENT DISTRICT EXPANSION, WHICH EXTENSION FOR A ONE YEAR PERIOD WAS INITIATED BY RESOLUTION NO. 95-102, ADOPTED FEBRUARY 91 1995; PROVIDING THAT AT SUCH TIME ALL PROPERTY OWNERS OR ANY OTHER PERSONS INTERESTED THEREIN MAY APPEAR BEFORE THE CITY COMMISSION AND BE HEARD AS TO THE PROPRIETY, ADVISABILITY AND COST OF MAKING SUCH jj IMPROVEMENTS AGAINST EACH PROPERTY SO IMPROVED. WHEREAS, Chapter 170, Florida Statutes (1989), allows municipalities in Home Rule Charter counties to levy and collect special assessments against property benefited for the purpose of stabilizing and improving retail or wholesale business districts, or nationally recognized historic districts, or combinations thereof, through promotion, management, marketing and other similar services in business districts of the municipality; and WHEREAS, on June 7, 1989, pursuant to Resolution No. 89-548, the City Commission declared the Flagler/Core Area Security District to be a Special Improvement District for the provision of the above specified services in accordance with applicable provisions of Chapter 170, Florida Statutes, as amended; and CITY commsSION MEETING OF 5 E P 1 4 1995 Resolution No. 95- 651 WHEREAS, pursuant to Resolution No.89-828, adopted September 14, 1989, the Miami City Commission confirmed the establishment of the Flagler/Core Area Security District Special Improvement District, providing enhanced street maintenance and similar services in the Downtown Central Business district; and WHEREAS, the established District has been extended by one-year terms pursuant to Resolution Nos. 91-292, 92-249, 92-473, 93-127, 94-77, and 95-102; and WHEREAS, Section 170.07 of the Florida Statutes requires that a public hearing be held to hear the testimony of all property owners to be assessed and any other interested parties pertaining to the propriety and advisability of making such improvements, the cost thereof, the manner of payment therefor, and the amount thereof to be assessed against each property so improved within the Flagler/Core Area Security District Special Improvement District Expansion; and WHEREAS, Section 170.08 of the Florida Statutes states that all final considerations for the special assessment will be given after hearing testimony from the affected property owners as to making the improvements and funding them with special assessments, and further states that following testimony, the Miami City Commission shall make a final decision on whether to levy the special assessments, and if approved a final assessment - 2 - 95- E51 I roll shall be filed with the City of Miami Clerk's Office and such assessments shall stand confirmed; and WHEREAS, a preliminary assessment roll has been completed and filed of record with the City Clerk; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. A public hearing is hereby scheduled to take place before the City Commission in the City Commission Chambers, City Hall, Dinner Key, 3500 Pan American Drive, Miami, Florida, September 28, 1995, at 4:30 P.M. The City Commission shall hear testimony of all affected property owners and those persons interested in the Flagler/Core Area Security District Special Improvement District Expansion. Section 3. Background Chapter 170, Florida Statutes (1989), allows municipalities in Home Rule Charter counties to levy and collect special assessments against properties benefited for the purpose of stabilizing and improving retail and wholesale business districts, or nationally recognized historic districts, or combinations thereon through promotion, management, marketing and other similar services in business districts of the municipality. The Miami City Commission established the Flagler/Core Area Security District Special Improvement District, providing enhanced street maintenance and similar services in the Downtown Central Business District, Section 107.07 of the Florida Statutes requires that a public hearing be held to hear testimony of all property owners to be assessed and any other interested parties pertaining to propriety and advisability of making such improvements, the cost thereof, and the amount thereof to be assessed against each property so improved within the Flagler/Core Area Security District Special Improvement District. Attached is a Resolution for City Commission approval which schedules a public hearing for September 28, 1995, at 4:30 p.m., to take testimony regarding the Flagler/Core Area Security District Special Improvement District. CHO/PA✓pc encl. 1-12-1 95- 651 L CITY OF MIAMI, FLORIDA NOTICE TO THE PUBLIC PLEASE ALL TAKE NOTICE THAT a public hearing is scheduled to be held by the City Commission of the City of Miami, Florida, on September 28, 1995, at 4:30 p.m., in the City Commission Chambers at City Hall, 3500 Pan American Drive, Miami, Florida, on the extension of the term of the Flagler/Core Special Assessment District for one (1) additional year from March 8, 1995 to March 7, 1996, for the provision of promotion, management, marketing and other similar services. The area encompassing said district is bifurcated and is described as follows: the northern portion being in the area bounded by the north side of Northeast/Northwest 2nd Street on the south, the south side of Northeast/Northwest 3rd Street on the north, the east side of Northwest 1st Avenue on the west, and the west side of Biscayne Boulevard on the east; the southern portion being in the area bounded by the south side of Southeast/Southwest 3rd Street on the north, an imaginary line extending south from the west side of Southeast 1st Avenue on the west, the north bank of the Miami River on the south, and the west side of Biscayne Boulevard on the east, including an imaginary line extending south to the Miami River. The Special Assessment for each affected parcel or property and the properties subject to the assessment which make up the Flagler/Core area Security District Special Improvement District are described on documents available for public inspection at the Office of the City Clerk, at City Hall, 3500 Pan American Drive, Miami, Florida. All interested persons are invited to appear and may be heard concerning this item. Should any person desire to appeal any decision of the City Commission with respect to any matter considered at this hearing, that person shall ensure that a verbatim record of the proceedings is made, including all testimony and evidence upon which any appeal may be based.
