RESOLUTION NO. 9.5 - 638
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE A SECOND INTERLOCAL
AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, BETWEEN THE CITY OF MIAMI AND
{ METROPOLITAN DADE COUNTY, FLORIDA (THE
"COUNTY"), TO PROVIDE FOR THE SUSPENSION OR
TERMINATION OF CERTAIN TERMS AND CONDITIONS
SET FORTH IN THE FIRST INTERLOCAL AGREEMENT
WITH THE COUNTY CONCERNING THE DISPOSAL OF
SOLID WASTE MATERIALS COLLECTED IN AND BY THE
CITY OF MIAMI.
WHEREAS, the City desires to enter into a Second Interlocal
Agreement with Metropolitan Dade County (the "County") for the
disposal of certain solid waste materials collected in and by the
City of Miami; and
WHEREAS, said Second Interlocal Agreement accommodates the
City's pending Bedminster Corporation agreement which provides
for disposal at the Bedminster Facility when it becomes
operational;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference

thereto and incorporated herein as if fully set forth in this
Section.

Section 2. The City Manager is hereby authorized!/ to
negotiate and execute a Second Interlocal Agreement, in a form
acceptable to the City Attorney, between the City of Miami and
Metropolitan Dade County, Florida, to provide for the suspension
or termination of certain terms and conditions set forth in the
First Interlocal Agreement with the County concerning the
disposal of solid waste materials collected in and by the City of
Miami.
Section 3. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION
It is respectfully recommnndnd that the City Commission authorizo
the City Manager to negotiate and execute an Interlocal Agreement
with Metropo,l.itnn Dade County for the disposal of all Municipal
Solid Waste (MSW) collected in and by the City of Miami, in a
form acceptable to the City Attorney and in substantially the
terms set forth in the attached resolution; at a price of $45.00
per ton with a maximum 5% per year Consumer Price Index (CPI)
increase.
BACKGROUND
Over the past few years, the markets for solid waste disposals,
including recyclable$ and yard/garden trash, have diversified,
moved into the national and international markets and provided
the opportunity for municipalities, like Miami, to reduce their
disposal costs significantly; while, in the case of recyclable
materials, at the same time producing revenue to off -set some
collection costs. Concurrently, Metropolitan Dade County was
projecting significant increases in the tipping fees which the
City was ,paying for the disposal of all of our waste, eventually
excluding recyclable materials, and flow control legislation was
threatening an end to our ability to seek cheaper disposal costs
outside of Dade County. In our case, therefore, we began to
dispose of our waste at privately owned facilities in Dade and
Broward Counties.
Subsequently, negotiations with the Bedminster Corporation
regarding the original terms of our contract with them for the
development and management of a composting facility at which we
would dispose of solid waste vollected in and by the City of
Miami; reduced the tipping fees and provided for the exclusion of
yard and garden waste which the City intends to recycle at our
Virginia Key Yard/Trash Management Facility.
The Interlocal Agreement under Consideration reflects agreement
with Metropolitan Dade County on these issues, specifically a
reduced tipping fee of $45.00 per ton and the right to divert the
permitted solid waste to Bedminster without penalty when that
facility becomes operational. It also allows us the flexibility
in the interim to continue with a Recycling Progran which is
currently producing revenue at several levels.
