J-95-814 9/8/95 RESOLUTION N09 O " C, 3 1 A RESOLUTION AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A FIRST INTERLOCAL AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, BETWEEN THE CITY OF MIAMI AND METROPOLITAN DADE COUNTY, FLORIDA (THE "COUNTY"), TO PROVIDE FOR THE DISPOSAL AT { METROPOLITAN DADE COUNTY SOLID WASTE MANAGEMENT SYSTEM FACILITIES OF MUNICIPAL SOLID WASTE MATERIALS COLLECTED IN AND BY THE CITY OF MIAMI. WHEREAS, the City desires to enter into an interlocal agreement (the "First Interlocal Agreement") with Metropolitan Dade County for the disposal of solid waste materials collected in and by the City of Miami; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY I OF MIAMI, FLORIDA: I Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. QU J N III ' CITY kTTO Y W322:ROD:BSS bli- 637 CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM 39 Honorable Mayor and Members of TO: City Commission DATE: SEP -$ 1995 FILE Tnterlocal Agreement sua�ECT : Between Metropolitan Dade County and Con- tract Cities FROM : Ces dio REFERENCES : Cit ager ENCLOSURES: RECOMMENDATION It is respectfully recommended that the City Commission authorize the City Manager to negotiate and execute in a form acceptable to the City Attorney the above referenced Interlocal between Metropolitan Dade County and Contract Cities, of which the City of Miami is one, for our use of the County Solid Waste Management System for disposal of solid waste collected by the City of Miami, until such time as the Bedminster facility becomes operational. BACKGROUND This is one of two interlocal agreements that Dade County is requiring for our participation in their solid waste management system, specifically for the disposal of the solid waste collected by the city, excluding recyclable materials, yard and garden waste and certain other specified items. This, the first, is required for all cities desiring to formalize their relationship with Dade County for the use of their facilities for disposal. This agreement prevents the city's paying additional tipping fees (ten percent (10%) above the contract city fee) to the county under their short-term disposal contracts, and sets the tipping fee as $45 per ton with annual U.S. Government Consumer Price Index (CPI) for the Southeast Region, for the term of the agreement, proposed as twenty (20) years. Including Dade County, there are twenty-seven (27) Contract Cities. This agreement addresses the solid waste issues common to all municipalities participating in the Dade County system. The second interlocal is specific to the City of Miami and is being presented for your consideration as a separate item. �J �+ E; 37
