HomeMy WebLinkAboutR-95-0628,T J-95-808 9/6/95 RESOLUTION NO.9 5 ^ 6 /91 A RESOLUTION BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING THAT AN EMERGENCY NEED EXISTS, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS AND AUTHORIZING THE CITY MANAGER TO ACCEPT THE LOWEST RESPONSIVE AND RESPONSIBLE INFORMAL BID FOR THE CONSTRUCTION OF CITY STORM SEWERS AT N.W. 34 STREET AND N.W. 9 AVENUE AND AT N.W. 29 AVENUE AND N.W. 36 STREET, MIAMI, FLORIDA; ALLOCATING FUNDS THEREFOR, IN AN AMOUNT NOT TO EXCEED $130,000, FROM PROJECT NO. 352295 AS APPROPRIATED BY THE CAPITAL IMPROVEMENT ORDINANCE NO. 11205, AS AMENDED; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE SUCCESSFUL BIDDER. WHEREAS, the City Manager has made a finding that a storm water drainage emergency exists in the Allapattah neighborhood at N.W. 34 Street and N.W. 8 Avenue and at N.W. 29 Avenue and N.W. 36 Street, Miami, Florida, constituting a valid emergency; and WHEREAS, the nature of said emergency requires the immediate construction of the storm sewers to protect the health, safety and welfare of the citizens of the City; and WHEREAS, the normally required procedures and scheduling requirements for formal advertising, receipt of bids, award of contract and processing of contracts will needlessly and unwisely delay the construction of the storm sewers; and CITY COMMISSION MEETING OF S E P 1 1E 1995 Resolution No. 95- �;18 L WHEREAS, Sections 18-52.5 and 18-52.6 of the Code of the City of Miami, as amended, make provision for emergency procurement of required goods and services for public works projects and improvements; and WHEREAS, the City Manager and the Director of the Department of Public Works recommend that informal bid procedures be utilized to procure the needed services, equipment and/or materials for said storm sewer construction; and WHEREAS, after receipt of informal bids, a contract for said i services, equipment and/or materials will be awarded to the lowest responsible bidder by the City Manager; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a 4/5ths affirmative vote of the members of the City Commission, after a duly advertised public hearing, the City Managers finding that a valid emergency needs exists for the construction of city storm sewers at N.W. 34 Street and N.W. 9 Avenue and N.W. 29 Avenue and N.W. 36 Street, Miami, Florida, in the amount of $130,000, for the Department of Public Works, is hereby ratified, approved and confirmed, with funds therefor hereby allocated from Project No. 352295 as appropriated by the Capital Improvement Ordinance No. 11205, as amended. 2- 95- 628 Section 3. The requirements for competitive sealed bids are hereby waived for the construction of the above storm sewers. Section 4. The City Manager is hereby authorized to seek informal bids for the above work and to award the contract to the lowest responsive and responsible bidder. Section 5. The City Manager is hereby further I authorized) to execute a contract, in a form acceptable to the City Attorney, with the successful bidder. Section 6. BACKGROUND: Based on Information supplied to me by the Director of the Public Works Department, I have found that a STORMWATER DRAINAGE EMERGENCY exists In the Allapattah neighborhood at three locations. The problem was identified by the Public Works Department In response to numerous citizen complaints of street flooding during moderate rainstorms. At two locations near the Intersection of N.W. 34 Street and N.W. 9 Avenue, stormwater drains from the public right of way onto private property threatening owners belongings. The third location on N.W. 29 Avenue south of N.W. 36 Street is Impassable during rainstorms, forcing the closing of critical driveway serving commercial property. Stormwater stays at these locations for extended periods of time providing a breeding area for mosquitoes. Funds for the execution of this protect are available from monies already appropriated In the City's Capital Improvement Appropriations Ordinance 11205.
