A RESOLUTION, WITH ATTACHMENTS, ACCEPTING THE
PLAT ENTITLED LA PLAYA ESTATES, A SUBDIVISION
IN THE CITY OF MIAMI, SUBJECT TO ALL OF THE
CONDITIONS OF THE PLAT AND STREET COMMITTEE,
AND ACCEPTING THE DEDICATIONS SHOWN ON SAID
PLAT; ACCEPTING THE COVENANT TO RUN WITH THE
j LAND POSTPONING THE IMMEDIATE CONSTRUCTION OF
CERTAIN IMPROVEMENTS UNTIL REQUIRED BY THE
DEPARTMENT OF PUBLIC WORKS; AUTHORIZING AND
DIRECTING THE CITY MANAGER AND CITY CLERK TO
EXECUTE THE PLAT; AND PROVIDING FOR THE
RECORDATION OF SAID PLAT IN THE PUBLIC
RECORDS OF DADE COUNTY, FLORIDA.

WHEREAS, the City Department of Public Works recommends the
acceptance of the plat;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section I. The plat entitled LA PLAYA ESTATES is a
resubdivision of Lots 126 and 127, "UTOPIA", Plat Book 8, Page
94, lying in Section 29, Township 54 South, Range 41 East, City
of Miami, Dade County, Florida, which plat by reference is made a
part hereof as if fully incorporated herein, and, subject to all
of the conditions required by the Plat and Street Committee as
set forth as Exhibit "A" attached hereto is hereby accepted. The
dedications shown on the plat together with the dedications to

the perpetual use of the public of all existing and future
planting, trees and shrubbery on said property, are also hereby
accepted and confirmed by the City of Miami, Florida.
2. The Covenant To Run With The Land executed by F & L
Developers, Inc., a Florida Corporation, postponing the immediate
construction of street improvements (curb and gutter, pavement
and drainage) on La Playa Boulevard and Malaga Avenue until such
time as required by the Department of Public Works of the City of
iMiami, is hereby accepted and the proper officials are directed
to record said covenant after the plat has been recorded in the

Public Records of Dade County, Florida.
3. The City Manager and City Clerk are hereby authorized

and directed to execute the plat and cause the same to be
i
recorded in the Public Records of Dade County, Florida.

4. This Resolution shall become effective immediately upon
its adoption.

The City of Miami Plat and Street Committee, at Its meeting of
March 2, 1995, approved the above tentative plat subject to the
following revisions being made to the tentative plat, additional
Information being provided and/or variances being granted. Please
be advised that the processing of your tentative plat cannot
proceed until these conditions have been satisfied.
- Correct zoning classification in location sketch.
- Show surrounding subdivision In location sketch.
- Tree survey required (diameter, height, canopy).
- MDWSD will require an 8-Inch water main extension from
Justison and Malaga along Malaga to end of property.
No sanitary sewer service Is available in the
neighborhood.
- Label LeJeune Road and Braganza Avenue in the location
sketch.
- Show the underlying legal description of the proposed
plat In the location sketch.
- Show the proposed plat name at the location sketch.
- Label all lots, blocks and subdivisions shown in the
location sketch; also Include all zoning designations.
- Label all of the adjacent lots In the main sketch -
Include subdivision name, plat book and page.
- Refer all elevations to City of Miami Datum; describe
City of Miami bench mark used.

Dade County, Florida.

l In addition to the above requirements, you should be aware of
the following:
1. State and local laws require the Installation of various
physical Improvements In the public rights -of -way when
property Is platted. These subdivision Improvements
include paving, drainage, landscaping, sidewalks, etc. In
some cases this could represent a substantial Investment
on your part.
2. The alteration, relocation or Installation of utilities
such as storm and sanitary sewers, electric, telephone,
water, etc., caused by this plat will be at the property
owner's expense. Also, utility easements may be required
on the property being platted.
3. A building permit will not be Issued on the property being
platted until the final plat is recorded. Also, the
Certificate of Occupancy for any building construction will
be issued only after all the required subdivision
Improvements have been completed.
4. Approval for fire flow requirements must be obtained from
the Fire., Rescue and Inspection Services Department prior
to the Issuance of a building permit.
5. Additional Items must be provided to the City of Miami
Department of Public Works before the final plat Is
submitted to the City Commission for approval. You will be
notified in writing as to what these Items are after the
amount of the bond has been determined for the necessary
subdivision Improvements.

REPORT OF PROPOSED RECORD PLAT OF
LA PLAYA ESTATES
Located at La Playa Boulevard and Malaga Avenue
A SUBDIVISION IN THE CITY OF MIAMI, FLORIDA
The accompanying Plat entitled LA PLAYA ESTATES was
prepared by Florida International Land Surveyor, Inc. It is in
correct form for submission to the City Commission and is
forwarded with a recommendation that it be approved.
PERTINENT INFORMATION REGARDING THE PLAT:
(1) The property platted is a resubdivision of Lots 126 and 127,
"UTOPIA", Plat Book 8, Page 94,. lying in Section 29,
-Township 54 South, Range 41 East, City of Miami, Dade
County, Florida. The area platted consists of two (2) lots
containing 10,850.6 square feet (0.25 + of an acre). It is
zoned R-1.
(2) The location of the streets and the widths conform with the
standards of the Department of Public Works of the City of
Miami, Florida.
(3) As certified to by Vicente Tome, Registered Surveyor and
Mapper, this Plat complies with the plat filing laws of the
State of Florida.

(4) The Certificate of Title Examination, dated July 13, 1995,
signed by Milagros R. Vazquez, Attorney, indicates that the
fee simple title to the property platted is correctly vested
in F & L Developers, Inc., a Florida Corporation, and the
Plat has been correctly executed.
(5) The area platted is encumbered by a mortgage and the
mortgage holder has executed the Plat and joined in its
dedications.
(6) As a result of a field investigation by the Department
Public Works it has been determined that no improvements
shall be required at this time. However, the Department
recommends that a covenant be accepted postponing the
immediate construction of street improvements (curb &
gutter, pavement and drainage) on La Playa Boulevard and
Malaga Avenue. This Plat is forwarded to the City
Commission of Miami, Florida, without the usual formality of
a Contract and a Bond being provided.

With the understanding that this opinion of Title is furnished
to CITY OF MIAMI, FLORIDA in compliance with Section 54.5-8 of the
Miami City Code and as an inducement for acceptance hereinafter
described. It is hereby certified that we have examined the
complete Abstract of Title completely covering the period from the
beginning to July 13, 1995 11:00 pm, inclusive, of the following
described real property:
Lots 126 and 127, of UTOPIA, according to the Plat thereof, as
recorded in Plat Book 8 at Page 94, of the Public Records of
Dade County, Florida.
Basing our opinion on said complete abstract covering said
period we are of the opinion that on the last mentioned date the

1. Mortgage from F & L Developers, Inc. a Florida
Corporation, to Chase Federal Bank, a Federal Savings Bank, dated
February 3rd, 1995, recorded February 6, 1995, under Official
Records Book 16672, at Page 0640, of the Public Records of Dade
County, Florida, in the principal sum of $149,200.00.
2. Restrictions recorded February 15, 1924, recorded in Deed
Book 389, at Page 190, of the Public Records of Dade County,
Florida.
3. Agreement For Water Facilities between Metropolitan Dade
County and F & L Developers Inc. dated July 5, 1995 and recorded on
July 7, 1995, under Official Records Book 16846, at Page 4220, of
the Public Records of Dade County, Florida.
Therefore, it is our opinion that the following parties must
join in the platting of the above described real property in order
to grant CITY OF MIAMI, FLORIDA and the public, a good and proper
title -to the dedicated areas shown on the final plat of the
aforedescribed property, the subdivision thereof to be known as La
Playa Estates.

ENCLOSURES:
It is respectfully recommended that the City Commission adopt a
resolution accepting the plat LA PLAYA ESTATES and approving
recording the same in the Public Records of Dade County, Florida.
BACKGROUND:
The Department of Public Works has reviewed this plat, and has
determine that it is now in order for acceptance by the City
Commission.
The proposed record plat entitled LA PLAYA ESTATES is a
resubdivision of Lots 126 and 127, "UTOPIA", Plat Book 8, Page
94, lying in Section 29, Township 54 South, Range 41 East, City
of Miami,.Dade County, Florida. The area platted consists of two
