A RESOLUTION RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S EMERGENCY
ACTION IN DECLARING AN EXEMPTION FROM THE
PROHIBITIONS CONTAINED IN SECTION 36-4(a) OF
THE CITY CODE (THE "NOISE ORDINANCE") FOR
DATES SPECIFIED HEREIN IN CONNECTION WITH THE
FILMING OF CERTAIN ACTION SEQUENCES FOR THE
FEATURE LENGTH FILM ENTITLED "THE SUBSTITUTE"
AT MIAMI SENIOR HIGH SCHOOL; FURTHER,
APPROVING AN EXEMPTION FROM THE NOISE
ORDINANCE FOR THE FILMING OF CERTAIN ACTION
DATES SPECIFIED HEREIN.
WHEREAS, SUBSTITUTE PRODUCTIONS, INC. (the "Applicant") is
currently filming a feature length film entitled "THE SUBSTITUTE"
at Miami Senior High School (the "Premises"), located at
2450 Southwest First Street, Miami, Florida; and
WHEREAS, the filming includes action sequences involving
gunfire, minor explosions and squib walls (bullet hits on walls);
and
WHEREAS, the Applicant requested that the City Commission
declare an exemption from Section 36-4 of the City Code in the
event the filming of said sequences created noise audible at a
distance of 100 feet from the premises, for the following dates
and times:

Wednesday, August 16, 1995, from 9 p.m. to 2 a.m.
Thursday, August 17, 1995, from 9 p.m. to 6 a.m.
Friday, August 18, 1995, for unspecified times, as a weather
contingency date
Friday, August 25, 1995, from 8 p.m. to 2 a.m
one unspecified night during the week of August 21 through
'25, 1995, between the hours of 8 p.m. and 2 a.m.;
and
WHEREAS, as the City Commission did not meet during the
month of August, the City Manager declared an exemption from
Section 36-4 of the City Code, (the "Noise Ordinance") subject to
the Applicant complying with all applicable laws, ordinances and
all other regulations and obtaining all required permits from the
applicable authorities; and
WHEREAS, the applicant has requested an exemption from the
Noise Ordinance to film additional action sequences under the
William Powell Bridge for the following dates and times:
From sunset on Wednesday, September 27, 1995, to
sunrise Thursday, September 28, 1995
From sunset on Thursday, September 28, 1995, to sunrise
Friday, September 29, 1995;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Managers emergency action in

declaring an exemption from Section 36-4 of the Code of the City
of Miami, as amended, for dates specified hereinabove in
connection with the filming of certain action sequences for the
feature length film entitled "THE SUBSTITUTE" at Miami Senior
High School is hereby ratified, approved and confirmed.
Section 3. An exemption from the Noise Ordinance is
hereby granted for the filming of additional action sequences
under the William Powell Bridge for the dates specified
hereinabove in connection with the filming of "THE SUBSTITUTE".
Section 4. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION
It is recommended that a resolution be passed ratifying the Manager's action in declaring
an exemption from the prohibitions contained in section 36-4(a) of the City Code (Noise
Ordinance) in connection with the filming of certain action sequences for the feature
length film entitled "The Substitute" at Miami Senior High School.
The City was informed by "The Substitute" Production Co., that filming would include
action sequences involving gunfire, minor explosions and squib walls (bullets hits on
walls). Due to the commencement of the 1995-96 school year on August 28th, all filming
would have to be completed during the month of August. As the City Commission did
not meet during the month of August, the City Manager declared the filming of the
sequences above exempt subject to the Production Co. complying with all applicable laws
and ordinances and obtaining all required permits from the applicable authorities. The
Miami Police Department assisted the Production Co., to obtain the necessary permits
and also in advising the neighborhood of the activity being filmed at the school.
