RESOLUTION NO. 0�'� 623
A RESOLUTION, AUTHORIZING THE CITY MANAGER TO
ENTER INTO A MUTUAL AID AGREEMENT, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, ON BEHALF OF
THE CITY OF MIAMI WITH THE FLORIDA CITY
POLICE DEPARTMENT FOR THE PURPOSE OF
IMPLEMENTING THE FLORIDA MUTUAL AID ACT
PROGRAM WITH SAID LAW ENFORCEMENT AGENCY.
WHEREAS, there is an existing and continuing possibility of
the occurrence of law enforcement problems and other natural and
man-made conditions which are likely to be beyond the control of
I the services, personnel, equipment or facilities of the City of

Ii Miami Police Department and/or the participating municipal police
l departments; and
WHEREAS, to meet the responsibility of the respective
governments to ensure the public safety and peace for the
citizens of their communities, it is necessary for the various
governmental agencies to enter into Mutual Aid Agreements,
pursuant to Chapter 23, Florida Statutes; and
WHEREAS, pursuant to Resolution No. 95-117, adopted
February 9, 1995, the City Manager was authorized to execute
Mutual Aid Agreements on behalf of the City of Miami with certain
municipal police departments and at this time, such agreement
should be executed with the Florida City Police Department; and

Resolution No,
WHEREAS, Section 23.1225(3), Florida Statutes, requires that
authorization for entering into Mutual Aid Agreements must first
be approved by the governing body of the municipality;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the

Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorizedi to

enter into a Mutual Aid Agreement, in a form acceptable to the
City Attorney, on behalf of the City of Miami with the Florida
City Police Department for the purpose of implementing the
I
Florida Mutual Aid Act Program with said law enforcement agency.
Section 3. This Resolution shall become effective
immediately upon its adoption.

ENCLOSURES
The attached Resolution authorizes the City of Miami to eater into a Mutual Aid
Agreement with the Florida City Police Department. it would be in best interests of the
City of Miami to have this Resolution approved as soon as possible.
Chapter 23, Florida Statutes, now requires that the governing body of the municipality
entering into a Mutual Aid Agreement authorize some prior to its execution, A prior
Resolution authorized the execution of Mutual Aid Agreements with Metropolitan Dade
County, South Miami, Hialeah, North Bay Village, Key Biscayne, North Miami, apa-
Locka, Florida Highway Patrol and the Florida Department of Law Enforcement.
