A RESOLUTION APPROVING THE ENGAGEMENT OF THE
LAW FIRM OF WEISS, SEROTA & HELFMAN, P.A. TO
SERVE AS COUNSEL FOR VICTOR H. DE YURRE, CITY
OF MIAMI COMMISSIONER, BEFORE THE UNITED
STATES DISTRICT COURT FOR PRE-TRIAL
LITIGATION SERVICES IN CONNECTION WITH THE
CASE OF GERALDO LOPEZ MORALES, ET AL. V. CITY
OF MIAMI, CESAR H. ODIO AND VICTOR DE YURRE,
-MORENO, WITH THE INTERIM
CASE NO 95-1584-CIV
FEE FOR SUCH SERVICES NOT TO EXCEED
$15,000.00; ALLOCATING FUNDS THEREFOR FROM
THE CITY OF MIAMI SELF-INSURANCE AND

BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Attorney's engagement of the law
firm of Weiss, Serota & Helfman, P.A. to serve as counsel for

States District Court for pre-trial litigation services in
connection with the case of Geraldo Lopez Morales, et al. v. City
of Miami Cesar H. Odio and Victor De Yurre, Case No. 95-1584-CIV-
MORENO, is hereby approved, with the interim fee for such
services not to exceed $15,000.00, with funds therefor hereby
allocated for said services from the City of Miami Self -Insurance
and Insurance Trust- Fund, Index Code No. 620101-661.

SUBJECT : Attorney's engagement of Weiss, Serota
& Helfman, P.A. as Counsel for Geraldo

The attached proposed Resolution seeks approval for the
engagement of the law firm of Weiss, Serota & Helfman, P.A. to
serve as counsel for Commissioner Victor H. De Yurre before the
United States District Court, Southern District of Florida, Miami
Division, for pre-trial litigation services in connection with
the case of Geraldo Lopez Morales, et al. (Plaintiffs) v. City of
Miami, Cesar H. Odio and Victor De Yurre (Defendants), Case
No. 95-1584-CIV-MORENO. The Plaintiffs have filed said
litigation to seek compensatory and punitive damages, claiming
that Defendants violated Plaintiffs' First Amendment rights under
the United States Constitution.
Pursuant to Section 111.07, Florida Statutes (1993), the
City of Miami is authorized to provide an attorney to defend any
civil action for damages as a result of any act or omission of
its officers, employees or agents arising out of and in the scope
of employment. This includes representation where the action
seeks relief personally against the officer for alleged civil
rights deprivations.
Funds for said services, in an amount not to exceed $15, 000,
will be allocated from the City of Miami Self -Insurance and
Insurance Trust Fund.
