A RESOLUTION AUTHORIZING THE SAME SPECIAL CHARGES, TERMS AND CONDITIONS, AS ESTABLISHED IN PREVIOUS YEARS, INCLUDING THE WAIVER OF ALL USER FEES AND LIGHTING, FOR THE USE OF THE BOBBY MADURO MIAMI BASEBALL STADIUM BY THE MIAMI AMATEUR BASEBALL ASSOCIATION ("MABA") FOR THE PRESENTATION OF BASEBALL GAMES TO BE HELD AUGUST 6, 1995 THROUGH DECEMBER 17, 1995; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, BETWEEN THE CITY OF MIAMI AND MABA FOR THIS PURPOSE, SUBJECT TO THE ORGANIZERS OBTAINING INSURANCE TO PROTECT THE CITY IN AN AMOUNT AS PRESCRIBED BY THE CITY MANAGER OR HIS DESIGNEE. WHEREAS, the Department of Conferences, Conventions, and Public Facilities is responsible for the operation of the Bobby Maduro Miami Baseball Stadium and attempts to secure the presentation therein of athletic events for the community; and WHEREAS, Section 53-146 (C) (6) of the Code of the City of Miami, Florida, as amended, provides that the City Commission has the right to establish and fix special charges or special terms and conditions for the use of said stadium; and WHEREAS, the Miami Amateur Baseball Association (MABA) wishes to use the Bobby Maduro Miami Baseball Stadium for the presentation of baseball games, to be held August 6, 1995 through December 17, i995; and CITY COMMISSION MEETING OF J U L 1 3 1995 Revolution No. �5- 601 WHEREAS, MABA has asked the City Commission to waive all user fees for the use'of the Bobby Maduro Miami Baseball Stadium; and WHEREAS, the City Commission wishes to authorize the same terms and conditions for the presentation of said baseball games as established in previous years; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY ( OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The same special charges, terms, and conditions, as established in previous years, including the waiver of all user fees and lighting, for the use of the Bobby Maduro Miami Baseball Stadium by the Miami Amateur Baseball Association ("MABA") for the presentation of baseball games to be held August 6, 1995 through December 17, 1995, are hereby authorized. Section 3. The City Manager is hereby authorizedi to execute an agreement, in a form acceptable to the City Attorney, between the City of Miami and MABA for said purpose, subject to the organizers obtaining insurance to protect the City in an amount as prescribed by the City Manager or his designee. ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2- 95- 601 s PASSED AND ADOPTED this 13th day of July, 1995. 44 .
