HomeMy WebLinkAboutR-95-0567RESOLUTION NO. `, `� 6) 7 A RESOLUTION COMPUTING A PROPOSED MILLAGE RATE FOR THE CITY OF MIAMI, FLORIDA, FOR FISCAL YEAR BEGINNING OCTOBER 1, 1995 AND ENDING SEPTEMBER 30, 1996; INSTRUCTING THE CITY MANAGER TO SUBMIT SAID PROPOSED MILLAGE RATE TO THE BADE COUNTY PROPERTY APPRAISER AND THE TAX COLLECTOR TOGETHER WITH THE DATE, TIME AND PLACE OF THE PUBLIC HEARING AT WHICH THE CITY COMMISSION WILL CONSIDER THE PROPOSED MILLAGE RATE AND THE CITY'S TENTATIVE BUDGET FOR SAID FISCAL YEAR. WHEREAS, the State Legislature has enacted HB-4D, entitled "Truth in Millage" (Trim Bill) which requires municipalities to compute a proposed millage rate; and WHEREAS, said law stipulates that said proposed millage rate be submitted to the Property Appraiser and the Tax Collector; and WHEREAS, said rate will reflect the levy necessary to fund the City's tentative budget other than the portion of the budget to be funded from sources other than ad valorem taxes; and WHEREAS, the proposed millage rate submitted to the Property Appraiser is not binding but .is necessary for the purpose of preparation of tax notices; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: :CTTY COMMISSION MEETING OF J U L 1 3 1995 Resolution No. 95- 567 Section 1. A proposed millage rate for the City of Miami, Florida, for Fiscal Year beginning October 1, 1995 and ending September 30, 1996, is hereby computed as follows: General Operating 9.5995 Debt Service 2.1060 Total Millage Rate 11.7055 Section 2. The City Manager is hereby instructed to submit forthwith said proposed millage rate for the City of Miami to the Property Appraiser and to the Tax Collector together with the date, time and place at which the City Commission will hold a public hearing to consider the proposed millage rate and the City's tentative budget for said fiscal year, as follows: September 14, 1995 at 5:05 P.M. and September 28, 1995 at 5:05 P.M. in the Commission Chambers at City Hall, 3500 Pan American Drive, Dinner Key, Miami, Florida. Section 3. This Resolution shall become effective immediately upon its adoption. PASSED AND ADOPTED this 13th day of July 1995. SItPHEN P. Q JO S II REFERENCES: Proposed Citywide Mlllage Rates City Attorn y ENCLOSURES: Pursuant to your memorandum of August 3, 1995, we reviewed the transcript you provided for Item #91 (Resolution No. 94-567, adopted July 13, 1995), concerning the proposed millage rate for the City of Miami for Fiscal Year beginning October 1, 1995 and ending September 30, 1996. Thus, we are in complete accord with your findings that the Finance Director did clearly state on the record that "... we are recommending the same millage as of Fiscal Year `95, which is 11.7055". The Resolution that you presently have in your possession reflects those rates submitted to this Office by the Budget Division prior to the distribution of the July 13th City Commission Agenda Packet. We were unaware that the rates were to be modified at the Meeting so the signed -off legislation was routinely forwarded to your office for execution, Consequently, we are transmitting the attached modified original Resolution which reflects the computations as presented for the record at the City Commission Meeting. Foeman REFERENCES : R-95-567 City Clerk ENCLOSURES : (3 pages) This memorandum is being written to seek clarification surrounding the passage of agenda item 91 (R 95-567 -- compute proposed millage rate for the City of Miami for the fiscal year beginning October 1, 1995 and ending September 30, 1995 [FY 96]). Attached hereto is a copy of the minutes from said proceedings pertaining to the above -cited issue. Contained in said excerpt, the Finance Director clearly states that there would be no increase in the total millage rate for FY 96 (11.7055). However, he did not mention on the public record that the total millage rate and the debt service should be changed in the legislation. There is no discussion concerning the issue of debt service. In the prepared resolution which has now been executed on file in our office, the total millage rate as contained in said legislation is 11.8599, and not 11.7055. Additionally, the debt service appearing in said legislation is 2.2604. This also needs to be changed in the legislation. If you were to add the general operating (9.5995) plus the correct debt service portion (2.1060), it would equal the correct total millage rate as was given by the finance director (11.7055). Chief Deputy Clerk Sylvia Lowman, of my staff, In a recent conversation with Revenue Management Administrator Dipak Parekh, was informed that the debt service was incorrect and it should be 2.1060. In closing, we respectfully request clarification from you regarding this matter, and guidance as to the feasibility of amending said instrument reflecting the correct proposed millage rate. 95- 567 ----------------------------------------------------------------- ----------------------------------------------- 99.
