RESOLUTION NO.
A RESOLUTION, WITH ATTACHMENTS, APPROVING IN
PRINCIPLE, THE DESIGNATION OF THE EAST LITTLE
HAVANA COMMUNITY DEVELOPMENT CORPORATION, A
NOT -FOR -PROFIT CORPORATION, AS SPONSOR TO
UNDERTAKE THE DEVELOPMENT OF A 50-75 UNIT
RESIDENTIAL/RETAIL MIXED USE PROJECT
CONSISTING OF 10,000-15,000 SQUARE FEET OF
RETAIL SPACE PLANNED FOR DEVELOPMENT ON SIX
(6) PARCELS OF VACANT LAND UNDER CITY -
OWNERSHIP LOCATED AT 1435, 1453 AND 1461
SOUTHWEST 8TH STREET IN THE LITTLE HAVANA
NEIGHBORHOOD, SUBJECT TO SAID CORPORATION
PROVIDING EVIDENCE ACCEPTABLE TO THE CITY OF
FIRM COMMITMENTS FOR PROJECT CONSTRUCTION AND
PERMANENT FINANCING; DIRECTING THE EAST
LITTLE HAVANA COMMUNITY CORPORATION TO
PREPARE AND FINALIZE PROJECT PLANS AND
SPECIFICATIONS, CONSTRUCTION AND PERMANENT
FINANCING, AND CONSTRUCTION SCHEDULE TO BE
SUBMITTED WITHIN TWELVE (12) MONTHS OF THE
DATE OF THIS ACTION FOR FINAL CONSIDERATION
AND APPROVAL BY THE CITY COMMISSION; FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AN
ACCEPTABLE RETURN TO THE CITY FOR THE VALUE
OF SAID PARCELS WITH THE EAST LITTLE HAVANA
COMMUNITY DEVELOPMENT CORPORATION, PREDICATED
ON A LAND REIMBURSEMENT PROVISION.
WHEREAS, there exists in the City of Miami, a severe
shortage of housing within the affordability range of families
and individuals of low and moderate income; and
WHEREAS, the City Commission recognizes that participation
of both the public and private sector is necessary to foster the
"F development of housing affordable to low and moderate income
families and individuals in the City; and

WHEREAS, in an effort to promote the development of
affordable housing in the City, the City Administration
recommends the granting of development rights to the East Little
Havana Community Development Corporation for the development of a
50-75 unit residential/retail mixed -use project planned for
development on six (6) vacant parcels of City -owned land located
in theLittleHavana neighborhood, subject to certain terms and
conditions;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. East Little Havana Community Development
Corporation, a not -for -profit corporation, is hereby designated,
in principle, as sponsor to undertake the development of a 50-75
unit residential/retail mixed use project consisting of 10,000-
15,000 square feet of retail space, affordable to low and
moderate income families and individuals on six (6) vacant City -
owned parcels, located in the Little Havana neighborhood, more
particularly described in Exhibit A, subject to said corporation
providing evidence acceptable to the City of firm commitments for
project construction and permanent financing. Development rights
granted to the East Little Havana Community Development
corporation shall be only for a period of three (3) years from
the date of this conditional award by the City Commission.

Section 3. East Little Havana Community Development
Corporation is hereby directed to prepare and finalize project
plans and specifications, construction and permanent financing,
construction schedule which shall be submitted within twelve (12)
months of the date of this action for final consideration and
approval by the City Commission.
Section 4. The City Manager is hereby further authorized
to negotiate an acceptable return to the City for the value of
said parcels with the East Little Havana Community Development
Corporation, predicated on a land reimbursement provision.
Section 5. The City will continue to retain ownership
(title) and use of the subject parcels until City Commission
approval and authorization to transfer the subject parcels to the
East Little Havana Community Development Corporation is secured
at a later date.
Section 6. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached resolution approving in principle, the designation of
the East Little Havana Community Development Corporation, a not -
for -profit housing corporation, as sponsor to undertake the
development of a 50-75 unit residential/retail mixed -use project
on six (6) vacant parcels under city -ownership in the Little
Havana neighborhood.
BACKGROUND:
-The Department of NET, Offices of Development and Asset
Management and -Capital Improvements recommend ratification of the
attached resolution, approving in principle, the designation of
the East Little Havana Community Development Corporation, as
sponsor to undertake the development of 50-75 unit
residential/retail mixed -use project on six (6) vacant parcels
under city -ownership located at 1435, 1453 and 1461 Southwest 8th
street in the Little Havana neighborhood. The retail component of
the project would consist of approximately 10,000-15,000 square
feet.
The attached resolution requires that final designation of the
East Little Havana Community Development Corporation as project
sponsor is predicated upon the submission within twelve (12)
months, from the date of this conditional award, for the City
Administration's verification and the City Commission review and
approval:
1) Final housing/retail site plan and specifications.
2) Verifiable evidence of firm commitments for construction
and permanent financing in accordance with the sponsor's
proposal to develop the proposed residential/retail
mixed -use project.

3) Land reimbursement provision that provides an acceptable
return to the City for the value of the subject parcels.
The East Little Havana Community Development Corporation will be
only entitled to development rights of the said parcels for a
period of three (3) years from the date of this conditional
award. The City will continue to retain ownership and use of the
subject parcels until City Commission approval and authorization
to transfer the subject parcels to the East Little Havana
Community Development Corporation is secured at a later date.
The City is in a position to assist the private sector in the
development of 50-75 new homeownership housing units, affordable
to low and moderate income families, in addition to 10,000-15,000
square feet of retail space in Little Havana, by making six (6)
parcels of vacant land currently under city -ownership available
for such development. In an effort to further promote the
development of new homeownership housing units in the Little
Havana neighborhood, City Commission ratification of the attached
resolution is recommended.
