A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION AFTER A
DULY ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING OF AN EMERGENCY SITUATION REQUIRING
AN INCREASE IN FEES FOR ADDITIONAL
PROFESSIONAL SERVICES NOT TO EXCEED
$24,753.00 IN THE PROFESSIONAL SERVICES
AGREEMENT BETWEEN THE CITY OF MIAMI AND POST,
BUCKLEY, SCHUH & JERNIGAN, INC., FROM
$47,760.00 TO $72,513.00 FOR THE "PREPARATION
OF A FACILITY MASTER PLAN FOR SITE
CONSOLIDATION OF SELECTED CITY MAINTENANCE
FUNCTIONS", B-3249, CAPITAL IMPROVEMENT
PROJECT NO. 311018, AS APPROPRIATED BY
CAPITAL IMPROVEMENTS ORDINANCE NO. 11205 FROM
FUNDS ALREADY APPROPRIATED TO THE PROJECT.
WHEREAS, the City of Miami has entered into a professional
services agreement with firm of Post, Buckley, Schuh, & Jernigan,
Inc. ("PBS&J") for a feasibility study to consolidate selected
City maintenance functions of the City of Miami Municipal Shops
as authorized by Resolution No. 94-455; and
WHEREAS, said master plan and feasibility study concluded
that the existing Heavy Equipment Facility site and Solid Waste
Building could not accommodate all employee parking and program
requirements necessary to consolidate all City maintenance
.functions; and

WHEREAS, the City Manager has made a written finding that a
valid emergency existed which required the work to continue as
expeditiously as possible to protect the health, safety and
welfare of the citizens of the City; and
WHEREAS, PBS&J was directed to provide additional services
for alternate programming studies, concepts and revised layouts
of various site plans which included off site programs and
employee parking in order to gain maximum use of the site; and
WHEREAS, PBS&J has completed the required additional
services and has provided all deliverables to the City; and
WHEREAS, the total cost for said additional services has
been determined to be $24,753.00, which is considered to be fair
and reasonable; and
WHEREAS, funding for said additional services is available
from Capital Improvement Project No. 311018, as appropriated by
Ordinance No. 11205;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings set forth in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a 4/5ths affirmative vote of members of
the City Commission, after a duly advertised public hearing, the
City Manager's finding of an emergency situation requiring an
increase in fees for additional professional services not to
exceed $24,753.00 in the professional services agreement between
the City of Miami. and Post, Buckley, Schuh & Jernigan, Inc., from
$47,760.00 to $72,513.00 for the "preparation of a Facility
Master Plan for Site Consolidation of Selected City Maintenance
Functions", B-3249, Capital Improvement Project No. 311018, as
appropriated by Capital Improvements Ordinance 11205 from funds
already appropriated to the project is hereby ratified, approved
and confirmed.
Section 3. This Resolution shall become effective
immediately upon its adoption.

i RECOMMENDATION
It is respectfully recommended that the City Commission
adopt the attached resolution authorizing an increase in
fees for additional professional services by an amount not
to exceed $24,753.00 in the professional services agreement
between the City of Miami and Post, Buckley, Schuh, &
Jerinigan, Inc. for the feasibility study entitled
"Preparation of a Facility Master Plan for Site
Consolidation of Selected City Maintenance Functions-"
BACKGROUND
The City of Miami has entered into a professional services
agreement with the firm of Post, Buckley, Schuh, & Jernigan,
Inc. ("PBS&J") for a feasibility study to consolidate
selected City maintenance functions of the City of Miami
Municipal Shops as authorized by Resolution No. 94-455. The
master plan and feasibility study has been completed which
concluded that the existing site of the Heavy Equipment
- Facility and Solid Waste Building could not accommodate all
ejuployee parking and program requirements.
Due to the extreme time constraints placed upon the City as
a result of the land sale agreement with the Dade County
Public Health Trust, PBS&J was directed to provide
additional services as expeditiously as possible for
a1 Lerna to programming studies, concepts and revised layouts
of various site plans which included off site programs and
eanployee parking in order to gain maximum use of the site.
P13S&J has completed the required additional services and has
provided all deliverables to the City. The total cost for
these additional services increases the professional
services contract from $47,760.00 to $72,513.00.

This memorandum serves as a written finding of a valid public
emergency pertaining to the need for additional services and

Plan for Site Consolidation of Selected City Maintenance
Functions
'.t'he T'acility Master Plan has been completed which concluded that
t.lie existing site of the Heavy Equipment Facility and Solid Waste
nu i.ld i.ng could not accommodate all employee parking and program
requirements. It is necessary to conduct additional programming
.-arid site evaluations as expeditiously as possible to determine
which City functions will remain at the site and how employee
parking can be accommodated.
The finding is based on the following:
1. The property where the City of Miami Motor Pool Facility,
Communications Building and Public Works Maintenance
Building are located is being sold to the Dade County
Public Health Trust.
2. Several departments must move from their existing
locations to the Heavy Equipment Facility site.
3. The Motor Pool facilities must be relocated by the summer
of 1995.
4. Construction activities must occur prior to the move to
provide adequate parking and infrastructure at the City's
Heavy Equipment Facility prior to the move.

5. The normally required procedures and scheduling
requirements for entering into a new professional services
agreement will needlessly and unwisely delay the transfer
of operations
Such conditions indicate the need for extraordinary measures to
protect the health, safety and welfare of the community and the
convenience of the City. In order to determine, as expeditiously
as possible, which City functions and programs remain at the
site, it is necessary to proceed with additional studies and site
programming by PBS&J. These additional services will result in
an Increase in contract fees by $24,753.00.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the Commission of the City of
Miami, Florida, on July 13, 1995, at in the City
Commission Chambers at City Hall, 3500 Pan American Drive, Miami,
Florida for the purpose of hearing any comments by the City
Commission from any interested parties affected by an Emergency
Resolution authorizing an increase in fees for additional
professional services by an amount not to exceed $24,753.00 in
the professional services agreement between the City of Miami and
Post, Buckley, Schuh and Jerinigan, Inc. for the feasibility
study entitled "Preparation of a Facility Master Plan for Site
Consolidation of Select City Maintenance Functions". All
interested persons are invited to appear and may be heard
concerning the street opening. Should any person desire to
appeal any decision of the City Commission with respect to any
matter considered at this hearing, that person shall ensure that
a verbatim record of the proceedings is made, including all
testimony and evidence upon which any appeal may be based.
