HomeMy WebLinkAboutR-95-0530RESOLUTION NO. 9 5 530 A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY SITUATION REQUIRING AN INCREASE, IN AN AMOUNT NOT TO EXCEED $32,000, IN THE CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA, AND F & L CONSTRUCTION, INC., DATED SEPTEMBER 12, 1994, FROM $368,800 TO $400,800, FOR ADDITIONAL IMPROVEMENTS IN DOWNTOWN STREET IMPROVEMENTS -SIDEWALK REBUILDING PROJECT B-4570; ALLOCATING FUNDS THEREFOR AS PREVIOUSLY APPROPRIATED BY ORDINANCE NO. 11205, AS AMENDED, FROM CAPITAL IMPROVEMENT PROJECT NO. 341135; FURTHER RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S DECISION TO ALLOW F & L CONSTRUCTION, INC. TO PROCEED WITH SAID ADDITIONAL IMPROVEMENTS. WHEREAS, the contract dated September 12, 1994, between the City of Miami, Florida, and F & L Construction, Inc. for Downtown Street Improvements- Sidewalk Rebuilding Project B-4570, (the "Contract") consists of replacing deteriorated and/or hazardous concrete sidewalks, curbs and gutters in the Downtown Impact Fee area bordered by the Miami River, Biscayne Bay, NE/NW 14th Street, and NW 7th Avenue (the "Project"); and CITY COMISSSION MEETING br,, 1 J U L 1 14nnr- R9o,u► 9 5,`� r WHEREAS, in addition to the work included in the Project, additional hazardous and deteriorated sidewalks, curbs and gutters in the Downtown area should be replaced; and WHEREAS, at the present time an unencumbered balance of $32,000 is available from monies already appropriated to the Project from Capital Improvement Project No. 341135; and WHEREAS, the City Manager determined that the most cost effective and expeditious method by which to accomplish the additional improvements is to increase the price of the Contract from $368,800.00 to $400,800.00 and to authorize F & L Construction, Inc. to proceed with the additional improvements; WHEREAS, the City Manager has made a written finding that a valid emergency existed which required the work to continue as expeditiously as possible to protect the health, safety and welfare of the citizens of the City; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a 4/5ths affirmative vote of the members of the City Commission after a duly advertised public hearing, 2- 95- 530 d�ki�tf?�p� the City Manager's finding of an emergency situation requiring an increase, in an amount not to exceed $32,000, in the contract between the City of Miami, Florida, and F & L Construction, Inc. dated September 12, 1994, from $368,800 to $400,800, for additional improvements in Downtown Street Improvements -Sidewalk Rebuilding Project B-4570, is hereby ratified, approved and confirmed, with funds therefor hereby allocated, as previously appropriated by Ordinance No. 11205, as amended, from Capital Improvement Project No. 341135. Section 3. The City Manager's decision to allow F & L Construction, Inc. to proceed with the replacement of additional deteriorated and/or hazardous sidewalks, curbs and gutters in the Downtown Impact Fee area is further ratified, approved and confirmed. BACKGROUND: The Department of Public Works, in an - effort to serve all residents of the City of Miami, has determined that it is now appropriate and in order for the City Commission to ratify the City Manager's decision to increase the contract dated September 12, 1994, between the City and F & L Construction, Inca for construction of Downtown Street Improvements- Sidewalk Rebuilding Project B-4570 in the amount not to exceed $32,000. The contract increase is to pay for additional replacement of deteriorated and/or hazardous concrete sidewalk and curb & gutter in the downtown area bordered by the Miami River, Biscayne Bay, NE/NW 14th Street and NW 7th Avenue. The City Commission awarded a contract to F & L Construction, Inc. for said project in the amount of $368,800. The project is being funded by Impact Fees appropriated under Capital Improvement Project No. 341135. (These Impact Fees can only be utilized in the Downtown area.) At the present time an unencumbered balance of $32,000 is available to pay for a continuation of the on -going improvements in the Downtown Impact Fee area. 95— 530 /o,/ A considerable amount`of hazardous and deteriorated sidewalk, curb & gutter, still needs to be replaced in the downtown area.
