.A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION AFTER A
DULY ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING, THE CITY MANAGER'S
FINDING OF AN EMERGENCY SITUATION REQUIRING
AN INCREASE, IN AN AMOUNT NOT TO EXCEED
$12,877, IN THE CONTRACT BETWEEN THE CITY OF
MIAMI, FLORIDA, AND MARIN & MARIN
CONSTRUCTION, INC. DATED APRIL 15, 1994, FROM
$290,253 TO $303,130, FOR MARINA IMPROVEMENTS
MIAMI YACHT CLUB - SECOND BIDDING PROJECT
H-1068; ALLOCATING FUNDS THEREFOR AS
PREVIOUSLY APPROPRIATED BY ORDINANCE
NO. 11205, AS AMENDED, FROM CAPITAL
IMPROVEMENT PROJECT NO. 311808.
WHEREAS, the contract dated April 15, 1994, between the City
of Miami, Florida, and Marin & Marin Construction, Inc. for
construction of Marina Improvements Miami Yacht Club - Second
Bidding, Project H-1068, (the "Project") with allocated funds
appropriated by Ordinance No. 11205, as amended, from Capital
Improvements Project No. 311808, requires an increase in price in
an amount not to exceed $12,877.00 to construct rip -rap at the
shoreline as required by permitting agencies; and
WHEREAS, the Director of Public Works, the Director of Asset
Management and Capital Improvement and the City Manager recommend
the increase in the contract price to cover the additional costs;
and

WHEREAS, funds to cover the increase in contract price are
available from FEMA monies already appropriated to the Project;
WHEREAS, the City Manager has made a written finding that a
valid emergency existed which required the work to continue as
expeditiously as possible to protect the health, safety and
welfare of the citizens of the City; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a 4/5ths affirmative vote of the members
of the City Commission, after a duly advertised public hearing,
the City Manager's finding of an emergency situation requiring an
increase, in an amount not to exceed $12,877, in the contract
between the City of Miami, Florida, and Ma.rin & Marin
Construction, Inc. dated April 15, 1994, from $290,253 to
$303,130, for construction of Marina Improvements Miami Yacht
Club - Second Bidding, Project H-1068, is hereby ratified,
approved and confirmed, with funds therefor hereby allocated as
previously appropriated by Ordinance No. 11205, as amended, from
Capital Improvement Project No. 311808.
Section 3. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached Resolution authorizing an increase in the contract
between Marin & Marin Construction, Inc., and the City of Miami
for Miami Yacht Club Marina Improvements project H-1068 in the
amount of $12,877.00.
BACKGROUND
The City Commission awarded a contract to Marin & Marin
Construction, Inc. for the installation of concrete deck '-on
concrete piles; and installation of water, electric and fire
protection utilities for the north and central dock.
As part of this hurricane -related job, there was extra work
required to obtain permits for the project by Dade County
Department of Environmental Resources Management and Florida
Department of Environmental Protection. These agencies required
the placement of 150 cubic yard of Limestone RIP -RAP boulders at
the shoreline as mitigation for issuing their respective permits.
The cost of this work is $12,877.00. Funds for the increase in
contract are available from FEMA monies already appropriated to
Capital Improvement Project No. 311808 by Ordinance No. 11205, as
amended.

NOTICE TO THE PUBLIC '
PLEASE ALL TAKE NOTICE THAT a public hearing will be held by the
City Commission of the City of Miami, Florida, on July 13, 1995,
at 10:00 a.m., in the City Commission Chambers at City Hall, 3500
Pan American Drive, Miami, Florida, for the purpose of hearing
any objections from any interested parties affected by an
increase in the contract between Marin & Marin Construction, Inc.
and the City of Miami in an amount not to exceed $12,877 for the
construction of RIP -RAP at the Shoreline on the Miami Yacht Club
Marina Improvements Project H-1068, Project No. 11205.
All interested persons are invited to appear and may be heard in
connection with this item. Should any person desire to appeal
any decision of the City Commission with respect to any matter
considered at this hearing, that person shall ensure that a
verbatim record of the proceedings is made, including all
testimony and evidence upon which any appeal may be based.
