RESOLUTION NO. 9 5 —
A RESOLUTION, WITH ATTACHMENTS, ACCEPTING THE
PLAT ENTITLED WOODLAWN PARK CEMETERY 1ST
ADDITION, A SUBDIVISION IN THE CITY OF MIAMI,
SUBJECT TO ALL OF THE CONDITIONS OF THE PLAT
AND STREET COMMITTEE, AND ACCEPTING THE
DEDICATIONS SHOWN ON SAID PLAT; AUTHORIZING
AND DIRECTING THE CITY MANAGER AND CITY CLERK
TO EXECUTE THE PLAT; AND PROVIDING FOR THE
RECORDATION OF SAID PLAT IN THE PUBLIC
RECORDS OF DADE COUNTY, FLORIDA.
WHEREAS, the City Department of Public Works recommends the
acceptance of the plat;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OIL' THE CITY
OF MIAMI, FLORIDA:
Section 1. The plat entitled WOODLAWN PART: CCM ETERY 1ST
ADDITION, is a resubdivision of Tract 2, "Boundaries of Woodlawn
Park Cemetery", Plat Book 44, Page 70, and all of Block h, lying
Northerly of said Tract 2, "Tamiami Pines", Plat Book 14, Page
23, and the Southerly 211.1 feet of Tract 1, "Boundaries of
Woodlawn Park Cemetery", Plat Book 44, Page 70, and Southwest 33
Avenue :from the South right-of-way line of Southwest 11 Street
extended to the North line of Tract 3, "Boundaries of Woodlawn
Park Cemetery", Plat Book 44, Page 70, all lying in. Section 9,
Township 54 South, Range 41 East, City of Miami, Dade County,
Florida, being more particularly described on the attached
ATTACHMENT 1, which plat by reference is made a part 'hereof as if

fully incorporated herein, and, subject to all of the conditions
required by the Plat and Street Committee as set forth as Exhibit
"A" attached hereto is hereby accepted. The dedications shown on
the plat together with the dedications to the perpetual use of
the public of all existing and future planting, trees and
shrubbery on said property, are also her,.by accepted and
confirmed by the City of Miami, Florida.
Section 2. The City Manager and City Clerk are hereby
authorized and directed to execute the plat and cause the same to
be recorded in the Public Records of Dade County, Florida.
Section 3. This Resolution shall become effective
immediately upon its adoption.

PLAT #1465
The City of Miami Plat and Street Committee, at its meeting of June
2, 1993, approved the above tentative plat subject to the following
revisions being made to the tentative plat, additional information
being provided and/or variances being granted. Please be advised
that the processing of your tentative plat cannot proceed until
these conditions have been satisfied.
- Dedicate Water & Sewer easement within area to be
vacated and closed for water service or contact MDWASAD
for relocation and service.
- Dade County Subdivision Control (Public Works) require
existing and proposed grave sites to be shown on the
plat.
- Provide fractional description at location sketch.
- Provide north arrow on main sketch.
- Provide square footage of area to be"vdcated.
- Include state plane coordinates on final plat.
- Final plat must be drawn on 30" X 36" mylar.
- Provide emergency access easement to the existing
maintenance building and an 8-inch water main extension
with fire hydrant.
- Tract "A" should be designated G/I (Government and
Institution).

- Unity of Title with cemetery is required prior to final
plat. This document must be approved by the Department
of Law.
- Provide more detailed information on east side of S.W.
33 Avenue at S.W. 11 Street, i.e., topography and
elevations.
- Check all adjacent subdivision in the main sketch and
location sketch.
Correct legal description: "All of tract 2, Plat Book
44 at Page 70 and all remnant parcels of lots".
Provide deeds for all lots and remnant parcels.
The Plat and Street Committee has reviewed the public
interest requirements set forth in Sec. 54.5-16 of the
Miami City Code for the vacation and closure of S.W. 33
Avenue and recommends to the Miami Zoning Board that
the street be vacated and closed. Please provide a
legal opinion regarding reversionary rights on the
closure of S.W. 33 Avenue along with your application
for public hearing to the Hearing Boards Division of

the Planning, Building and Zoning Department.
In addition to the above requirements, you should be aware of
1 the following:
1. State and local laws require the installation of various
physical improvements in the public rights -of -way when
property is platted. These subdivision improvements
include paving, drainage, landscaping, sidewalks, etc. In
some cases this could represent a substantial investment
on your part.
2. The alteration, relocation or installation of utilities
such as storm and sanitary sewers, electric, telephone,
water, etc., caused by this plat will be at the property
owner's expense. Also, utility easements may be required
on the property being platted.
3. A building permit will not be issued on the property being
platted until the final plat is recorded. Also, the
Certificate of Occupancy for any building construction will
be issued only after all the required subdivision
improvements have been completed.

4. Approval for fire flow requirements must be obtained from
the Fire, Rescue and Inspection Services Department prior
to the issuance of a building permit.
5. Additional items must be provided to the City of Miami
Department of Public Works before the final plat is
submitted to the City Commission for approval. You will be
notified in writing as to what these :items are after the
amount of the bond has been determined for the necessa •,-
subdivision improvements.
6. Tentative plat approval is only valid for one (1) year from
the date of the Plat and Street Committee Meeting at which
time it was approved.
If you have any questions concerning these requirements, please
refer to the attached sheet for the appropriate person to contact.

33 AVENUE AND SOUTHWEST 34 AVENUE
A SUBDIVISION IN THE CITY OF MIAMI, FLORIDA
The accompanying Plat entitled WOODLAWN PARK CEMETERY 1ST
ADDITION was prepared by E.R. Brownell & Associates, Inc. It is
in correct form for submission to the City Commission and is
forwarded with a recommendation that it be approved.
PERTINENT INFORMATION REGARDING THE PLAT:
1. The property platted is a resubdivision of Tract 2,
"Boundaries of Woodlawn Park Cemetery", Plat Book 44, Page
70, and all of Block 6, lying Northerly of said Tract 2,
"Tamiami Pines", Plat Book 14, Page 23, and the Southerly
211.1 feet of Tract 1, "Boundaries of Woodlawn Park
Cemetery", Plat Book 44, Page 70, and Southwest 33 Avenue
from the South right-of-way line of Southwest 11 Street
extended to the North line of Tract 3, "Boundaries of
Woodlawn Park Cemetery", Plat Book 44, Page 70, all lying
in Section 9, Township 54 South, Range 41 East, City of
Miami, Dade County, Florida. The area platted consists of
six (6) tracts containing 2.47 + acres. It is zoned G/I.

2. The location of the streets and the widths conform with the
standards of the Department of Public Works of the City of
Miami, Florida.
3. As certified to by Thomas Brownell, Registered Surveyor
and Mapper, this Plat complies with the plat filing Laws of
the State of Florida.
4. The City Zoning Board of Miami, Florida, after Public
Hearing, has recommended the closing of that portion of
Southwest 33 Avenue lying between the South right-of-way
line of Southwest 11 Street extended and the North line of
Tract 3, "Boundaries of Woodlawn Park Cemetery", Plat Book
44, Page 70. This action was confirmed by City Commission
Resolution No. 94-903.
5. The Certificate of Title Examination, dated March 27, 1995,
signed by James S. Groh, Attorney, indicates that the fee
simple title to the property platted is correctly vested in

Woodlawn Park Cemetery Company, and the Plat has been
correctly executed.
6. The area platted is not encumbered by mortgages.
7• In accordance with the requirements of Chapter 54, of The
Code of The City of Miami, Florida, a Cashier's Check in
the amount of $28,500.00 has been tendered by the owner,
Woodlawn Park Cemetery Company. This Cashier's Check has
been deposited with the Director of Finance, and it will
guarantee the construction of the subdivision improvements

according to the provisions of the Agreement between the
City of Miami and the aforementioned owner. The
improvements required at the property platted are listed as
follows: new concrete sidewalk, new concrete curb, new
asphaltic concrete pavement, landscaping, and the removal
of existing concrete sidewalk and asphaltic concrete
pavement.
8. The attached Resolution has been prepared for the
acceptance of the Plat by the City Commission of Miami,
Florida.

WRITTEN CONSENT IN LIEU OF A
SPECIAL MEETING OF THE SHAREHOLDERS
AND DIRECTORS OF WOODLAWN PARK CEMETERY CO.
All of the shareholders and directors of Woodlawn Park
Cemetery Co., a Florida Corporation ("Corporation"), hereby adopt
the following resolutions without a meeting, waiving all
requirements of notice, in accordance with Florida Statutes, Title
36, Ch. 607.0702, and the bylaws of the Corporation:
WHEREAS, the best interest of the Corporation would be
served by the replat of the real property situate in
Miami, Florida, currently known as the 1.52 Acre Addition
to Woodlawn Park Cemetery as recorded in Plat Book 44,
page 70 and located at 3260 S.W. Sth Street, it is
therefore:
RESOLVED, that the officers of the Corporation are hereby
authorized to execute and deliver the necessary
documents, applications, certifications as may be
required, to the necessary city, county or state offices.
RESOLVED, that the execution of the plat and any other
necessary documents are authorized to be accomplished by
the Corporation's President and Secretary, and all other
actions taken on behalf of the Corporation in connection
therewith are hereby ratified and confirmed.
FURTHER RESOLVED, that the officers of the Corporation
shall take such further action as they consider necessary
or appropriate to effect the intent of the foregoing
resolution.

With the understanding that this opinion of title is furnished to City of Miami, Florida,
in compliance with Section 54.5-8 of the Miami City Code and as an inducement for acceptance

It is respectfully recommended that the City Commission adopt a
resolution accepting the plat WOODLAWN PARK CEMETERY 1ST ADDITION
and approving recording the same in the Public Records of Dade
County, Florida.
BACKGROUND:
The Department of Public Works has reviewed this plat, and has
determine that it is now in order for acceptance by the City
Commission.
The proposed record plat entitled WOODLAWN PARK CEMETERY 1ST
ADDITION is a resubdivision of Tract 2, "Boundaries of Woodlawn
Park Cemetery", Plat Book 44, Page 70, and all of Block 6, lying
Northerly of said Tract 2, "Tamiami Pines", Plat Book 14, Page
23, and the Southerly 211.1 feet of Tract 1, "Boundaries of
