HomeMy WebLinkAboutR-95-0400i J-95-425 04/18/95 RESOLUTION NO. 9 5 400 A RESOLUTION BY AN AFFIRMATIVE VOTE OF 4/5TH OF THE MEMBERS OF THE CITY COMMISSION DISPENSING WITH THE PROCEDURES FOR THE PROCUREMENT OF PROFESSIONAL SERVICES FOR THE DESIGN OF ALTERATIONS TO THE EXISTING CITY OF MIAMI HEAVY EQUIPMENT FACILITY TO ACCOMMODATE A MOTOR POOL MAINTENANCE SHOP ("PROJECT"); RATIFYING, APPROVING AND CONFIRMING THE CIT-5' MANAGER'S FINDING THAT A VALID PUBLIC EMERGENCY EXISTS JUSTIFYING THE WAIVER OF SAID PROCEDURES; RECOGNIZING THE FIRM OF POST, BUCKLEY, SCHUH, AND JERNIGAN, INC. ("PBS&J") AS THE MOST QUALIFIED TO PROVIDE ARCHITECTURAL AND ENGINEERING SERVICES FOR SAID PROJECT; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A PROFESSIONAL SERVICES AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE FIRM OF POST BUCKLEY, SCHUH AND JERNIGAN, INC. FOR SAID PROJECT, IN AN AMOUNT NOT TO EXCEED $46,600; ALLOCATING FUNDS THEREFOR FROM CAPITAL IMPROVEMENT PROJECT NO. 311018, AS APPROPRIATED BY ORDINANCE NO. 11205, FOR SAID PURPOSE. WHEREAS, there is an urgent need to relocate the City of Miami Motor Pool Maintenance Shop due to the sale of City Property surrounding the existing motor pool facility; and WHEREAS, after a review of space and personnel requirements, it has been determined that the functions carried out by the current Motor pool Maintenance Shop can now be accommodated within the present Heavy Equipment Facility (HEF) building provided that certain alterations and renovations are completed within the HEF itself; and CITY COM USSION, MEETING OF MAY 1 1 1995 Resolution No, Q 5- 400 WHEREAS, PBS&J has completed several studies regarding the City's needs at the HEF site and is most qualified to provide architectural and engineering services for the Project; and WHEREAS, it would be most advantageous and timely for the City Manager to negotiate with PBS&J for said professional services and to enter into an agreement for said purpose; and WHEREAS, funding for said professional services is available from Capital Improvement Project No. 311018, as appropriated by Ordinance No. 11205; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: I Section 1. The recitals and findings contained in the I j Preamble to this Resolution are hereby adopted by reference I thereto and incorporated herein as if fully set forth in this Section. i Section 2. The City Manager's finding that a valid public emergency exists justifying the waiver of required competitive procedures for the procurement of professional architectural and engineering services for the design of alterations to the City of Miami Heavy Equipment Facility to accommodate a Motor Pool Maintenance Shop ("Project") is hereby ratified, approved and confirmed by an affirmative vote of four - fifths (4/5th) of the Members of the City Commission. Section 3. The firm of Post, Buckley, Schuh and Jernigan, Inc. is hereby recognized as the most qualified to provide architectural and engineering services for said Project. -2- 95- 400 tl�J Section 4. The City Manager is hereby authorized-!/ to negotiate and execute a professional services agreement, in a form acceptable to the City Attorney, with the firm of Post Buckley, Schuh and Jernigan, Inc. for said Project, in an amount not to exceed $46,600.00 with funds therefor hereby allocated from Capital Improvement Project No. 311018, as appropriated by Ordinance No. 11205, for said purpose. Section 5. BACKGROUND A recent review of personnel and space requirements has confirmed that the functions carried out by the current Motor Pool Maintenance Shop can be accommodated within the present Heavy Equipment Facility (HEF) building provided that certain alterations and renovations are completed within the HEF structure itself. However, relocation of these functions must be accomplished by the summer of 1995 as provided in the land sale agreement between the City of Miami in the Dade County Public Health Trust. The firm of Post, Buckley, Schuh & Jernigan, Inc. has completed several studies regarding the City's needs at the HEF site and is most qualified to provide architectural and engineering services for these alterations and renovations. Since time is of the essence, it would be in the City's best interest for the City Commission to dispense with the procedures of Section 18- 52.3 of the Miami City Code and authorize the City Manager to negotiate with the firm of Post, Buckley, Schuh & Jernigan, Inc. for professional services for said design of alterations to the HEF and to enter into an agreement for that purpose. 95- 400 CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO : File DATE : FILE : SUBJECT : Emergency Finding: Dispensing With Procedures of Section 18-52.3 of City Code FROM : REFERENCES: ( Professional Services for Design of Alterations at Cesar H. Odio ENCLOSURES: Heavy Equipment Facility for a City Manager Motor Pool Maintenance Shop) This memorandum serves as a written finding of a valid public emergency pertaining to the need to relocate the City's motor pool maintenance shop. It is necessary to procure architectural and engineering services, as expeditiously as possible, for the design of alterations to the City of Miami Heavy Equipment Facility to accommodate a motor pool maintenance shop due to the sale of City property that incorporates the existing motor pool facility. The finding is based on the following: 1. In accordance with certain schedules outlined in the land sale agreement between the City of Miami and the Public Health Trust, the existing motor pool facility must be vacated by the City by June 19, 1995. 2. The new facility will be relocated to the existing Heavy Equipment Facility building. 3. Construction plans and specifications for the alterations to the Heavy Equipment Facility must first be prepared prior to bidding procedures and the City does not have in-house expertise to complete architectural and engineering plans within the anticipated time frame. 4. Services of an outside architectural and engineering (A/E) firm must be retained in order to complete the project as soon as possible. 5. The time frame for selection of an A/E firm to perform these services as set forth in Sec. 18-52.3 of the Miami City Code is eight months, which is unacceptable given the agreed upon relocation schedules. 6. The motor pool facility plays an essential role in providing services to nearly all departments of the City, including the maintenance and repair of police vehicles. These services cannot be halted or interrupted. 95- 400 V, Such conditions indicate the need for extraordinary measures to protect the health, safety and welfare of the community and convenience of the City. In order to initiate the relocation of the motor pool maintenance shop as soon as possible, the procedures for professional services outlined in Section 18-52-3 of the Miami City Code must be dispensed with and a professional services contract negotiated for architectural and engineering services with a firm most familiar with the Heavy Equipment Facility Site and needs of the City in this area. cc: A.
