RESOLUTION NO. 9 5 - 384
A RESOLUTION ACCEPTING PAYMENT IN THE AMOUNT
OF $60,000 FROM THE DADE COUNTY SCHOOL BOARD
AS A CONTRIBUTION FOR THE REOPENING AND
CONSTRUCTION OF JEFFERSON STREET BETWEEN
WASHINGTON AVENUE AND CHARLES AVENUE BY THE
CITY OF MIAMI, FLORIDA; AUTHORIZING THE CITY
MANAGER TO ENTER INTO AN AGREEMENT? IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY— WITH THE
DADE COUNTY SCHOOL BOARD WHEREBY THE CITY
SHALL ASSUME RESPONSIBILITY FOR CONSTRUCTION
OF THE ROADWAY AND ALLOW THE SCHOOL BOARD TO
AUDIT THE ACCOUNTING RECORDS OF THE PROJECT.
WHEREAS, In order to allow a safer and more effective
traffic pattern for school buses traveling to and from George
Washington Carver Middle School, the reopening and construction
of Jefferson Street between Washington Avenue and Charles Avenue
Is hereby recommended; and
WHEREAS, the City of Miami has agreed to accomplish the
reopening and construction of the aforesaid street by accepting
$60,000 from the Dade County School Board as Its contribution
towards the cost of construction, provided that an agreement Is
entered Into between the City of Miami and the Dade County
School Board so that the City can accept responsibility for the
construction of the aforesaid street and the School Board can
audit the accounting records of the project;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference

thereto and Incorporated herein as if fully set forth in this
Section.
Section 2. The City of Miami hereby accepts from the Dade
County School Board a contribution In the amount of $60,000 for
the City's construction of Jefferson Street between Washington
Avenue and Charles Avenue, Miami, Florida.
Section 3. The City Manager is hereby authorized to enter
Into an agreement, in a form acceptable to the City Attorney— ,
with the Dade County School Board, with the City assuming
responsibility for the construction of Jefferson Street between

Washington Avenue and Charles Avenue and allowing the Dade County
School Board to
audit the accounting records of the construction
project.

Section 4. This Resolution shall become effective

It is respectfully recommended that the City Commission adopt the
attached resolution accepting $60,000 from the Dade County School
Board for the reopening and construction of Jefferson Street
adjacent to Esther Armbrister Park and an ordinance amending
Ordinance No. 11205, the City's Capital Improvement
Appropriations Ordinance, to establish a new capital improvement
project to begin during fiscal year 1994-95 in the program area
of 'Transportation and Physical Environment.
BACKGROUND:
In order to allow a safer and more efficient traffic pattern for
school buses travelling to and from George Washington Carver
Middle School the Department of Public Works recommends the
reopening and construction of Jefferson Street between Washington
Avenue and Charles Avenue. This request is supported by the Dade
County School Board which has agreed to fund the physical
reopening of Jefferson Street In the amount of $60,000.
It Is respectfully recommended that the City Commission accept
the contribution from the Dade County School Board and amend the
Capital Improvement Appropriations Ordinance, to establish a new
capital Improvement project entitled "Jefferson Street F.�Ing
Project -Phase II", Project No. 341202, so that the City can
j complete this Important roadway link. Additionally, an agreement
i between the City of Miami and the Dade County School Board will

be necessary so that the City can assume responsibility for the
project and the School Board may be allowed to audit the
accounting records of the project.

This will confirm that the School Board, at its meeting of April
12, 1995, approved agenda item K-20 (see enclosed), providing
funding for the improvement of a portion of Jefferson Street in
order to facilitate school bus access to Carver Middle School. As
discussed, I will prepare a brief Agreement to be executed by the
City Manager and the Superintendent, in order to initiate the
expenditure of funds.
Please keep me advised of the actions of the City of Miami in this
regard, so that I can assure proper coordination with the school
and district staff as the work nroaresses.

SUBJECT: AGREEMENT WITH THE CITY OF MIAMI TO PROVIDE FUNDING
FOR THE IMPROVEMENT OF A PORTION OF JEFFERSON STREET
IN ORDER TO FACILITATE SCHOOL BUS ACCESS TO CARVER
MIDDLE SCHOOL
On July 14, 1994, the City of Miami Commission, at the request of local residents, agreed
to re -open a portion of Jefferson Street adjacent to the Carver Elementary/Carver Middle
School complex, in order to allow the street to be improved as public right-of-way (see
attachment). The portion of Jefferson Street east of the City of Miami park was closed as
public right-of-way in 1977 in order to augment the park site, but has never been developed.

b ,, unusable. In addition, code provisions require the road surface to be brought up to
cu. at standards.
The purpose of the residents' request was to allow district school buses to approach Carver
Middle School without traversing the surrounding residential neighborhood. In addition, the
only available bus route to the school currently requires buses to make a "U" turn at the cul-
de-sac adjacent to the school, creating a i4istical and safety concern.
The City action to re -open the road was subject to funding for the necessary road repairs
being provided by parties other than the City. City staff originally estimated that the work
would cost approximately $148,000. After re -analyzing the scope of the work, City staff now
believes that by doing only that which is necessary to meet basic City code requireme�. and
to serve school district buses, the work can be done at a cost not to exceed $60,000. The
City will have full control of the design and supervision of the work using their own work
fora or an outside contractor. District staff will have final review and approval of the plans
to assure that the scope of the work will serve the purpose of facilitating school bus usage
and will have no negative impact on the operation of either Carver Elementary or Carver
Middle Schools. The City will make every effort to complete the work prior to the
commencement of the 1995-96 school year.
The Region Superintendent for Region IV and the principals of Carver Elementary and
Carver Middle Schools recommend entering into this agreement,.
