A RESOLUTION, WAIVING BY A 4/5THS AFFIRMATIVE
VOTE OF THE MEMBERS OF THE CITY COMMISSION,
AFTER A DULY ADVERTISED PUBLIC HEARING, THE
PROHIBITION CONTAINED IN CITY CODE SECTIONS
2-301 THROUGH 2-304, AS SUCH PROHIBITION
APPLIES TO LAVERNE TAYLOR, WHO SERVES ON THE
CITY OF MIAMI HOUSING OPPORTUNITIES FOR
PERSONS WITH AIDS (HOPWA) ADVISORY BOARD, IN
RELATION TO HER EMPLOYMENT WITH THE
METROPOLITAN DADE COUNTY DEPARTMENT OF HUMAN
RESOURCES (OFFICE OF COMMUNITY SERVICES), A
I SUCCESSFUL PROPOSER FOR THE PROVISION OF
SERVICES IN CONNECTION WITH THE CITY'S 1994
HOPWA PROGRAM FUNDED BY THE U. S. DEPARTMENT
OF HOUSING AND URBAN DEVELOPMENT.
WHEREAS, Laverne Taylor is currently serving as a member of
the City's 1994 HOPWA Advisory Board (HAB) and is employed by the
Metropolitan Dade County Department of Human Resources (Office of
Community Services); and
WHEREAS, Dade County's Department of Human Resources is
seeking to provide housing related services in connection with
the City's 1994 HOPWA Program; and
WHEREAS, Dade County's Department of Human Resources has
been recommended by the HOPWA Selection Committee and the City
Administration to receive 1994 HOPWA Program funding;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2.
The prohibition
contained in Sections 2-301
through 2-304
of the City Code is hereby waived by
a 4/5ths
affirmative vote of the City Commission,
after a duly
advertised
public hearing,
as such prohibition
pertains to Laverne
Taylor
Section 3.
The waiver set
forth in Section 2
hereof is
based upon the recitals and findings contained in Section 1
hereof and upon the following findings:
(a) The City of Miami has determined that Laverne
Taylor is a member in good standing of the City of
Miami Housing Opportunities for Persons with AIDS
(HOPWA) Advisory Board and is currently employed
by Metropolitan Dade County Department of Human
Resources (Office of Community Services), being
the successful proposer for the provision of
services in connection with the City's 1994 HOPWA
j Program which is funded by the U. S. Department of

would be in violation of Sections 2-301 through 2-
304 were there not a waiver of the prohibition
contained in said Sections.

(b) The herein proposed participation will be in the
best interest of the City of Miami in connection
with implementation of the 1994 HOPWA Program.
Section 4. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached resolutions, waiving by a 4/5th affirmative vote of the
City Commission, the prohibitions contained in City Code Sections
2-301 through 2-304, to allow four (4) members of the City's
HOPWA Advisory Board and their respective organizations to
receive funding and provide housing related services to persons
with HIV/AIDS, in connection with the implementation of the
City's 1994 HOPWA Program.
BACKGROUND:
The Department of Development and Housing Conservation recommends
ratification of the attached resolutions, waiving by a 4/5ths
affirmative vote of the City Commission, the prohibition
contained in City Code Sections 2-301 through 2-304, to allow
four (4) members of the City's HOPWA Advisory Board and their
respective organizations to receive funding and provide housing
related services to persons with HIV/AIDS, in connection with the
implementation of the City's 1994 HOPWA Program.
In July of 1994, the City of Miami, on behalf of Metropolitan
Dade County and the cities of Hialeah and Miami Beach, applied
for $5,155,000 in Housing Opportunities for Person with AIDS
(HOPWA) Program funding from the U.S. Department of Housing and
Urban Development. In November of 1994, the City was notified by
U.S. HUD that its application for $5,155,000 in HOPWA Program
funding had been approved.
In January and March, 1995, the Department of Development and
Housing Conservation solicited applications from local area AIDS
service providers for the purpose of providing housing related
assistance to individuals with HIV/AIDS in connection with the
HOPWA Program. Subsequently, all of the HOPWA Program funding
applications received by the Department were rejected due to a

conflict of interest in the programmatic content and application
evaluation criteria by which HOPWA Program funding would be
awarded. This instance occurred largely due to the fact that
several of the organizations that applied for HOPWA Program
funding also had representatives on the HOPWA Advisory Board that
developed the contents of the funding application and the
evaluation criteria by which funding would be awarded. As a
result, the City readvertised on March 31, 1995 for new proposals
from local area HIV%AIDS service providers. On April 17, 1995,
the proposals submitted in response to the City's advertisement
were reviewed by a newly appointed Selection Committee which
consist of representatives not directly affiliated with the
City's HOPWA Advisory Board.
Based on the proposals which were received and the
recommendations of the Selection Committee, funding has been
recommended for four (4) organizations that currently have
representatives on the HOPWA Advisory Board. The names of the
individuals and organizations are listed below:

In an effort to expedite the provision of housing related
services to persons with HIV/AIDS under the City's 1994 HOPWA
Program, it is recommended that the City Commission approve the
waiver of the Conflict of Interest provision, as outlined in
Sections 2-301 through Section 2-304 of the City Code, for the
aforementioned individuals and organizations.
