A RESOLUTION RATIFYING, APPROVING AND CONFIRMING THE
CITY MANAGER'S ACTION IN WAIVING THE REQUIREMENT FOR
COMPETITIVE SEALED BIDS FOR THE EMERGENCY REPAIRS TO
THE BAYFRONT PARK ELECTRICAL SERVICE BY EDD HELMS
ELECTRICAL CONTRACTING (NON-MINORITY/NON-LOCAL
VENDOR), IN THE AMOUNT OF $7,695.32; ALLOCATING FUNDS
THEREFOR FROM CAPITAL IMPROVEMENT PROJECT NO. 331305,
INDEX CODE NO, 3193011-340, AS APPROPRIATED BY THE
1993-94 CAPITAL IMPROVEMENT ORDINANCE; FURTHER
RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S
ISSUANCE OF AN EMERGENCY PURCHASE ORDER FOR THIS
PURPOSE.
WHEREAS, Bayfront Park is one of the most important locations for public
events in the City of Miami and is the site of the annual Orange Bowl Parade
on New Year's Eve; and
WHEREAS, the existing underground electrical service in Bayfront Park
was installed y the U.S. Army Corps of Engineers which provides electric power
to the Flagler Promenade and for the television broadcast trucks which are
used for the national television broadcasting of the Orange Bowl Parade; and
WHEREAS, the U. S. Army Corps of Engineers had not yet provided the City
of Miami with "as -built" plans of the existing underground electrical cable
locations and contractors working on park improvements had no way of locating
the underground service locations within the park; and
WHEREAS, during the installation of utilities, drainage structures and
fencing improvements in the south end of the park, a major incident occurred
shortly before the Orange Bowl Parade when the electrical service lines were

damaged cutting off all electric power to the television broadcast trucks and
another later incident occurred cutting off all electrical power to scheduled
events on the Flagler Promenade; and
WHEREAS, because of the City's obligations for the Orange Bowl Parade
and other scheduled events, as well as for the welfare, convenience, and
safety of the public, the Bayfront Park Management Trust and the Department of
Public Works recommended immediate "emergency" repairs to be done by the
park's electrical contractor, Edd Helms Electrical Contracting; and
WHEREAS, under the authority of Section 18-52.6 of the City Code, the
City Manager authorized the "emergency" work in order for the city to fulfill
its obligations to the public and for the Orange Bowl Parade and other public
events scheduled in the Park; and
WHEREAS, the funds for the "emergency" in the amount of $7,695.32 are
available from CIP Project No. 331305 as appropriated by the FY '1993-94
Capital Improvement Ordinance;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this
Resolution are hereby adopted by reference thereto and incorporated herein as
if fully set forth in this Section.
Section 2. The City Manager's action in authorizing the emergency
repair to the Bayfront Park Electrical Service System by Edd Helms Electrical
Contracting, in the amount of $7,695.37, is hereby ratified, approved and
confirmed, with funds therefor hereby allocated from Capital Improvement
Project No. 331305, Index Code No. 3193011-340, as appropriated by Fiscal Year
1993-94 Capital Improvement Ordinance.
Section 3. The City Manager's issuance of emergency purchase orders for
said purpose is further ratified, approved and confirmed.

Section 4. This Resolution shall become effective immediately upon its
adoption.

It is respectfully recommended that the City Commission adopt
the attached Resolution ratifying, approving, and confirming
the action of the City Manager and authorizing "EMERGENCY"
repairs to the Bayfront Park Electrical Service System in the
amount of $7,695.32.
BACKGROUND
When Bayfront Park was re -developed under the Noguchi Plan, the
U.S. Army Corps of Engineers (COE) made the existing installation
of the underground electric service cables. The COE had not
provided the City with "As -Built" drawings of the electric
service, when the installation of utilities, drainage structures,
and fencing work got underway at the South end of the Park.
Shortly before last years' Orange Bowl Parade, the electrical
service cables at the South end of the Park were broken during
the excavation for the storm drainage piping. The damage cut off
electric service to the NBC trailers preparing for the TV
broadcast of the Parade in a few days. It was an "emergency" to
have the electric service to the NBC trailers restored as soon as
possible. A few weeks later, the electric service along the
Flagler Promenade was also damaged during the Vine Fence
installation. It was necessary for public safety and convenience
and for Bayfront Park operations to repair the Baywalk electric
and lighting as soon as possible.
The Bayfront Park Management staff had their electrical
contractor, Edd Helms Electrical Contracting Inc., immediately
make the necessary emergency repairs. The repairs were made
under the "EMERGENCY" provisions in Section 18.52.6 of the City
Code. My approval was later followed up with a written finding
of an "Emergency" dated 6/14/94. At the time of these
incidences, the Corps of Engineers' were still preparing the "As -
Built" plans . City's South End contractor and the Vine/Fence
contractor had obtained existing utility locations through
"U.N.C.L.E." but these locations did not cover the on -site
underground electric lines. Therefore, the contractor's
liability insurance does not cover the above damage.

Funding for these Emergency repairs is available from Project No.
331305 as appropriated from the Fiscal Year 1993-94 Capital
Improvement Ordinance. It is now recommended that the City
Commission adopt the attached Resolution ratifying, approving and
confirming the action of the City Manager in authorizing these
"Emergency" repairs.
