HomeMy WebLinkAboutR-95-0348i i J-95-395 5/3/95 RESOLUTION NO. 9 5_ 3 4 8 A RESOLUTION RELATED TO THE CURTIS PARK SPORTS COMPLEX; AUTHORIZING THE CITY MANAGER TO NEGOTIATE, ESTABLISH AND APPLY SPECIAL CHARGES, TERMS AND CONDITIONS ON AN INDIVIDUAL BASIS; RESCINDING ALL PREVIOUSLY ESTABLISHED CHARGES, TERMS AND CONDITIONS FOR USE OF SAID COMPLEX; FURTHER AUTHORIZING THE CITY MANAGER TO ISSUE PARK PERMIT(S), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THE USE OF SAID FACILITY. WHEREAS, the Parks and Recreation Department is responsible for the operation of the Sports Complex at Curtis Park (the "Facility") and to secure the presentation of athletic events for the community at said facility; and and WHEREAS, said Facility is unique because of the amenities it offers the public; WHEREAS, prevailing market conditions have identified many different types of uses and users of said facilities, such as football, soccer, track, and baseball competitions; and WHEREAS, previously established charges, terms and conditions, pursuant to Resolution No. 93-632, adopted October 14, 1993, and Resolution No. 93-715, adopted CITY COA+IIMSSIQN MEETING OF Resolution No. 95- 348 November 23, 1993, were authorized until the City Manager reviewed the market rates for use of such facilities; and WHEREAS, the City Manager has determined that application of individual charges, terms and conditions for use of said Facility would best be addressed by the negotiation on a case by case individual basis; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized to negotiate, establish and apply special charges, terms and conditions on an individual basis at the Curtis Park Sports Complex and all previously established charges, terms and conditions for use of the Curtis Park Sports Complex are hereby rescinded. Section 3. The City Manager is hereby authorized' to issue Park Permit(s), in a form acceptable to the City Attorney, for the use of said facility. The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including those prescribed by applicable City Charter and Code Provisions. BACKGROUND The City of Miami Parks and Recreation Department is responsible for the operation of the Sports Complex at Curtis Park and to secure the presentation of athletic events for the community at this facility. I This is a unique City of Miami facility because of the amenities it offers to the public. Based on these characteristics, prevailing market conditions have identified many different types of organizations interested in using this facility for various uses such as ft:otball, soccer, track, and baseball competitions. These differec.- ses would be best addressed on a case by case i basis by the Ct:y Manager negotiating, establishing and applying individual special charges, terms and conditions for each use. We, therefore, recommend that due to the uniqueness of this facility, the City Manager, or designee, be authorized to negotiate and apply appropriate use fees, terms and conditions with prospective users of the facility on an individual basis. 95- 348 ajI - / V__
