WHEREAS, the Miami Zoning Board at its meeting of January 23, 1995, Item No. 7, duly adopted Resolution ZB 014-95 by a six to three (6-3) vote, granting a special exception, subject to Commission approval, as hereinafter set forth; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, requires City Commission approval of the special exception as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter, and notwithstanding the decision of the Zoning Board, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to deny the special exception and to reverse the decision of the Zoning Board; CITY COb MISSION DMI STING OF MAY 0 1 1995 Resolution No, 9 5- 3 3 4 4•n. r ■ Ilorr, NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The decision of the Miami Zoning Board to grant a Special Exception, subject to City Commission approval, as set forth in Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 9, Section 934, Community Based Residential Facilities, Subsection 934.3, Certificate of Use Not Transferable, to allow a change of ownership of Certificate of Use No. 105341 for the property located at 250 Northwest South River Drive, Miami, Florida, more particularly described as Lots 1, 2, and 17, Block 4, CITY OF MIAMI SOUTH SUBDIVISION as recorded in Plat Book B, at Page 41, of the Public Records of Dade County, Florida; zoned R-4 Multi -Family High -Density Residential, is hereby reversed and the Special Exception is hereby denied. BACKGROUND: At the direction of the Commission and following continuation of this item on February 23, 1995, the Planning, Building and Zoning Department held a meeting on March 8, 1995 at the Administration Building for the purpose of having property owners and representatives of the Salvation Army and Northwest Dade Center Inc., meet together and seek a compromise. After 1 1/2 hours, no compromise was reached (see minutes attached). The Planning, Building and Zoning Department, however, is in full agreement that the conditions, as proffered by the applicant at the February 23rd meeting, will reduce the impact of the facility on the area and will provide appropriate assurances to the area residents. Attachment 9- 334 p MINUTES SALVATION ARMY/NORTHWEST DADE CENTER INC. MEETING A meeting took place at 6:00 p.m., March 8, 1995 at the Planning, Building and Zoning Department, 3rd Floor Conference Room, for the purpose of discussing changing the ownership of the Salvation Army facility at 250 NW South River Drive, to Northwest Dade Center, Inc., so that Northwest Dade Center could operate a Community Based Residential Facility. The meeting was held at the direction of the Miami City Commission, which on February 22, 1995, continued this item until the March 27, 1995 City Commission meeting. A courtesy notice was sent to all property owners within 375 feet of the facility (see attachment). Participants included representatives from the Salvation Army, Northwest Dade Center, Inc., employees of the facility and former clients of the program, who together totalled 25 persons including Vicky Leiva, Attorney. Property owners and residents totalled 11 persons. City staff included Jose R. Casanova Jr., Planner II, and Joseph W. McManus, Deputy Director; Jose Casanova served as moderator. The total attendance was 38 persons (See attendance sheet attached). The meeting allowed all sides to present their views and express their concerns; but after approximately 1.5 hours no compromise was reached. Property owners, residents and investors did not want this proposed facility in the area because they felt it provides a negative impact on their properties and businesses. They disagree with the proposed facility because they think that it will not contribute to revitalizing the area, nor bring tourists, will hurt their businesses and will contribute to a reduction of property values. On the other hand, Northwest Dade Center, Inc., (NDC) believes that the proposed facility, with the reduction from a 225 bed capacity to 75 beds and the proposed change in clientele from street homeless to transitional housing, will provide a needed service to the community and create a minimum impact in the neighborhood. Vicky Leiva, Esq. led the presentation for NDC, she stated that NDC is buying the new facility from the Salvation Army and planning to renovate it. NDC has a $650,000 grant from Dade County Community Development funds. The funds will be partly used to reduce the bed capacity from 225 to 75 in order to provide transitional housing for homeless persons; $125,000 will be spent on a new roof, windows, landscaping and partitions. Homeless persons, once stabilized and ready to start a new life, will go to this transitional housing and will not be wandering on the street. Walk-in's directly from the street will no longer be allowed and clients will stay in this facility approximately 9 months to 1 year. The facility will have 24-hour supervision; controlled in - and -out. It will be the equivalent of living in an apartment setting. The reason for the meeting, according to Leiva, was not to have or not have the facility operating on the site, but whether new services will be offered on this site including education, vocational training and additional supervision. 95- 334 :3 In response to a question, Salvation Army representatives stated that they will open a new facility at 1901 NW 38th Street. NDC stated that they have been operating a similar transitional house (40 beds) at 1339 SE 9th Avenue, in Hialeah since 1992; and further, that they propose that for the first 3 months after the proposed facility is open, they will transport any homeless person asking for assistance in the vicinity of the facility to the new Salvation Army facility on NW 38th Street. They stated the current bed/patient count was over 100. NDC representative Manuel Jardon also identified a facility for the mentally handicapped on Lincoln Road (FPL site) at Miami Beach and one psychiatric hospital at Las Olas Boulevard in Ft. Lauderdale. He said these facilities are found throughout the urban area. NDC representative Jardon stated, in response to a question, that he had looked at other sites, that homeless depression takes time to cure, that the housing stock is depleted; that Miami and Hialeah are tough to enter. , NDC wants to help SSI disabled who number 55,000, who are eligible for Section 811 vouchers. Property owners stated that the value of their property had been declining, in part because of the Salvation Army facility, and now that the Salvation Army was leaving, they were faced with this proposal by NDC, which would continue the decline of property values. In response to questions, NDC representatives said that some of the clients in the proposed facility would work, some would receive training, none would be hanging out. NDC representatives said that these would not be "detox" people; all would be stabilized and referred from another facility. Camillus House has learned that alcoholism can only be treated by long term rehabilitation. Property owners stated that the homeless would not leave the area, but will continue to stay there. Captain Hedgren of the Salvation Army stated that the homeless will be referred to the new Homeless Trust shelter at 1500 N Miami Avenue or the new Salvation Army shelter at 1901 NE 38th Street. NDC representative Jardon stated that the proposed NDC facility would not accept walk-ins, but would only take referrals who were stabilized. Property owners stated that the Salvation Army facility has historically had a negative impact on business, that no one would open a business nearby knowing that NDC would occupy the Salvation Army facility. These facilities did not help the economy. Property owners stated that business had gone down, and the homeless deterred tourists from visiting the area. In response to a question, NDC representative Jardon explained that Section 811 vouchers are available for handicapped persons, who are developmentally disabled, have acquired disabilities, have physical disabilities or have other disabilities; there will be no "mental" cases at this site. He said the employees/former clients at the meeting were fair examples of the people who would be at the proposed NDC facility. Staff responded that the Planning, Building office was a neutral and convenient site. 95- A property owner said that previous notices had described a "nontransferable variance" not a "change of ownership". Staff responded that the issue was a change of ownership. Before the end of the meeting, staff requested a npromise solution from the audience but no compromise was reached nor recommendation or suggestion was presented. Staff announced that the information from the meeting will be presented to the City Commission at the March 23, 1995 meeting (now March 27, 1995).
