A RESOLUTION RESCINDING RESOLUTION NO. 90-651,
ADOPTED SEPTEMBER 7, 1990, WHEREBY A
CONSTRUCTION CONTRACT WAS AWARDED TO AND
SUBSEQUENTLY DEFAULTED UPON BY JORGE LARRAURI,
G.C., FOR THE PROJECT ENTITLED "MORNINGSIDE
PARK - IRRIGATION SYSTEM (SECOND BIDDING)"
(THE PROJECT); AUTHORIZING THE CITY MANAGER TO
NULLIFY THE CONTRACT BETWEEN THE CITY OF MIAMI
AND JORGE LARRAURI, G.C., FOR SAID PROJECT;
FURTHER ACCEPTING THE BID OF JAFFER ASSOCIATES
LTD., IN THE PROPOSED AMOUNT OF $55,578, TOTAL
BID FOR "MORNINGSIDE PARK IRRIGATION SYSTEM
REPAIRS AND COMPLETION OF THE EXISTING
IRRIGATION SYSTEM; ALLOCATING FUNDS THEREFOR
FROM PROJECT NO. 331338, "CITYWIDE IRRIGATION
PROJECTS", AS APPROPRIATED BY FISCAL YEAR
1994-95 CAPITAL IMPROVEMENT ORDINANCE
NO. 11205, IN THE AMOUNT OF $55,578 TO COVER
THE CONTRACT COST AND $10,112 TO COVER THE
ESTIMATED EXPENSES, FOR AN ESTIMATED TOTAL
COST OF $65,690.
WHEREAS, sealed bids were received July 10, 1990, for the
project entitled "MORNINGSIDE PARK IRRIGATION SYSTEM PROJECT,
B-3238-B (SECOND BIDDING)" (the Project); and
WHEREAS, On September 7, 1990, the City Commission adopted
Resolution No. 90-651 which accepted the bid of Jorge Larrauri,
G.C., and authorized the City Manager to execute a contract with
said firm for the Project; and
WHEREAS, during the process of said contract it was
determined that Jorge Larrauri, G.C., began the work but later
defaulted on the contract without finishing the work; and

WHEREAS, the City Manager has determined that it is in the
best interest of the City of Miami to nullify the construction
contract between City of Miami and Jorge Larrauri, G.C. for the
MORNINGSIDE PARK IRRIGATION PROJECT B-3238-B (SECOND BIDDING),
and to award a contract to the lowest bidder for the repair and
completion of the existing unfinished irrigation system at
Morningside Park; and
WHEREAS, the City Manager authorized the issuance of an
emergency purchase order for the investigation, inventory and
testing of the existing unfinished irrigation system in order to
determine the scope of work required and unit prices for the
future repairs and completion of the unfinished Morningside Park
irrigation system; and
WHEREAS, sealed bids were received September 6, 1994, for
"MORNINGSIDE PARK IRRIGATION SYSTEM -INVESTIGATION, INVENTORY AND
TESTING PROJECT B-3238-E; and
WHEREAS, pursuant to Resolution No. 94-793, adopted
November 17, 1994, the City Commission ratified, approved and
confirmed the City Manager's action in awarding the contract to
Jaffer Associates, Ltd., as the lowest responsible and responsive
bidder for the MORNINGSIDE PARK IRRIGATION SYSTEM -INVESTIGATION,
INVENTORY AND TESTING PROJECT B-3238-E which included scope of
work and unit prices; and
WHEREAS, Jaffer Associates, Ltd. completed the Morningside
Park Irrigation System -Investigation, Inventory, and Testing
Project and provided a total proposed bid of $55,578 based on the
unit prices in its low bid to repair and complete the unfinished
irrigation system; and

WHEREAS, the City Manager and the Director of the Public
Works Department recommend that the bid of Jaffer Associates,
Ltd. be accepted as the lowest and responsive bid for the
project; and
WHEREAS, monies are available for the proposed amount of the
contract, project expense, and incidentals under Project
No. 331338, as appropriated by Fiscal Year 1994-95 Capital
Improvement Ordinance No. 11205;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Resolution No. 90-651, adopted September 7,
1990, is hereby rescinded.
Section 3. The City Manager is herby authorized to
nullify the contract between the City of Miami and ore Larrauri,
G.C. for the "MORNINGSIDE PARK IRRIGATION SYSTEM PROJECT (SECOND
BIDDING)".
Section 4. The total bid of Jaffer Associates Ltd. in
the proposed amount of $55,578 for the repair and completion of
the MORNINGSIDE PARK IRRIGATION SYSTEM PROJECT B-3238-E for the
total bid of the proposal based on scope of work and unit prices,
is hereby accepted.
Section 5. The total estimated project cost of $65,690
is hereby allocated from Project No. 331338, as appropriated by

Fiscal Year 1994-95 Capital Improvement Ordinance No. 11205.
Said total project cost consists of the $55,578 contract cost and
$10,112 estimated expenses incurred by the City.
Section 6. The City Manager is hereby authorized to
enter into a contract,11in a form acceptable to the City
Attorney, on behalf of the City of Miami with Jaffer Associates,
Ltd., for the "MORNINGSIDE PARK IRRIGATION SYSTEM PROJECT -
REPAIRS AND COMPLETION" B-3238-E, total bid of the proposal in
the amount of $55,578.00.
Section 7. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached Resolution rescinding the construction contract awarded
to Jorge Larrauri. G.C. for the project entitled ''Morningside Park
Irrigation System Project B-323BE (Second Bidding) and authorizing
the City Manager to enter into a contract for the repair and
completion of the Morningside Park Irrigation System B-323BE with
Jaffer Associates, Ltd. in the imount of $55,578.
BACKGROUND
By Resolution No. 90-651, the City Commission awarded a contract
to Jorge Larrauri, G.C. for the Morningside Park Irrigation System
B-3238E (Second Bidding). Jorge Larrauri G.C. entered into a
contract with the City, started construction but never completed
the project. The Public Works Department determined that Jorge
Larrauri G.C. was in default of their contract. The completion of
this project was further delayed by Hurricane Andrew which caused
considerable damage to the trees and vegetation in this park which
is adjacent to Biscayne Bay.
Since the hurricane, many of the trees and plantings have been
restored and some new trees and palms added. The irrigation that
was unfinished is now needed to support the new trees and palms
and other landscaping in the park. In order to repair and
complete the irrigation work defaulted by Jorge Larrauri G.C., it
was necessary to do a complete investigation, inventory and
testing to determine the scope of work and unit prices necessary
to repair and complete the unfinished irrigation system. The City
Manager authorized an emergency purchase order for this work and
the assessment- of the unfinished irrigation work was completed. On
November 17, 1994, the City Commission adopted Resolution No. 94-
793 ratifying, approving and confirming the City Manager's action
in awarding a contract to the lowest responsible and responsive
bidder, Jaffer Associates, Ltd.

After their investigation and inventory of the existing irrigation
system, Jaffer Associates submitted a proposal for the repair and
completion of the irrigation system based on the unit prices with
their original bid. The total amount of Jaffer Associates'
proposal is $55,578.
It is now recommended that the City Commission adopt the attached
Resolution to rescind the original Morningside Park Irrigation
System contract with Jorge Larrauri, G. C., and award a new
construction contract to Jaffer Assoc., Ltd. to repair and
complete the irrigation system in the amount of $55,578. Funds
are available under CIP Project No. 331338 entitled "Citywide
Irrigation Projects".
