A RESOLUTION ACCEPTING THE PROPOSAL OF LAW
ENFORCEMENT PSYCHOLOGICAL & COUNSELING
ASSOCIATES, INC., TO PROVIDE PSYCHOLOGICAL
PRE -EMPLOYMENT SCREENING AND PSYCHOLOGICAL
COUNSELING SERVICES FOR THE POLICE
DEPARTMENT, ON A CONTRACT BASIS FOR ONE (1)
YEAR WITH THE OPTION TO EXTEND FOR TWO (2)
ADDITIONAL ONE (1) YEAR PERIODS, AT A
PROPOSED ANNUAL COST OF $133,500.00;
ALLOCATING FUNDS THEREFOR FROM THE POLICE
DEPARTMENT'S GENERAL OPERATING BUDGET AS
FOLLOWS: $112,000 FROM ACCOUNT CODE NO.
290201-270 AND $21,500 FROM ACCOUNT CODE
290201-260; AUTHORIZING THE CITY MANAGER TO
EXECUTE A CONTRACT, ON MOST FAVORABLE TERMS
AND IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, FOR A ONE YEAR PERIOD WITH THE
OPTION TO RENEW FOR TWO (2) ADDITIONAL ONE
(1) YEAR PERIODS, AT THE SAME PRICE, TERMS,
AND CONDITIONS SUBJECT TO THE AVAILABILITY OF
FUNDS, AND THEREAFTER TO INSTRUCT THE CHIEF
PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER
FOR THIS SERVICE.
WHEREAS, the City of Miami's Police Department needs to
provide psychological pre -employment screening services and
provide psychological counseling services to current employees;
and
WHEREAS, Requests for Proposals for the above service were
mailed to twenty-two (22) potential proposers; andWHEREAS,
pursuant to public notice, sealed proposals were received from
five ( 5 ) firms on September 30, 1994 ; and CITY GOPIrR55101

WHEREAS, the five proposals were evaluated and ranked by a
selection committee which recommended that the proposal received
from Law Enforcement Psychological & Counseling Associates, Inc.,
be accepted as the most responsible and responsive proposal; and
WHEREAS, funds for this purchase are available from the '
Police Department's General Operating Budget: $112,000 from
Account Code No. 290201-270 and $21,500 from Account Code No.
290201-260; and
WHEREAS, the City Manager and the Police Department
recommend that the proposal received from Law Enforcement
Psychological & Counseling Associates, Inc., be accepted as the
proposal most advantageous to the city;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The proposal of Law Enforcement Psychological
& Counseling Associates, Inc., to provide psychological pre-
employment screening and psychological counseling services for
the Police Department, on a contract basis for one (1) year with
the option to extend for two (2) additional one (1) year periods,
at a proposed annual cost of $133,500.00, is hereby accepted,
with funds therefor hereby allocated from the Police Department's
General Operating Budget as follows: $112,000 from Account Code
No. 290201-270 and $21,500 from Account Code 290201-260.

Section 3. The City Manager is hereby authorizedI/ to
execute a contract with Law Enforcement Psychological &
Counseling Associates, Inc., on most favorable terms and in a
form acceptable to the City Attorney, for a one (1) year period
with the option to renew for two (2) additional one (1) year
periods, at the same price, terms, and conditions, subject to the
availability of funds, and thereafter to instruct the Chief
Procurement Officer to issue a purchase order for this service.
Section 4. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the award of RFP No. 93-94-
183R and a Resolution accepting said RFP be granted to Law
Enforcement Psychological and Counseling Associates, Inc., a non -
minority, Dade County vendor, located at 250 Catalonia Avenue,
Suite 604, Miami, Florida, 33134, in the amount of $133,500, for
furnishing psychological services.
Funding is to be from the Police Department General Operating
Budget, Index Code 290201-270 in the amount of $112,000 and Index
Code 290201-260 in the amount of $21,500; total amount of
$133,500.
BACKGROUND:
The Police Department is desirous of pre -employment psychological
testing service to identify individuals who are not fit for
police work. This Department is also seeking a consultant to
provide individual counseling and assessment services to its
current employees.
Based on evaluations conducted by a selection committee,
comprised of citizens and members from the Department of
Personnel Management and Police, the firm of Law Enforcement
Psycohological and Counseling Associates, Inc., is the highest
ranked proposer. They provided the lowest overall price and met
the requirements specified by the Police Department.
On September 9, 1994, RFP's were sent to prospective vendors.
The RFP's were opened on September 30, 1994, with five (5)
responsive vendors.
It is, therefore, recommended that the award of the RFP be made
to Law Enforcement Psychological and Counseling Associates, Inc.,
in the amount of $133,500. Funding is to be from the Police
Department General Operating Budget, Index Code 290201-270 in the
amount of $112,000 and Index Code 290201-260 in the amount of

THIS MATTER having come before the Civil Service Board on April 10, 1995, pursuant to an
appeal tiled by Police Officer Wilfredo Perez-Borroto (the "Appellant"), City of Mani Police
Department. The Appellant requested a hearing to appeal the decision cif the Chief of Police to
forfeit twenty (20) hours of earned overtime, effective March 7, 199
represented by Jose Fernandez, Assistant City Attorney. Thu Appell

dated February 6, 1994). The Appellant obtained
police uniforms from the City authorized uniform
vendor designated for Officer Wilfredo Perez, IB
0625. These uniforms bure the tiame tag "Perez"
When Officer Wilfredo Perez confronted the Appe a
about the uniforms, lie admitted to intentionally
taking his uniforms. According to Officer Perez, �
the Appellant then agreed to give Officer Wilfredo I
Perez any uniforms issued to him in the calendar
year 1993, so as to make up for the utforms
designated for Officer Perez, which the Appellant
misappropriated. During a sworn statement on
January 7, 1994, given to Sergeant Dalton of Inter ial
Affairs, the Appellant denied any knowledge of tak irq
Officer Wilfredo PercZs uniforms and discussing t e
matter with him (Officer Wilfredo Perez). Subsequ rn
on January 12, 1994, the Appellant gave Sergeant
Dalton a second stalerrrenl aRer being shown copi s
of a 1992 uniform chit for Officer Wilfredo Perez,
at which time the Appellant identified the signatur
on the uniforms chit as being his. The Reprimand is
incorporated herein and made a part hereof.

and being otherwise fully advised, the Board finds the Appellant, Wilfttdo Perez-Borroto NOT
GUILTY of violating Departmental Order 1, Chapter 11, Section 11,6.17. ; GUILTY or violating
Departmental Order 1, Chapter 11, Section 11.6.54.1; and GUILTY or violating City of Miami
Civil Service Rulc 14.2 (e).

The Board recommends to the City Manager that the Director's decision to impose a twenty

LEGAL ADVERTISEMENT

Sealed proposals will be received by the City of Miami City Clerk
at her office located at City Hall, 3500 Pan American Drive,
Miami, Florida not later than 10:30 a.m., September 30, 1994 for
the furnishing of pre -employment psychological screening and
psychological services for current employees for the Department
of Police.
Proposals submitted after the deadline and/or submitted to any
other location or office shall be deemed not responsive and will
be rejected.
Ordinance No. 10062, as amended, established a goal of Awarding
51% of the City's total dollar volume of all expenditures for All
Goods and Services to Minority and Women owned Business
Enterprises, on an equal basis.
Minority and women vendors who are interested in submitting
proposal and who are not registered with the City as minority or
women vendors are advised to contact the City Procurement Office,
1390 N.W. 20th Street, Second Floor, Telephone 575-5174.
Ordinance #10032 established a "First Source Hiring Agreement"
program to stimulate the creation of employment for City of Miami
residents. For details of the program's requirements, contact
the Neighborhood Jobs Program at 579-2468.
Detailed specifications for the proposals are available upon
request at the Procurement Management Office.
The City Manager may reject all proposals and readvertise.
