A RESOLUTION APPOINTING NINE (9) INDIVIDUALS TO THE CITY OF MIAMI'S AFFORDABLE HOUSING ADVISORY COMMITTEE AND DEFINING AFFORDABLE HOUSING PURSUANT TO THE STATE HOUSING INITIATIVES PARTNERSHIP PROGRAM. WHEREAS, on July 7, 1992, the State of Florida enacted the William E. Sadowski Affordable Housing Act, which allocates a portion of new and existing documentary stamp taxes on deeds on real estate transactions to local governments for the development and maintenance of affordable housing; and WHEREAS, the Sadowski Affordable Housing Act provides a dedicated revenue source for affordable housing and created the State Housing Initiatives Partnership Program (SHIP); and WHEREAS, in August of 1994, the City of Miami was notified by the State of Florida that the City would be eligible to received $1,353,387 in SHIP Program funds beginning with the State's FY 1995-96 allocation, contingent upon the legislature appropriating the existing ten cents ($.10)authorized in the Sadowski Act this year; and WHEREAS, in order for the City of Miami to receive the aforementioned funds, it is necessary for the City to appoint a nine (9) member Affordable Housing Advisory Committee. The committee shall be responsible for developing CITY COMMISSIOIF MEETING OF MAY 0 1 1995 Resolution No. 95- 395 09-' nine (9) member Affordable Housing Advisory Committee. The committee shall be responsible for developing a Housing Incentive Plan after reviewing the City's existing policies, procedures, ordinances, land development regulations and comprehensive plan and to make specific recommendations aimed at encouraging and facilitating affordable housing units in the City of Miami, while also protecting property values; and WHEREAS, the Sadowski Affordable Housing Act requires this appointing resolution to include a definition of affordable housing; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following individuals are hereby appointed to the City of Miami Affordable Housing Advisory Committee: Rafael Cabezas as the member who is an active residential home builder. Jose R. Alonso active banker or mortgage banker. Herbert J. Bailey active affordable housing provider. Tayler Pierce Kurau advocate of low income persons. -2- as the member who is an as the member who is an as the member who is an 95- 305 Humberto Pellon as the member who is an active real estate professional. The term affordable housing is hereby defined as housing where the occupant is paying no more than thirty percent (30%) of their gross income on total gross housing cost. Section 4. CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO: Honorable Mayor and Members of the City Commission FROM Cesa, io City ger RECOMMENDATION° DATE: APR 13 1995 FILE : Resolution Relating to SUBJECT : the Appointment of the City of Miami's Afford- able Housing Advisory REFERENCES :Committee City Commission Agenda ENCLOSURES:Item - April 27, 1995 It is respectfully recommended that the City Commission adopt the attached resolution appointing certain individuals to positions on the City of Miami Affordable Housing Advisory Committee as required by the State of Florida's State Housing Initiatives Partnership Program, pursuant to 420.907-420.9079, Florida Statutes. The Department of Development and Housing Conservation recommends ratification of the attached resolution. The resolution provides for appointments to the City of Miami's Affordable Housing Advisory Committee for the purpose of implementing the State of Florida's State Housing Initiatives Partnership (SHIP) program in the City of Miami. In July of 1992, Governor Lawton Chiles signed into law the William Sadowski Affordable Housing Act, which provided for a dedicated revenue source to assist local governments in their efforts to further expand the availability of housing units affordable to very low, low and moderate income families and individuals. Moreover, this legislation also created the State Housing Initiatives Partnership Program (SHIP Program). In August of,1994, the City of Miami was notified by the State of Florida that the City would be eligible to receive $1,353,387 in SHIP Program funds beginning with the State's Fiscal Year 1995- 96, contingent upon legislative appropriation. In order for the City of Miami to receive the aforementioned funds, it is necessary for the City Commission to appoint a nine (9) member Affordable Housing Advisory Committee prior to May 2, 1995, that would be responsible for developing a Housing Incentive Plan, after reviewing the City's existing policies, procedures, ordinances, land development regulations and comprehensive plan and to make specific recommendations aimed at encouraging and facilitating affordable housing units in the City of Miami, while also protecting property values. 95- 305 �/�"� Honorable Mayor and Members of the City Commission Page 2 The nine (9) member Affordable Housing Advisory Committee must consist of the following individuals: 1. Active Residential Home Builder 2. Active Banker or Mortgage Banker 3. Representative of Labor in Home Building 4. Advocate for Low Income Persons 5. Affordable Housing Provider 6. Real Estate Professional 7. At Large Member 8. At Large Member 9. At Large Member Each member of the City Commission shall have one (1) appointee and the City Manager shall have four (4) appointees. In order to avoid overlapping we ask that the appointments be made as follows: Mayor Steven P. Clark - Advocate for Low Income Persons Vice Mayor J. L. Plummer - Active Residential Home Builder Commissioner Miller Dawkins - Affordable Housing Provider Commissioner Wilfredo Gort - Real Estate Professional Commissioner Victor DeYurre - Active Banker or Mortgage Banker City Manager Cesar H. Odio - Representative of Labor in Home Building - At Large Member - At Large Member - At Large Member The assignment of certain appointments to each Commissioner is intended to avoid overlapping one or more of the same type of professionals on the committee. It is not a requirement that a particular appointment be made by a Commissioner, as long as when all of the appointments are made, the Advisory Committee contains the required composition. The-'.city..of Miami will be eligible to receive, $1, 353, 387 beginning with State Fiscal Year•.'19.95-96 contingent upon legislative appropriation: - For the city of : Miami - to receive these funds, its staff must submit to -the Florida Housing Finance Agency -an ordinance and a - Local Housing Assistance Plan by May 2, 19.95.- The Plan may be submitted for up to a three-year period. The submission must .include the following: 1. Ordinance. The Ordinance must create a Local Affordable Housing Assistance Fund; establish the Local Housing Assistance Program; designate who will be responsible for implementing and administering the Program; and create an Affordable Housing Advisory Committee. 2. The Local Housing Assistance Plan. The Plan must provide a concise description of the city's local housing assistance program and provide a breakout of the way the city proposes to spend the funds. 3. Checklist/Housing Delivery Goals Chart/Certification. This checklist will identify where the SHIP Review Committee may locate the mandatory items required in the Local Housing Assistance Plan. The Certification will document the local government's intent to comply with basic program guidelines and requirements. 30
