J-95-264 3/27/95 RESOLUTION NO. 9 5 - 248 A RESOLUTION, WITH ATTACHMENT, MAKING FINDINGS, AND DIRECTING THE PERMANENT PROHIBITION OF VEHICULAR ACCESS TO CERTAIN STREETS IN THE SHORECREST NEIGHBORHOOD IN THE CITY OF MIAMI, FLORIDA, SUBJECT TO THE APPROVAL OF THE METROPOLITAN DADE COUNTY TRAFFIC DIRECTOR, IN ACCORDANCE WITH PLAN "A", ATTACHED HERETO AND MADE A PART HEREOF, AND SUBJECT TO CONDITIONS AS SET FORTH HEREIN. WHEREAS, a group of property owners has requested that the City restrict vehicular access to certain streets within the Shorecrest neighborhood; and WHEREAS, the City Commission adopted Resolution No. 94-494 on July 14, 1994, authorizing, for a one hundred twenty (120) day trial period, temporary barricades and traffic regulatory signs across certain streets in the Shorecrest neighborhood in the City of Miami, Florida, in accordance with Plan "A", subject to certain conditions which have been met; and WHEREAS, the Departments of Police, Fire -Rescue and General Services Administration/Solid Waste have evaluated the effects of the vehicular access restrictions upon their respective operations during the trial period; and ATTACH!filE.H!T (O CON TA I N E D CITY COMMISSION MEETING OF MAR 2. 11995 Resolution No. 95- 248 pg. WHEREAS, it is now in order to formally adopt said Plan "A" with the provision that Barricade No. 10 be modified or removed, in accordance with the provisions of Section 54-17 of the Code of the City of Miami, Florida, as amended, which gives the City Commission the power, after a properly advertised public hearing, to recommend to the Metropolitan Dade County Traffic Director that vehicular access to a particular street or streets be prohibited where such prohibition is found to be in the best interest of the public; and WHEREAS, the City Commission finds that the herein prohibition of vehicular access is in the best interest of the public; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. It is hereby directed that vehicular access to certain streets in the Shorecrest neighborhood in the City of Miami, Florida, subject to the approval of the Metropolitan Dade County Traffic Director, in accordance with Plan "A", attached hereto and made a part hereof, be permanently prohibited (1) in accordance with the findings as set forth hereinabove; (2) with the provision that Barricade No. 10 be either removed or replaced; and (3) subject to the following conditions: .2_ 95- 248 (a) the Department of Public Works shall design the barricades; (b) the design of the barricades shall be subject to review and modification by the Metropolitan Dade County Public Works Department; (c) all of the traffic regulatory signs shall be subject to review and modification by the Metropolitan Dade County Public Works Department; and (d) in the event the Metropolitan Dade County Traffic Director does not approve the prohibition of vehicular access as set forth in Plan °A", amended to either modify or remove Barricade No. 10, the matter shall be brought back to the City Commission. Section 3. Said barricades shall prevent vehicular access but not restrict pedestrian access. Section 4. This Resolution shall become effective immediately upon its adoption. BACKGROUND: On July 14, 1994 a group of citizens from the Shorecrest neighborhood, bounded by Biscayne Boulevard, N.E. 79 Street, north city limits and Biscayne Bay, appeared before the City Commission requesting that vehicular access be restricted to many of the streets serving the Shorecrest neighborhood. The citizens' request for vehicular access restrictions is In l response Mato ' the Increasing need to control and prevent undeslrab-Te' vehicular traffic adjacent to and within their neighborhood and a desire to maintain the "character" of the neighborhood. Resolution No. 94-494 approving the Implementation of traffic control Plan "A" on a trial basis was adopted by the City Commission. During the 120 day trial period, various city, county and state departments conducted technical evacuations of the temporary barricades and letters were sent to alP=property owners within the Shorecrest area soiciting their approval or disapproval of the plan. The results of the evaluations are as follows. Fire Department The Fire Department conducted trial emergency runs at each barricade starting from the intersection of Biscayne Boulevarq and N.E. 79 Street. The response time is longer with the barricades in place as compared to unrestricted access by the following times: Page 1 of 4 95- 248 Honorable Mayor and Members of the City Commission Barricade 1 22 seconds longer Barricade 2 18 seconds longer Barricade 3 10 seconds longer Barricade 4 1 minute 20 seconds longer Barricade 5 1 minute 14 seconds longer Barricade 6 2 minutes 9 seconds longer Barricade 7 2 minutes 15 seconds longer Barricade 8 2 minutes 8 seconds longer Barricade 9 1 minute 37 seconds longer Barricade 10 1 minute 32 seconds longer Barricade 11 2 minutes 33 seconds longer Barricade 12 2 minutes 9 seconds longer Due to the location of the barricades, the closest fire hydrants are now further away at Barricades 1, 4, 5, 7, 9 and 10. Fire hose is laid by the moving fire truck because firefighters cannot effectively hand drag a hose through a barricade. Since It is difficult to control parked cars, Illegal plantings and debris placed In the closure, the fire department cannot depend on a mountable or "crash" type barricade for access. Turning a fire apparatus around on a narrow dead end street is difficult. Police Department The Police Department has experienced delays in response time similar to the Fire Department. The barricades also preclude pursuit and disrupt routine neighborhood patrolling. The Police Department cannot depend on a mountable or "crash" type barricade for access due to the difficulty In controlling parked cars, planting and debris at the closure. Miller Elementary School. The school board recommends this barricade be removed or relocated. Florida Department of Transpoprtatlon The F.D.O.T. has concerns about emergency vehicle access to the neighborhood and disagrees with the method that the City's Traffic Consultant utilized to prepare the traffic study. This department requires a complete follow-up report to access the Impact of the closures on State arterial roadways prior to a recommendation. Dade_ --Country Public Works Department The County is concerned about the Fire Department's comments about emergency access. The temporary barricades south of N.E. 82 Street have caused severe traffic delays on N.E. 10 Avenue which will require the Installation of an exclusive left turn lane at Its Intersection with N.E. 82 Street. The barricades have also forced traffic to utilize N.E. 88 Street, outside the City, overburdening this roadway and shifting vehicular traffic north of the City. Residents are forced to use N.E. 78 Street as access from Biscayne Boulevard�'to the neighborhood. The physical dimensions of N.E. 78 Street and the traffic slgnalizatlon is not designed to handle this burden of traffic. This department requires the City to conduct a "post barricade" traffic study for presentation to the County and F.D.O.T. The City w;I be required to implement all roadway and traffic signal modifications necessary to mitigate traffic Impacts on surrounding roadways. City of Miami Public Works Department Traffic counts on local and primary streets were collected prior to and after installation of temporary barricades. The attached "Existing Daily Conditions" map of streets sealed off by barricades compares the "before" and "after" daily (24 hour) traffic counts. Page 3 of 4 95- 248 04., Y Honorable Mayor and Members of the City Commission Although traffic on the protected streets has decreased sharply, the excess traffic has been forced onto other local and primary streets that have not been barricaded with the greatest negative impact occurring at Intersections permitting right and left turns. The "before" and "after" peak hour (4:30-5:30) turning counts at critical intersections are shown on the attached "Existing Peak Hour Condition" map. These Intersections have experienced an unacceptable deterioration of level of service. if certain closures are approved by the City Commission and the Dade County Traffic Director determines that the closures can safely meet all technical requirements., the City will be required to fund and accomplish the reconstruction of critical primary roadways and the traffic signal improvements necessary to maintain the previous level of service. During the trial period, the Public Works Department solicited each property owner's opinion of temporary traffic control Plan "A" by mailing a postage paid, self addressed postcard ballot to each property owner. The results of the ballot are as follows (as of February, 1995): 324 In Favor of Plan "A" 90 Against Plan "A" 2 No Opinion 484 Did Not Respond Based on the reports from the Police, Fire, Rescue and inspection Services and Solid Waste Departments, the Florida Department of Transportation, Metropolitan Dade County and statistical data collected during the Plan "A" barricade -trial period, the Public Works Department has modified traffic control Plan "A". Barricades no. 3, 10, 11 and 12 will be removed to provide Improved emergency access to the neighborhood and Improve level of service at critical Intersections. It Is respectfulily recommended that the City Commission adopt the attached resolution authorizing the temporary restriction of vehicular access to streets In the Shorecrest neighborhood for a 90 day trial period, according to Amended Plan "A". As with the orIgInaI temporary barricade plan, the Public Works Department will monitor the affects of Amended Plan "A" for presentation to the Commssion at the end of the trial period. We have the following concerns which must be addressed prior to our reaching a final determination on the permanent closures. 1. The Fire Department is requesting access across the closures and therefore we would like to know how the City intends to resolve the Fire Department's concerns. Please furnish detailed drawings for the permanent closures. 2. Furnish drawings of end treatments at all locations as to whether the City will develop "T" turn arounds or cul-de- sacs. 3. The City, following the installation of temporary barricades, must collect the 'traffic data, and conduct the "post -barricade" study and furnish this Department a report for our evaluation and review. 4. Implementation of the needed improvements including the installation of an exclusive northbound left turn lane at NE 10 Avenue and NE 82 Street. In response to your memo on the proposed and temporary barricades in the shorecrest area, the City of Miami Fire -Rescue Department offer the following: The present system of blocking the streets is unacceptable - Response times increase. 2. The planter type of barricades where trees and shrubbery are planted within the confines of a berm are unacceptable. Response times increase and maintenance is a problem. 3. Any type of a permanent barricade that is locked or requires some type of a device (keys or electronic) to open said barricade is unacceptable. Response times would increase. 4. The only vehicular restriction that would be'acceptable, would be berm type with grass as a ground cover. Our Fire apparatus would be able to navigate any of the restrictions at any time. Depending on the location and the type of Barricade, the delay in response times and access to Fire Hydrants will vary. The best scenario as far as the Fire -Rescue Department is concerned would be to have no time delays and have complete access to Firs Hydrants with out having to use alternate routes. If we are to use barricades for whatever reason, then the Fire - Rescue Department proposes the use of one (1) or two (2) types. The first type would be a drive through planter which must allow complete unobstructed pathway through trees, signs., etc. These planters will have to be maintained. Similar types in the City are not being maintained, creating a no turnaround. situation. Fire Hydrants that were accessible, are not. The second type barricade is a guardrail which is hinged on one end, with a locking mechanism on the other- We presently do not have one of these in the City, but the City of North Miami Beach does. All streets signs are attached to the moving guardrail gate. The open end is unsupported when the open positions. Maintenance would be nothing more then periodically lubricating the locking mechanism and hinge. The time delay should be minimal. The effects of complete street closure at the following twelve (1.2) locations would result in situations as outlined.. 95- 248 �� Shorecrest Barricades July 27, 1994 Page II BARRICADE j, - N. E. 12th AVENUE & 81st STREET 1. The closest Fire Hydrant to the Cal -de -Sac in N. E. 81st Terrace would now be approximately 1,500 feet away, instead of approximately 700 feet. 2. There would be a time delay in the response time. Fire apparatus approach will have to be made from N.E. loth Avenue & 83rd Street. BARRICADE A 2- - N. E. llth AVENUE & N. BAYSHORE DRIVE 1. No turnaround on the North Side of the barricade. 2. There would be a time delay in the response time. Fire apparatus approach will have to be made from N.E. loth Avenue & 82nd Terrace. The City of Miami Fire -Rescue Department strongly recommends that there be no closures of streets by Barricades that would not allow access by Emergency vehicles. With drive through barricades in mind, water main extensions and New Fire Hydrant installations or relocations should not be necessary. A routine maintenance schedule is a must. Please be advised that the Solid Waste Division objects to the temporary barriers in Shorecrest being made a permanent solution. The impact is to increase the amount of time and fuel required to service this area because- our vehciles have to enter or exit north of the City limits and within the area are required to back up or circle blocks to make collections. 95— 248 �J ps:. We have disagreements and concerns over certain assumptions made to "simplify the analysis" and to reduce the data collection necessary. Assumptions such as; traffic distribution, LOS, and Table 3, among others. 2. According to the study there will be operational deficiencies that will occur at N . E.: 10rh Avenue and N.E. 82nd Street. The retiming of the signal will improve these deficiencies. It was a Child Day Care Center [unlicensed]. For a year the home was abandoned. The yard was full of trash and not cut. Windows were broken out and "homeless" were sleeping in the building. Drive by the property to- day. The building is secured, the property is neat and orderly, and the owner is cooperating in either sell- ing the home as is or repairing the damage. This was accomplished through the efforts of the Homeowner's Association. If you have a "problem property" on your street call the voice mail line or FAX us the information. ABANDONED OR UNREGIS- TERED CARS Seems as if there are a lot of "junk" cars in our area. City of Miami Or- dinance prohibits unregistered cars to be parked on the streets and/or in the yard of residential [R-1] property. Pass the complete information along to the Association and we will have the cars removed. STORAGE OF BOATS IN RESIDENTIAL AREAS Same as above. Give us a call PLANT THIEF Lots of neighbors have lost plants from their yard and off of their porch. When you see someone in the neigh- borhood walking around with a pot- ted plant in his arms, chances are it's not his. Get a detailed description of the person and call the police. If you wish, follow the person at a dis- tance so you can direct the police when they arrive. These people live on the fringes of our neighborhood. YOUTH GANG Yes, we have one. Mostly fourteen, fifteen and sixteen year olds. They live in the N.E. 85th Terrace to N.E. 88th Street area [ East of the Boule- vard to N.E. 8th Court. The police know who they are and arrest them on a constant basis. Because they are "juveniles" and HRS. will not accept them when they are arrested, they are released back into the neigh- borhood to continue their plunder. When you see teenagers that are act- ing suspicious or casing the area: Call The Police. 911 CITY OF MIAMI POLICE Board members and citizens in our area have been in contact with Chief Warshaw, Assistant Chiefs Martinez and Cheatham, Major Boyd and Capt. Yee of the North Station, Lt. Potzauf who is the shift officer in our area and five or six of the area Po- lice Officers. The cooperation from Lt. Potzauf down has been very posi- tive - from the Lt. up it has been less than enthusiastic. We are offering to help the Police in areas that we feel qualified. It is going to take con- tinued effort on the Homeowner's part to win over the Brass. All sug- gestions are welcome. If you have a background in law enforcement on any personal contacts, we can use your help. NUISANCE ABATEMENT BOARD This is a Board of City of Miami resi- dents that are appointed by the City Commissioners to hold hearings and levy fines and restrictions on resi- dents or businesses that cause a nui- sance to the community because of drug sales or use, prostitution, bark- ing dogs, gambling or During the past three months the Shalimar Motel at 6200 Biscayne Boulevard and the Seven Seas Mo- tel at 5940 Biscayne Boulevard have been closed for nine months because of illegal activities. This was their second offense in the past two years. The board had closed the Metro Motel for nine months because of drug and prostitution activity dur- ing 1993. Unfortunately for us, the Board was intimidated by the law- yer for the Plaintive and imposed a very light sentence of thirty day clo- sure. Keep your eyes out for any il- legal activity at this address and re- port it to the police. A lot of us drive on the Boulevard on a daily basis and should be responsive to the problems there. SHORECREST NEIGHBOR- HOOD ENHANCEMENT COMMITTEE Christopher Morson is the chairman of this committee. Be sure to read his article in this Newsletter. This committee is looking for involve- ment. If the vehicle is being driven be- tween the hours of 1:00 AM and 5:30 AM it will be pulled over by the City of Miami Police to verify that the person driving is authorized to do so. It is with great sadness and sorrow that I tell you of Brenda's death. I love them both and appre- ciate their friendship and support, UPPER EAST SIDE POLICE JUNIOR OLYMPICS On March 30, 1995 at Legion Park [6447 N.E. 7th Avenue] the City of Miami Police Department will be sponsoring a Junior Olympics for the 5th grade students form Phyllis Miller and Morningside Elementary Schools. Before the Com- mission meeting on March 23, 1995 we will have more accurate statistics dealing with those residents that are directly affected by the closures. METRO-DADE COMMISSIONER JAMES BURKE SAYS: "Avoid being a victim. Make your neighborhood a safe place to live and work, Experience has shown that there are certain conditions that con- tribute to a high crime rate in a com- munity. Conditions such as over- grown lots, junk cars, piles of gar- bage and abandoned buildings all contribute to crime as well as to downgrade the image of the commu- nity. As your County Commissioner I implore you to be active in your community's fight against crime. Hundreds of neighborhoods have set up crime watches, if there is one in your community join up, if you don't have one, then get the residents to- gether, throw a block party, or a pic- nic, start a newsletter, or do what- ever else you may think necessary to involve other residents." CITIZENS ON PATROL The City of Miami Police Depart- ment is presenting this "volunteer program to coordinate effort for citi- zens to take an active role in crime prevention efforts within the neigh- borhood the live and work at. Un- derstanding that: more police offic- ers on the field will not be a reality, this program will address fear of crime by multiplying the eyes and ears of the Police Department. Citi- zen volunteers play an integral part in the crime prevention efforts of the Miami Police Department." This program is in the formative stages. As soon as we have information on how to be involved we will announce it in the Newsletter. EAST -WEST MULTIMODAL CORRIDOR STUDY "The streets and highways along State Road 836 from the Florida Turnpike to Downtown Miarni are congested throughout the day. The recent revival of South Beach. as an entertainment center, and the preser- vation and promotion of Miami Beach's historic district have caused sharp increases in traffic on area roadways. Activity is continuous throughout the day and into the night; all approaches to Miami Beach are overwhelmed with traffic, including the connection of SR836 with I-395, the MacArthur Causeway and the major streets of Miami Beach. The East-West multimodal Corridor study is addressing these congestion problems as well as others identified in the study through a combination of highway and transit improve- ments. The East-West project will link Florida International University to Miami International Airport, downtown Miami, the Seaport, South Beach, the Miami Beach historic dis- trict and the Miami Beach Conven- tion Center. The study is well underway and a number or viable alternatives have been identified based on their tech- nical merits and reduced impacts." While I am the last to stand in the way of an ambitions and capable individual bet- tering himself, I am deeply suspicious that the real reason that this officer may be leav- ing is due to a lack of support and help from his superior officers. It may be that his sense of frustration is derived from the same source as that of many of the homeowners in this area. As a resident of Shorecrest since 1989, I have keenly felt the apparent lack of concern for this area by the police dept.; it seems that we are an unwanted step -child, and that we do not benefit equally from the tax -dollars we spend as do other areas of Miami. I am also wondering whether the quality of the in- dividuals assigned to this area is also sus- pect. I understand from other residents that we have a major who is on record as saying "I don't believe in street closures/ barriers" —it seems that they've worked in 'Golden Triangle' of Opa Locka and now Miami Shores, so why shouldn't they work here? This seemingly'head in the sand' attitude does not encourage the confidence of the residents of this area, and indeed creates an atmosphere that is not pleasant for the police department pf us. I would hope we can avoid further deterioration and that we will see more than the 'lip -service' that we have experienced in the past. I understand that you have spent time working in our neighborhood in the past; as a result you can surely appreciate, as well as we, what needs to be done. We are, as an organization, prepared to learn and help you and your officers to deal with these problems. We appreciate that you are lit- erally 'a thin blue line' in the war against crime and that you need all the intelligence and aid possible. However, we need the cooperation of your officers, and the fact the Officer Gentry may be leaving causes great concern amongst us. He is not amongst the officers who are often seen sitting around together at convenience stores doing nothing, which probably makes him unpopular with those that do shirk their duties —that's human nature! Each of us has a vote, some of us have the financial resources, political contacts and the will to act decisively and demand a change in this situation. I am sure you will be hearing more from the Shorecrest Homeowners Association both personally and on the political front. We are deter- mined to exercise our rights and to receive what is our just due. We want this to be a cooperative effort between the Law En- forcement Department of Miami and the residents of our area. The alternatives are not pleasant to dwell upon, but I can as- sure you that the overall mood in the area is one of disgust and little patience. I ab- hor violence and will do my utmost to control the tendencies of our more vola- tile residents but at some point people may `snap' and take the law into their own hands. If that happens the accompanying publicity and recriminations will do no good for either the area or the police de- partment. In conclusion, people in our area are fed up with being the victims of crime and lackadaisical police enforcement. We are reaching out to you for help, pragmatic and obvious help, not 'lip service.' We want to work with you in a cooperative effort to make the area fit for children and fami- lies. Christopher A. It's an example of the efforts made on your behalf by your Homeowners' Association. We are in the process of changing the quality of life in our area. The Association needs your help and support in order to continue this work. We need your 'bod- ies' and we need your membership dues, now!
