RESOLUTION NO. 9 5` 243
A RESOLUTION, WITH ATTACHMENTS, OFFICIALLY
CLOSING, VACATING, ABANDONING AND
DISCONTINUING THE PUBLIC USE OF THAT PORTION
OF SOUTHWEST 16TH ROAD SET FORTH ON
EXHIBIT "A", ATTACHED HERETO AND MADE A PART
HEREOF, SAID ACTION BEING A CONDITION FOR THE
APPROVAL OF TENTATIVE PLAT NO. 1447-B
"SIMPSON PARK FIRST ADDITION".
WHEREAS, the Miami Zoning Board at its meeting of January 9,
1995, Item No. 6, duly adopted Resolution ZB 006-95 by a seven to
one (7-1) vote, RECOMMENDING APPROVAL of the official vacation
and closure of a portion of Southwest 16th Road as herein set
forth; and
WHEREAS, the City Commission finds that it is in the best
interest of the general welfare of the City of Miami and its
inhabitants to grant the vacation and closure of that portion of
Southwest 16th Road in question and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. The portion of Southwest 16th Road described
on Exhibit "A", attached hereto and made a part hereof, is hereby
closed, vacated, abandoned and discontinued for public use, said
closure, vacation, abandonment and discontinuance being a
condition for the approval of Tentative Plat No. 1447-B "SIMPSON
PARK FIRST ADDITION".
Section 3. This Resolution shall become effective
immediately upon its adoption.

LEGAL DESCRIPTION
All that portion of the Southwest 16th Road lying between the
Northwesterly right-of-way line of South Miami Avenue extended
and the Southeasterly boundary of the Plat entitled "SIMPSON
PARK", according to the Plat thereof, as recorded in Plat Book 82
at Page 70, of the Public Records of Dade County, Florida.
Note: The portion of Southwest 16th Road being vacated contains
approximately 7,768 square feet.

Pursuant to discussions with the Miami Roads Homeowner's Association, and in consideration for the
closure and vacation of SW 16th Road, we would like to proffer the donation and installation of
approximately 150' x 6' high of Black Vinyl Chain Link Fence at the perimeter of Simpson Park and
adjacent to the promV of 1626 South Miami Avenue. This donation will complete the fencing arotmd
the perimeter of the Park of which the City had erected on three sides last year but had not been completed
behind the adjacent homeowners properties. 'Ibis donation is valued at a total cost of $1,600 based on an
estimate provided by Sovereign Consttucd,on Group, the original,contractor.

ANALYSIS The Public Works Department and the Plat and Street Committee have studied the proposed closure
of S.W. 16 Road northwest of South Miami Avenue and have determined that the closure of this
roadway will not adversely affect traf`lc circulation or access for public service vehicles
such as trash and garbage trucks, fire -lice and/or other emergency vehicles. S.W. 16 Road
currently is undeveloped and extends ap, iximately 150 feet and dead ends into Simpson Park and
is not part of the critical pedestrian and vehicular transportation network for the
neighborhood'. The Plat and Street Committee has reviewed the tentative plat of "Simpson Park
First Addition" and determined that all technical requirements contained in the City Code*
Subdivision Regulations have been met. The Public Works Department and the Plat and Street
Committee recommend approval of this street closure request.

The City of Miami Plat and Street Committee, at its meeting of June
2, 1994, approved the above tentative plat subject to the following
revisions being made to the tentative plat, additional information
being provided and/or variances being granted. Please be advised
that the processing of your tentative plat cannot proceed until
these conditions have been satisfied.
- Obtain written verification from utility companies that
easements are correctly shown.
- Monuments must be established on corners in City of
Miami Simpson Park and should -be shown on final plat.
- In the legal, description refer_. to "Rackley's
Resubdivision".
Reword the express purpose statement.
In reference to the proposed 10' alley, the dashed line
should be a solid line and the solid lines should be
dashed lines.
Provide note to remove dog cage slab encroachment.
The final plat must be on a 30" X 36" tracing.

Simpson Park First Addition
- Provide state plane coordinates for final plat.
- Remove chain link fence encroachment.
- Correct the word "zone" in Surveyor's Note No. 9. Also
add following language: "CS(conservation) in accordance
with City of Miami Ordinance 11000, as amended".
- The Plat & Street Committee has reviewed the public
interest requirements set forth in Sec. 54.5.16 of the
Miami City Code for the vacation and closure of S.W.
16th Road and finds said vacation° and closure to be in
the best interest of the public.
In addition to the above requirements, you should be aware'of
the following:
1. State and local laws require the installation of various
physical improvements in the public rights -of -way when
property is platted. I These subdivision improvements
include paving, drainage, landscaping, sidewalks, etc. In
some cases this could represent a substantial investment
on your part.
2. The alteration, relocation or installation of utilities
such as storm and sanitary sewers, electric, telephone,
water, etc., caused by this plat will be at the property
owner's expense. Also, utility easements may be required
on the property being platted.
3. A building permit will not be issued on the property being
platted until the final plat is recorded. Also, the
Certificate of Occupancy for any building construction will
be issued only after all the required subdivision
improvements have been completed.
4. Approval for fire flow requirements must be obtained from
the Fire, Rescue and Inspection Services Department prior
to the issuance of a building permit.
5. Additional items must be provided to the. City of Miami
Department of Public works before the final plat is
submitted to the City Commission for approval. You will be
notified in writing as to what these items are after the
amount of the bond has been determined for the necessary
subdivision improvements.

6. Tentative plat approval is only valid for one (1) year from
the date of the Plat and Street Committee Meeting at which
time it was approved.
