RESOLUTION NO 9 217
A RESOLUTION, WITH ATTACHMENT(S), AUTHORIZING
THE CITY MANAGER TO NEGOTIATE AN INTERLOCAL
AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY WITH EITHER DADE COUNTY OR
OKEECHOBEE COUNTY, FLORIDA, TO DISPOSE OF
SOLID WASTE GENERATED BY RESIDENTS,
BUSINESSES AND FACILITIES WITHIN THE CITY OF
MIAMI; FURTHER DIRECTING THE CITY MANAGER TO
PRESENT THE RESULTS OF SAID NEGOTIATIONS TO
THE CITY COMMISSION FOR REVIEW AND
CONSIDERATION.
WHEREAS, the City of Miami ("City") has the duty and
authority to provide for the disposal of municipal solid waste
generated by residents, businesses and facilities within its
jurisdiction; and
WHEREAS, the City is desirous of providing for such solid
waste disposal services at the most economical rates possible

consistent with environmental sound disposal methodologies; and
WHEREAS, the current solid waste disposal agreement by and

between Wheelabrator South Broward, Inc. ("Wheelabrator") and the
City expires on September 30, 1995; and

WHEREAS, the City has contracted with Bedminster Seacor
Services Miami Corporation ("Bedminster/SSI") for future solid
waste disposal services commencing no later than 1998; and

WHEREAS, the City desires to enter into a multi -year
agreement for solid waste disposal services commencing on
October 1, 1995, at a fixed tonnage fee, that would further serve
as a backup to the Bedminster/SSI agreement, in the event
Bedminster/SSI does not come on-line as set forth in the
Bedminster/SSI agreement; and
WHEREAS, the City Manager or his designee has contacted
various solid waste disposal service providers to determine
availability and price for the desired solid waste disposal
services; and
WHEREAS, the City has discussed with representatives of
Okeechobee County, Florida ("County") and Chambers Waste Systems
of Florida, Inc. ("Chambers") and with Dade County, Florida
("Dade") the terms and conditions for an Interlocal Agreement
("Agreement") with the County or with Dade, as the case may be,
for the desired solid waste disposal services; and
WHEREAS, either the County, Dade or the City have the power
to enter into agreements with other governmental agencies within
or outside of their respective boundaries for joint performance,
or the performance by one unit on behalf of the other, or any of
either agency's authorized functions pursuant to the Florida
Interlocal Cooperation Act of 1969, as amended (Section 163.01,
Florida Statutes); and

WHEREAS, the County or Dade has the authority to enter into
agreements with other persons to undertake to fulfill some or all

of their respective responsibilities for solid waste disposal;
and
WHEREAS, the City estimates a significant economic savings
by disposing of the City's solid waste through the County or
through Dade, as the case may be, as compared to the present
disposal agreement with Wheelabrator;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized-!/ to
negotiate an Interlocal Agreement, in a form acceptable to the
City Attorney with Okeechobee County, Florida or Dade County,
Florida, as the case may be, to dispose solid waste generated by
residents, businesses and facilities within the City of Miami;
Section 3. The City Manager is hereby directed to
present the results of said negotiations for an Interlocal
Agreement to the City Commission for review and consideration.
The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.

Section 4. This Resolution shall become effective
immediately upon its adoption.

Effective Date: October 1, 1995.
Term: 23 years; including backup to
Bedminster/SSI Agreement
(explained fully in Agreement).
Price Per Ton: $38.00 delivered to Transfer Site Qr.
$24.00 delivered to Regional Landfill
(subject to conditions discussed with
City Manager re: additional transfer
capacity and/or facilities).
Annual CPI Adjustment: 3% first applied October 1, 1998.
Annual Tons: Not less than 100,000;
put -or -pay requirement.
Transfer Site: Reuter Recycling of Florida

(or comparable location at similar distance).
Excuse of Performance: Acts of force majeure

ENCLOSURES:
It is respectfully recommended that the City Commission authorize the City
Manager to negotiate and execute an Interlocal Agreement with Okeechobee
County for disposal of the City of Miami's municipal solid waste.
BACKGROUND
The City currently has a solid waste disposal agreement with Wheelabrator
South Broward, Inc. (Wheelabrator) that expires on September 30, 1995. The
City's contract for future waste disposal services with Bedminster Seacor
Services Miami Corporation (Bedminster/SSI) no later than 1998. It would be
beneficial to the City to enter into a multi -year agreement for solid waste disposal
services commencing on October 1, 1995 at a fixed tonnage fee, that would
serve as a backup to Bedminster/SSI agreement, in the event Bedminster/SSI
does not come on line as set forth in the Bedminster/SSI agreement.
As a result, the Administration has contacted various solid waste disposal
service providers to determine the availability and price for waste disposal
services. The Administration has determined that the City would experience
substantial economic savings by disposing of the City's solid waste at the
designated transfer site or comparable location (i.e. Reuters Recycling Facility in
Pembroke Pines) for ultimate disposal at the Okeechobee County's regional
landfill facility, operated by Chambers Waste Systems of Florida, Inc.
(Chambers) a private waste disposal company, as compared to the present
disposal agreement with Wheelabrator.
