HomeMy WebLinkAboutR-95-0198J-95-61 2/15/95 RESOLUTION NO. 95- 198 A RESOLUTION RESCINDING, IN ITS ENTIRETY, RESOLUTION NO. 94-736, ADOPTED OCTOBER 27, 1994, WHEREBY THE RESURFACING OF FIVE TENNIS AND BASKETBALL COURTS IN GIBSON PARK BY AGILE COURTS CONSTRUCTION COMPANY, INC. WAS AUTHORIZED; APPROVING THE RESURFACING OF FIVE TENNIS AND BASKETBALL COURTS IN GIBSON PARK FOR THE DEPARTMENT OF PARKS AND RECREATION, UNDER EXISTING DADE COUNTY CONTRACT NO. 1153-0/95, BY AAA COURTS, INC., AT A TOTAL PROPOSED AMOUNT OF $15,805.00; ALLOCATING FUNDS THEREFOR FROM CAPITAL IMPROVEMENT PROJECT NO. 331341, ACCOUNT CODE NO. 589301-860; AUTHORIZING THE CITY MANAGER TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER FOR SAID PURPOSE. WHEREAS, the City Commission adopted Resolution No. 94-736 on October 27, 1994, which Resolution authorized the resurfacing of five tennis and basketball courts in Gibson Park under existing Dade County Contract No. 1153-0/95, by Agile Courts Construction Company, Inc., at a total proposed amount of $16,863.00; and WHEREAS, pursuant to an addendum received from Dade County, the Procurement Management Division of the Department of General Services Administration and Solid Waste has been notified that the primary vendor under Dade County Contract No. 1153-0/95 was AAA Courts, Inc., not Agile Courts Construction Company, Inc.; and =Y comm-siON. MEETING OF MAP, 0 9 1995 Resolution No. 95- 198 WHEREAS, pursuant to said notification, the Department of Parks and Recreation of the City of Miami contacted AAA Courts, Inc. to request its estimated proposal for resurfacing five tennis and basketball courts in Gibson Park under existing Dade County Contract No. 1153-0/95; and WHEREAS, for the same scope of work, the estimate received from AAA Courts, Inc., in the total proposed amount of $15,805.00, is less than the estimate received from Agile Courts Construction Company, Inc., in the amount of $16,863.00; and WHEREAS, based on the foregoing, the City Manager and the Director of the Department of Parks and Recreation recommend that the services of AAA Courts, Inc., under existing Dade County Contract No. 1153-0/95, for a total proposed amount of $15,805.00, be approved; and WHEREAS, funds for said purpose are available from Capital Improvement Project No. 331341, Account Code No. 589301-860; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Resolution No. 94-736, adopted October 27, 1994, is hereby rescinded in its entirety. 95- 198 -2- Section 3. The resurfacing of five tennis and basketball courts in Gibson Park for the Department of Parks and Recreation, under existing Dade County Contract No. 1153-0/95, by AAA Courts, Inc., at a total proposed amount of $15,805.00, is hereby approved, with funds therefor hereby allocated from Capital Improvement Project No. 331341, Account Code No. 589301-860. Section 4. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a purchase order for said purpose. Section 5. QUIN e70155, fifT CITY TTORNiY NF:BSS:M48 mm 95- 198 TO FROM CITY OF MIAMI, FLORIDA �� INTER -OFFICE MEMORANDUM Honorable Mayor and Members of the City Commission Ces� City Odio DATE : FEB 2 4 1995 FILE : SUBJECT: Resolution Award for Resurfacing Five Courts at Gibson Park REFERENCES: ENCLOSURES: REC0MMENDATZON:_ It is respectfully recommended that the City Commission adopt the attached resolution rescinding, in its entirety, Resolution No. 94-736, adopted October 27, 1994, whereby the resurfacing of five tennis and basketball courts in Gibson Park by Agile Courts Construction Company, Inc. was authorized, and furthermore, approving the resurfacing of the five tennis and basketball courts in this park by AAA Courts, Inc., 4730 S.W. 83 Terrace, Suite 102, Davie, Florida 33326 (a non -minority firm), under a currently effective Metropolitan Dade County Contract No. 1153- 0/95, at a total cost of $15,805.00. Funds for this improvement are to be provided from the Capital Improvement Project No. 331341, "Gibson Park Renovations". BACKGROUND• On October•27, 1994, the City Commission adopted Resolution No. 94-736 authorizing the resurfacing of five tennis and basketball courts in Gibson Park under an existing Dade County Contract No. 1153-0/95, by Agile Courts Construction Company at a total proposed amount of $16,863.00. The Procurement Management Division of the Department of General Services Administration and Solid Waste was notified by an addendum received from Dade County, that the primary vendor under this contract no. 1153-0/95 was AAA Courts, Inc., and not Agile Courts Construction Company, Inc. (Attached please find copies of correspondence between Ms. Judy Carter, Chief Procurement Officer, and these two vendors regarding this matter.) Pursuant to said notification, Recreation contacted AAA Courts, proposal for resurfacing the five Gibson Park under the existing 0/95. the Department of Parks and Inc. to request its estimated tennis and basketball courts in Dade County Contract No. 1153- 95- 198 yz�l Page 2 Honorable Mayor and Members of the City Commission The estimate received from AAA Courts, Inc. in the total proposed amount of $15,805.00 is less than the estimate received from Agile Courts Construction Company, Inc. in the amount of $16,863.00, for the same scope of work. We therefore recommend authorization to procure the services of AAA Courts, Inc. for resurfacing at this site. Citywide Neighborhood Park Renovation Project funds will provide the necessary financing for this project. Based on information received from Metro Dade County concerning Dade County Contract No. 1153-0/95, which indicated that Agile Courts Construction was the successful bidder, the City of Miami Commission made three (3),awards to Agile on October 27, 1994. „ Generally in the past when we received notices of Dade County contract awards, we did not obtain any subsequent addenda issued for the contracts. We were, therefore, unaware that any corrections had been made to the contract and only later discovered that AAA Courts was in fact awarded the Dade County contract, per Addendum No. 1, issued almost four (4) months after contract award. No work has commenced on the above noted projects and we have advised Agile Courts not to proceed with the work. We will be making a recommendation to the City Commission to rescind awards made to Agile Construction and to award said contracts to AAA Courts. Sincerely, J n S.
