RESOLUTION NO.
A RESOLUTION, RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S WAIVER OF ALL
USER FEES FOR THE USE OF THE BOBBY MADURO
MIAMI BASEBALL STADIUM BY MIAMI DADE
COMMUNITY COLLEGE-WOLFSON CAMPUS FOR THE
PRESENTATION OF GAMES AND PRACTICES BY SAID
SCHOOL'S BASEBALL TEAM, THE BARRACUDAS, FOR
THE PERIOD SEPTEMBER 20, 1994 THROUGH
APRIL 20, 1995; AUTHORIZING THE CITY MANAGER
TO EXECUTE AN AGREEMENT, IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY, BETWEEN THE CITY OF
MIAMI AND MIAMI DADE COMMUNITY
COLLEGE-WOLFSON CAMPUS FOR SAID PURPOSE,
SUBJECT TO THE ORGANIZERS OBTAINING INSURANCE
TO PROTECT THE CITY IN AN AMOUNT AS
PRESCRIBED BY THE CITY MANAGER OR HIS
DESIGNEE.
WHEREAS, the Department of Conferences, Conventions and
Public Facilities is responsible for the operation of the Bobby
Maduro Miami Baseball Stadium and attempts to secure the
presentation therein of events for the community; and
WHEREAS, presentation of baseball games by Miami Dade
Community College -Wolfson Campus is representative of the type of
community sports event the city desires to promote; and
WHEREAS, Section 53-146(c)(6) of the Code of the City of
Miami, Florida, as amended, provides that the City Commission has
the right to establish and fix special charges or special terms
and conditions for the use of said stadium;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager's action in waiving all user
fees for the use of the Bobby Maduro Miami Baseball Stadium by
Miami Dade Community College -Wolfson Campus for the presentation
of games and practices by said school's baseball team, the
Barracudas, for the period September 20, 1994 - April 20, 1995 is
hereby ratified, approved and confirmed.
Section 3. The City Manager is hereby authorizedl' to
execute an agreement, in a form acceptable to the City Attorney,
between the City of Miami and Miami Dade Community College -
Wolfson Campus for said purpose, subject to the organizers
obtaining insurance to protect the city in an amount as
prescribed by the City Manager or his designee.
Section 4. This Resolution shall become effective
immediately upon its adoption.

and regulations for:
Miami Dade Community
College -Wolfson Campus
REFERENCES: Athletic Department.
ENCLOSURES:
It is respectfully recommended that the City Commission adopt the
attached proposed resolution establishing special charges, terms
and conditions for the use of the Bobby Maduro Miami Baseball
Stadium by Miami Dade Community College -Wolfson Campus Athletics
Department, for the presentation of baseball games and practices
from now through April 20, 1995. The legislation would also
authorize the City Manager to execute an agreement, in
substantially the attached form, with this organization for this
purpose.
The Department of Conferences, Conventions and Public Facilities
wishes to allow Miami Dade Community College -Wolfson Campus
Athletic Department to use said facility for the presentation of
several baseball games and practices for said period. The
Baracudas baseball team has in the past, used said stadium for
the above purpose.
The administration has determined that modifications to the
standard use charges, terms and conditions as specified in the
City Code are appropriate for this event and has prepared an
agreement with Miami Dade Community College -Wolfson Campus, which
delineates the various revised charges, terms and conditions for
said use.
