HomeMy WebLinkAboutR-95-0117J-95-134 2/8/95 RESOLUTION NO. 9 5 _ 117 A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO MUTUAL AID AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, ON BEHALF OF THE CITY OF MIAMI WITH THE FOLLOWING LAW ENFORCEMENT AGENCIES: METROPOLITAN DADE COUNTY, SOUTH MIAMI, HIALEAH, NORTH BAY VILLAGE, KEY BISCAYNE, NORTH MIAMI, OPA-LOCKA, FLORIDA HIGHWAY PATROL AND THE FLORIDA DEPARTMENT OF LAW ENFORCEMENT, FOR THE PURPOSE OF IMPLEMENTING THE FLORIDA MUTUAL AID ACT PROGRAM WITH SAID PARTICIPATING GOVERNMENTAL AGENCIES. WHEREAS, there is existing and continuing possibility of the occurrence of law enforcement problems and other natural and man- made conditions which are or are likely to be beyond the control of the services, personnel, equipment or facilities of the City of Miami Police Department and/or the participating municipal police departments; and WHEREAS, to meet the responsibility of the respective governments to ensure the public safety and peace for the citizens of their communities, it is necessary for the various governmental agencies to enter into Mutual Aid Agreements, pursuant to Chapter 23 of the Florida Statutes; and WHEREAS, Section 23.1225(3) of the Florida Statutes requires that authorization for entering into Mutual Aid Agreements must first be approved by the municipality; CITY COMUSSION KEETLNG OF FED 0 �i 1995 Revolution No. 95- 117 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized" to enter into Mutual Aid Agreements, in a form acceptable to the City Attorney, on behalf of the City of Miami with the following law enforcement agencies: Metropolitan Dade County, South Miami, Hialeah, North Bay Village, Key Biscayne, North Miami, Opa-Looka, Florida Highway Patrol and the Florida Department of Law Enforcement, for the purpose of implementing the Florida Mutual Aid Act Program with said participating governmental agencies. Section 3. This Resolution shall become effective immediately upon its adoption. PASSED AND ADOPTED this 9th day of February 1996. y i STEPHEN P. J lII City Atto DATE : J=uat'y 30, 1995 FILEt7-95-134 SUBJECT : Proposed Resolution: Matual Aid Agreements with participating gover�m>ental agencies REFERENCES: City CD mdssion Meeting Febn wy 9, 1995 ENCLOSURES: (1) Pursuant to Chapter 23 of the Florida Statutes, the Florida Mutual Aid Act was adopted to provide that, should law enforoement problems and other natural man-made conditions go beyond the control of the services, personnel, equipment or facilities of a particular participating governmental agency, a participating agency can seek the cooperation and assistance of other participating law enforcement agencies. The attached proposed Resolution is submitted for your consideration as, pursuant to Section 23.1225(3) of the Florida Statutes, a municipality must first authorize the Mayor or Chief Administrative Officer to enter into Mutual Aid Agreements with participating agencies.
