HomeMy WebLinkAboutR-95-0102J-95-74 2/9 /95 RESOLUTION NO. 9r- 102 A RESOLUTION, WITH ATTACHMENT(S), CONFIRMING RESOLUTION NO. 89-828, ADOPTED SEPTEMBER 14, 1989, THEREBY ESTABLISHING THE FLAGLER/CORE AREA SECURITY DISTRICT SPECIAL IMPROVEMENT DISTRICT AND EXTENDING SAID DISTRICT FOR AN ADDITIONAL ONE YEAR PERIOD; DESIGNATING THE PROPERTY UPON WHICH THE SPECIAL ASSESSMENTS SHALL BE MADE AND ESTABLISHING AND LEVYING SPECIAL ASSESSMENTS AGAINST THE PROPERTIES IN SAID DISTRICT FOR THE PROVISION OF PROMOTION, MARKETING AND OTHER SIMILAR SERVICES FOR THE PURPOSE OF STABILIZING AND IMPROVING SAID DISTRICT. WHEREAS, Chapter 170, Florida Statutes, authorizes a municipality, subject to the approval of a majority of the affected property owners, to levy and collect special assessments against property benefited for the purpose of stabilizing and improving retail and/or wholesale business districts and/or nationally recognized historic districts through promotion, management, marketing and other similar services in business districts of the municipality; and WHEREAS, on June 7, 1989, pursuant to Resolution No. 89-548, the City Commission declared the Flagler/Core Area Security District to be a Special Improvement District for the provision of the above specified services in accordance with applicable provisions of Chapter 170, Florida Statutes, as amended; and ATT ACH ME T (c� (0N, TAItlIED CITY Cobwssxom MEETING OF. Si rely, osie Legido Correa Executive Director JLC/m 95- 102 INGRAHAM BUILDING • 25 SOUTHEAST 2ND AVENUE • SUITE 825 • DOWNTOWN MIAMI, FLORIDA 33131 TELEPHONE: (305) 379-7070 • FAcsIMILE: (305) 379-7222 WHEREAS, on September 14, 1989, pursuant to Resolution No. 89-828, the City Commission confirmed the establishment of the Flagler/Core Area Security District Special Improvement District (the "District") providing enhanced street maintenance and similar services in the District; and WHEREAS, the established District has been extended by one- year terms pursuant to Resolution Nos. 91-292, 92-249, 92-473, 93-127 and 94-77; and WHEREAS, the District, as extended by Resolution No. 94-77, will expire on March 7, 1995; and WHEREAS, the affected property owners have met and discussed further extension of the District and have appointed an Advisory Committee which has recommended that the District be extended for one additional year, for the provision of promotion, marketing and other similar services; and WHEREAS, the affected property owners desire that the special assessments be administered by the Downtown Miami Partnership, Inc., a not -for -profit Florida Corporation, subject to approval by Commissioner Wifredo Gort who shall have veto powers with regards to the use of the funds; and WHEREAS, the City Commission is cognizant of the property owners' concerns, and is desirous of implementing the recommendations of the Advisory Committee, subject to the approval of a majority of affected property owners; 95- 102 W-= NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Flagler/Core Area Security District Special Improvement District, established by Resolution No. 89-28, is hereby confirmed and extended for a term of one (1) year from the date this Resolution, subject to approval by a majority of the affected property owners in accordance with the provisions of Chapter 170, Florida Statutes. Section 3. The improvements to be provided by the levying and collection of special assessments shall consist of promotion and marketing services. Section 4. The properties upon which the special assessments shall be made, which are hereby described as all lots and lands located within the District legally described in Composite Exhibit "A" hereto, shall be assessed as follows, except exempt non-taxable lots and lands. 95- 102 -3- a. Buildings intended predominantly for office use and surface parking lots shall be assessed at $0.175 per $1,000 of assessed value; b. All other buildings shall be assessed at $0.928 per $1,000 of assessed value. Section 5. A preliminary assessment roll shall be promptly filed with the City Clerk's Office in accordance with this Resolution and the applicable provisions of Chapter 170, Florida Statutes. Section 6. This Resolution shall become effective after a public hearing, and upon approval of a majority of the property owners as set forth in Section 2 hereinabove. Background on June 7, 1989, the City Commission passed Resolution No. 89- 548, as amended, establishing the Flagler/Core Area Security District Special Improvement District. On June 30, 1989, the City Commission passed Resolution No. 89- 626 establishing the assessment rates for said District. On September 14, 1989, the City Commission passed Resolution No. 89-828 determining that security and street maintenance and similar services be provided for a period of one year in the Flagler/Core Area security District Special Improvement District. The Commission further levied special assessments against properties, in said district, benefiting through provision of such services in accordance with the final assessment roll filed with the City Clerk. The District was expanded by Resolution No. 91-468; extended for one year by Resolution No. 91-292 and for ninety days by Resolution No. 92-248. On July 9, 1992, the City Commission passed Resolution No. 92-473 extending the District for a period of one hundred ninety-two days (through March 7, 1993). Rafael Kapustin as Vice Chair of Downtown Miami Partnership began the meeting by giving a brief history on the special assessment district. Rafael said that the sentiment on the street from many property owners who pay the special assessment is that they no longer want the district to continue. Rafael said Commissioner Gort knowing this, suggested the idea of using the money on a one year experiment basis for marketing Downtown. Rafael asked those present what they felt about this idea, and opened up the meeting for discussion. A discussion then proceeded as to how much money this assessment generates. Josie said last year the monies generated were approx. $ 315,000.00. Oscar White said that is only a drop in the bucket, although I agree that the security issue is one that the City should be dealing with. Nancy Restrepo from Burdines commented on the fact that as far as marketing is concerned that is very little money. Nancy also said the good thing though is that Downtown can then start marketing itself together with Bayside and Omni as part of the one City one Downtown theme. Rafael said the monies would be used for public relations, for educating merchants and property owners, advertising, marketing etc... Howard Stone from Burdines said but if you are going to use this money for marketing downtown and when people get 95- 102 here they do not like what they see what good will the marketing do. Oscar White said what if some of the money was used towards security and some towards marketing. Josie said for that amount of money you could not get an), type of security if you had less wackenhut people they would not be able to cover the whole district properly. Sergio Rok said if we keep paying for security the City will not see the need to provide adequate security because we are paying for it ourselves. Rafael the way this procedure works is as follows, we will make a recommendation from what this group decides and it will go before the Commission for a first hearing in January and then a second hearing in February, that is the reason we met at this time because we need to get our recommendation on the City Commission agenda in early January. Rafael said in the past the recommendation that the property owners come make to the Commission, is usually supported by the Commission since it is the property owners money anyways. Josie said in the letter we sent out to property owners we asked them to respond via letters if they could not attend this meeting and I have received sixteen letters. I have verified the folio #'s and property names etc.. and everything is correct, all sixteen letters are against extending the district for security and all are in favor of using the money for marketing. A discussion went on for one hour, at approx. 6:30 p.m., Georgina Pardo made a motion, "To extend the district only for one more year provided that the money be used for marketing the district". Oscar White seconded the motion. A discussion then followed and Sergio Rok said I would like to amend that motion to include that the funds be administered by the property owners association, Downtown Miami Partnership, through a Committee of property owners assessed in this district. Georgina then amended the motion to read "To extend the district for one more year provided that the money be used for marketing the district", and that the funds be administered by the property owners association, Downtown Miami Partnership, through a committee of the property assessed in this district. Oscar White seconded the motion. Rafael asked how many are in favor and how many are against. There were eleven (11) Property owners represented, ten (10) were in favor and one (1) was opposed. Jim Wallen from the Holiday Inn said we are in favor of using the money for security, so I oppose this motion. Rafael suggested the possibility of hiring Counsel to represent the group before the Commission with their recommendation. All present agreed this would be a good idea.
