A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION AFTER A
DULY ADVERTISED PUBLIC HEARING, RATIFYING THE
CITY MANAGER'S FINDING OF SOLE SOURCE;
WAIVING THE REQUIREMENTS FOR COMPETITIVE
SEALED BIDS AND APPROVING THE ACQUISITION OF
A FORENSIC DRYING CABINET FROM DENLEY
INSTRUMENTS, INC., THE SOLE SOURCE PROVIDER
FOR THIS EQUIPMENT, AT A PROPOSED TOTAL COST
OF $16,835.00 FOR THE DEPARTMENT OF POLICE;
ALLOCATING FUNDS THEREFOR FROM THE POLICE
DEPARTMENT'S GENERAL OPERATING BUDGET,
ACCOUNT CODE NO. 290201-840; AUTHORIZING THE
CITY MANAGER TO INSTRUCT THE CHIEF
PROCUREMENT OFFICE TO ISSUE A PURCHASE ORDER
FOR THIS EQUIPMENT.
WHEREAS, the Police Department is recommending that
competitive bidding be waived for the purchase of a Forensic
Drying Cabinet from Denley Instruments, Ino., at a total proposed
cost of $16,835.00; and
WHEREAS, this cabinet will be utilized by the Police
Department for the purpose of drying blood soaked evidence; and
WHEREAS, the Police Department has been informed that only
blood soaked evidence from homicide cases will be allowed in the
examiner's facility after January 15, 1995; and
WHEREAS, the Federal Government has issued striot guidelines
on the handling and storage of blood -borne pathogens, therefore a
proper facility to dry blood soaked evidence is critically
needed; and

WHEREAS, the Chief Procurement Officer has adopted a finding
that Denley Instruments, Inc., is the only vendor able to provide
the equipment as specified by the City; and
WHEREAS, the finding of the Chief Procurement Officer has
been approved and adopted as the finding of the City Manager; and
WHEREAS, the City Manager and the Chief Procurement Officer
recommend that the requirements for competitive formal sealed
bids be waived and the procurement of this equipment from Denley
Instruments, Inc., as the sole source, be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a 4/5ths affirmative vote of the members
of the City Commission, after a duly advertised public hearing,
the City Manager's finding that Denley Instruments, Inc. is the
sole source provider of a Forensic Drying Cabinet required by the
Department of Police, is hereby ratified.
Section 3. The requirements for competitive sealed bids
is hereby waived and the Department of Police's request for the
acquisition of a Forensic Drying Cabinet from the above sole
source provider is hereby approved, with funds therefor hereby
allocated, in a total proposed amount of $16,835.00, from the
Police Department General Operating Budget, Account Code
No.290201-840.

Section 4. The City Manager is hereby authorized to
instruct the Chief Procurement Officer to issue a purchase order
for this equipment.
Section 5. This Resolution shall become effective
immediately upon its adoption.

ENCLOSURES:
It is respectfully recommended that the City Commission waive the
necessity of competitive bids and approve the attached resolution
for the purchase of an ASTEC Forensic Drying Cabinet, from Denley
Instruments, Inc., at total cost not to exceed $16,835.
BACKGROUND
'The Police Department presently utilizes the Dade County Medical
Examiner's facility for the purpose of drying blood-soaked
evidence. They are, now, informing us that only blood-soaked
evidence from homicide cases will be allowed in their facility
after January 15, 1995. We will, therefore, require a proper
facility to dry blood-soaked evidence that the Medical Examiner
will no longer accept. Additionally, the Federal Government has
issued strict guidelines on the handling and storage of
bloodborne pathogens. We have evaluated a drying cabinet
produced by ASTEC and distributed by Denley, Inc., the sole
source provider of this type of cabinet in the United States.
The cabinet meets the Police Department's requirements and is
being offered at an introductory price, of $16,835 which is
$3,015 below the list price.
The Chief Procurement Officer has determined that Denley
Instruments, Inc., is the sole authorized United States
distributor of the ASTEC Forensic Drying Cabinet.
It is, therefore, recommended that the Resolution authorizing the
waiver of sealed bids and the purchase of an ASTEC Forensic
Drying Cabinet, from Denley Instruments, Inc., at a total cost
not to exceed $16,835, be approved. Funding will be from the
Police Department General Operating Budget, Index Code 290201-
840.

Dear Mr. Schonberger:
In response to our telephone conversation, please let me confirm that Denley Instruments, Inc. is
the sole source supplier for the ASTEC Forensic Drying Cabinet in the United States. Therefore,
all sales and service are coordinated through our office in North Carolina.
The five-foot cabinet is made to order, in England,with a delivery time of six weeks after receipt
of order. The instrument requires a standard 110 volt electrical connection and simple water
supply and drainage plumbing which can be installed by a local plumbing contractor. A Denley
representative will meet with you at the time of. installation to provided calibration of the
instrument and training for your personnel. If you require further information; please contact me

An invesAgation was QVILdut;Lwd by the Procurement Managemont
staff to determine whether Donley Instruments, Inc. A non-
•minority/non-lnnal vendor of Research Triangle Park, North
Carolina is the sole source supplier of the Astec Forensic Drying
Cabinet specified by the Police Department.
Presently, the Pvl.Lce Department utilizes the Dodo County Medical
Examiner's facility for the purpose of drying blood soaked.

contacted to find out if they manufactured or distributed a
drying cabinet as or equal to the Astec Forensic Drying Cabinet.
There responses are as follows: M & S Manufacturing currently do
not have a cabinet that meets specificaLIVILc; however could
possibly manulauLure a drying cabinet to meet apace with a
definato increase In cost; Dectron Inc. primarily deals with food
prs nsmwing drying cabinets; Great Steel. Equipment of America does
not manufacture drying cabinets of this type, and Terra Universal
deals with photographic drying cabinets used in the prucemai iy
of film and slides.
The Dade County Medical Examiners Office was contacted to find
out if they or the Police Department used the Forensic Drying
cabinet requested. I was informed that the Metro -Dade voli'e
Department is planning to purchase the adore trying cabinet iram
Uenley InstrwitauLbF Inc. in the near futuro.
