Home My WebLink AboutR-95-0070U-95-123 1/12/95 RESOLUTION NO . 9 5 - 70 A RESOLUTION URGING THE FLORIDA LEGISLATURE TO ENACT THE OFFICER EVELYN GORT CAREER CRIMINAL ACT DURING THE 1995 LEGISLATIVE SESSION; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THE HEREIN RESOLUTION TO THOSE OFFICIALS DESIGNATED HEREIN. WHEREAS, public safety and tranquility is and should always be the highest priority of government; and WHEREAS, crime and fear of crime in Florida negatively affects the quality of life in Florida and threatens the economy of the State; and WHEREAS, Florida is in a state of crisis as its citizens are being terrorized by criminal activity, in particular, crimes committed by repeat offenders known as career criminals; and WHEREAS, career criminals are individuals arrested and convicted repeatedly, and then returned to the community to commit even more crimes; and WHEREAS, Florida has created a revolving door for career criminals, thereby wasting local tax dollars spent identifying, arresting and prosecuting offenders who spend little or no time in prison once convicted; and WHEREAS, statistics compiled during Fiscal Year 1992-1993 indicate that 529 out of 2,151 Florida criminals convicted of at least three serious felonies, who served at least one previous CITY COMuSSOm, MEETING OF JAN 1 2 1995 Resolution No. 95- 70 State prison sentence, and were again oonvioted of another serious felony, did not get sentenced to even one day in prison; and WHEREAS, the nffioer Evelyn Gut Career Criminal Aot is named after a Dade County Police Offioer, murdered by a 22 year old career criminal who amassed 21 felonies since his 18th birthday, received only two State prison sentences, and served only six months for both sentences combined; and WHEREAS, the Officer Evelyn Gort Career Criminal Aot is presently a proposed law that would, if adopted, impose fixed, lengthy terms of imprisonment on persons oonvioted of burglary of a structure, robbery or other forcible felonies, who have previously been convicted three times or more for forcible felonies; and WHEREAS, the Officer Evelyn Gort Career Criminal Act would also impose a mandatory 15 year prison term on any person convicted of possessing a firearm who has three or more previous convictions or delinquency adjudioations for foroible felonies; and WHEREAS, the Officer Evelyn Gort Career Criminal Act provides that career criminals receive a mandatory prison term of ten (10) years, thirty (30) years, or life, depending on the degree of the forcible felony for which they are convicted; and WHEREAS, the nffioer Evelyn Gort Career Criminal Aot will prevent oareer oriminals from serving less than 85% of their sentences; and 95- '70 -2- WHEREAS, adoption of the Officer Evelyn Gort Career Criminal Aol is absolutely imperative to isolate violent career criminals who commit an inordinate number of the crimes in our community, ruining the quality of life in Florida, as well as causing immeasurable pain, suffering and loss to victims and their loved ones; and WHEREAS, the Officer Evelyn Gort Career Criminal Act, supported by the Florida Police Chiefs Association, the Florida Sheriffs Association, the Florida Fraternal Order of Police, the Miami Fraternal Order of Police, the Florida Police Benevolent Association, the Dade County Police Benevolent Association, the Dade County Association of Chiefs of Police, the Dade County Board of County Commissioners, the Dade County State Attorneys Office and the Dade Delegation of the Florida Legislature, will be an effective tool to protect the public safety by dealing with the worst of the.State's career criminals; and WHEREAS, in order to ensure that career criminals will no longer ruin the quality of life in Florida, it is imperative that the Officer Evelyn Gort Career Criminal Act be adopted by the Florida Legislature; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. 95- 70 -3- " 1,„'� Section 2. The Florida Legislature is hereby urged to enact the OFFICER EVELYN GORT CAREER CRIMINAL ACT during the 1995 Legislative Session. Section 3. The City Clerk is hereby directed to transmit a copy of the herein Resolution to all members of the Dade County Legislative Delegation, Florida State Senate President James A. "Jim" Scott, and Florida State Speaker of the House of Representatives Peter Rudy Wallace. Section 4. This Resolution shall become effective immediately upon its adoption. Thank you for your cooperation. wGrod cc: Cesar Odio, City Manager 95- 70 Career criminals are exacting a terrible cost to society in human suffering and property loss, while turning Florida into a "state of fear" where people are forced to live like prisoners in their own homes. Career criminals are individuals who are arrested and convicted repeatedly, and then return to the community to commit even more crimes. As they pass through this revolving door, local tax dollars are wasted, with no real effect made on crime. A relatively small number of these career criminals are committing a large percentage of the crimes that are plaguing our communities. Everyone hears how hardened criminals in Florida serve short prison sentences, and then, to make matters worse, are released early. But did you know that in a one year period in Florida (1992-1993), 2,151 Florida criminals, who had at least three previous convic- tions for serious felonies and at least one previous state prison sentence, were convicted of yet another serious felony, and 529 of them did not get sentenced to even one day in prison? These dangerous career criminal felons were put on probation and sent back to your neighborhoods to commit more crises. These criminals must be sentenced to prison when convicted and then must serve substantial sentences if Florida's communities are to be made safe. ** Career criminals commit a large percentage of the crimes that strike fear into our communities and cause immense suffer- ing, grief and loss to our citizens. ** Career criminals are not going to turn away from crime because it is what they do for a living - crime is their lifestyle. ** Career criminals cost local taxpayers enormous amounts of tax dollars. Money spent on identifying, arresting and prosecuting them is wasted because now they spend little or no time in prison. In Dade County, for example, a study of 1800 career criminals shows that their offenses cost the local criminal justice system over $254,000,000 in local tax dollars. Unfortunately, that money is largely wasted because statistics show that these career criminals generally return back to our neighborhoods and commit more crimes. - THEY DO THE CRIKE BUT THEY DON' DO THE TIME - ** When career criminals walk the streets, they are 'living proof that crim!2 does pax. Crime prevention efforts with young people are futile as long as these negative role 95- 70
