A RESOLUTION BY A 4/5THS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION AFTER A
DULY ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING, AND CONFIRMING THE CITY MANAGER'S
EMERGENCY ACTION IN WAIVING THE REQUIREMENT
FOR COMPETITIVE SEALED BIDS FOR THE REPAIR OF
THE ROOF ON THE POLICE DEPARTMENT
HEADQUARTERS BUILDING BY CONSTRUCT RESTORE,
INC., IN THE AMOUNT OF $94,415.00; ALLOCATING
FUNDS THEREFOR FROM THE CAPITAL IMPROVEMENT
PROGRAM, INDEX CODE NO. 299301-830, PROJECT
312015; FURTHER RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S ISSUANCE OF AN
EMERGENCY PURCHASE ORDER FOR THIS PURPOSE.
WHEREAS, the Department of Police needed to repair the roof
at the headquarters building; and
WHEREAS, water was leaking into the Division of Computers,
which posed a serious threat to the $7 million of computer
hardware housed in that area; and
WHEREAS, the City Manager has approved the emergency repair
of this roof by Construct Restore, Inc.; and
WHEREAS, funding to cover this repair was available from
Capital Improvement Program, Index Code No. 299301-830, Project
312015;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By an affirmative vote of 4/5ths of the
members of the City Commission, and after a duly advertised

public hearing, the City Manager's emergency action in waiving
the requirement for competitive sealed bids for the repair of the
roof on the Police Department Headquarters Building by Construct
Restore, Inc., in the amount of $94,415, is hereby ratified,
approved and confirmed, with funds therefor hereby allocated from
Capital Improvement Program, Index Code 299301-830, Project No.
312015.
Section 3. The City Manager's issuance of an emergency
purchase order for this purpose is further ratified, approved and
confirmed.
Section 4. This Resolution shall become effective
immediately upon its adoption.

BACKGROUND:
that a Resolution ratifying the
authorizing the expenditure of
Police Department's Headquarters

Over the past several months the Police Department has been
attempting to repair roof leaks in its headquarters building.
Public Works did assist with the repairs; however, due to
multiple leaks in the roof, a clear emergency was created. Water
leaking into the Division of Computers, on the fifth floor, posed
a serious threat of damaging parts of the $7 million dollars of
computer hardware housed in that area. The leakage could have
forced the emergency shutdown of the mainframe resulting in loss
of access of Police and Fire Dispatch System, as well as other
City systems.
It is, therefore, recommended that the Resolution ratifying the
City Manager's emergency action and authorizing the expenditure
of $94,415 for roof repairs to the Police Department's
Headquarters building, be approved. Funding was provided from
the Capital Improvement Program, Index Code 299301-830, Project
#312015.

Over the past several months we have been attempting to address
roof leaks in the Miami Police Headquarters building. While
Public Works has been working with us, the process has been slow.
The multiple leaks in the roof are now to the point where an
emergency exists. Water leakage into the Department of Computers
main hardware computer room is in jeopardy of damaging some of
the $7 million dollars of hardware operating there. The leakage
may also force the emergency shutdown of the mainframe computers
resulting in the loss of Police and Fire Dispatch Systems, and
all other city systems.
I am requesting that you authorize an p-mergency repair of the
roof at this time. I also request that you direct Public Works
and C.S.A. to make the repairs, clearing and sealing of the MPD
Headquarters Building a top priority.

Repairs to the Police
Headquarters Building Roof

The following memorandum serves as a written finding of a valid
Public Emergency pursuant to section 18.52.6 of the City Code for
the conduct of repairs to the Miami Police Department -
Headquarters Building Roof!
For more than a year, the Police Department had been experiencing
moderate water leak problems with the Headquarters Building roof.
In the past several months, the Police Dept. started working with
Public Works to develop plans and specifications for permanent
repairs.
The roof of the Police Headquarters's Building is not a typical
or regular roof system. The roof assembly is of a special
construction to accommodate its use as a helicopter landing pad.
The entire roof surface is a concrete slab built over a
waterproofed concrete roof structure. The waterproofing under
the concrete structure is an elastomeric membrane which is
protected by the concrete surface slab above. The concrete roof
slab has expansion joints which are caulked with a high
performance sealant to prevent water leakage while allowing the
concrete surface slab to expand and contract. The roof
construction was originally completed in 1975 and the sealants
have deteriorated with age and now need replacement. The
waterproof membrane under the concrete top slab has also
developed leaks. The repair of this type roof is a difficult and
complex job.
Public Works was working on a solution for permanent repairs
when unusually heavy rains on August 12th resulted in significant
leaks into the main computer room located below the central .roof.
area. This room contains the City's main-frame computer which
controls both the emergency "E-911ti communication center for
Fire and Police as well as the central computer for all other
City offices.

requirements of obtaining sealed bids and ratifying the City
Manager's finding of an emergency for the expenditure of funds to
repair the roof of the Miami Police Department's Headquarters
building. The service was provided by: Con-Struct Restore,
Inc., 6760 S.W. 94th Street, Miami, FL 33156, at a cost of
$94,415.
