HomeMy WebLinkAboutR-95-0030J-95-19 12/29/94 RESOLUTION NO. 95- 30 A RESOLUTION APPOINTING CERTAIN INDIVIDUALS TO SERVE AS MEMBERS OF THE OCCUPATIONAL LICENSE EQUITY STUDY COMMISSION FOR TERMS OF OFFICE AS DESIGNATED HEREIN. WHEREAS, the Occupational. License Equity Study Commission was established by Ordinance No. 11130, adopted March 24, 1994, to review and make recommendations for chansses in the Occupational License categories and rates in accordance with Section 205 of the Florida State Statute; and WHEREAS, it is intended that members of the Occupational License Equity Study Commission shall be persons of knowledge, experience, mature judgment and background, having ability and desire to act in the public interest and are representative of the business community within the City of Miami; and WHEREAS, Ordinance No. 11130 created five (5) vacancies on the Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference CITY C0NzHSslov. MEETING OF Resolution No. 95- 30 thereto and incorporated herein as if fully set forth in this Section. Section 2. The following individuals are hereby appointed as members of the City of Miami Occupational License Equity Study Commission to serve a two (2) year term of offioe, or until the nominating commissioner leaves offioe, whichever occurs first: Appointee Teresa King Kinney Paul Garcia Valrie Screen [appointment pending] [appointment pending] Nominated By Stephen P. We have been informed by memorandum from Gary Houck, Liaison to said Committee, that Mr. Alvarez does not comply with requirement from the State. Florida Statute205.0535 states in part: ....Each member of the study commission must be a representative of the business community within the local government's jurisdiction...." Kindly indicate the name, address and phone number of your new appointee in the space designated hereinbelow. Each member of the Commission had one appointment to make. You expressed, on the record, that you wanted to defer on your appointment. However, on January 6th, our office received a memorandum from you (copy attached) appointing Valrie Screen to this Committee. Kindly advise if you wish to present a different nomination to this office, or If your prior nomination of Ms. Screen stands. We wish to remind you that present guidelines require members of the Occupational License Equity Study Commission to represent the business community. MH:sI i�� r CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO Honorable Mayor and Members of the City Commission FROM : Ces to Cit q I(r Recommendation; DATE : December 05, 1994 SUBJECT Agenda Item REFERENCES: ENCLOSURES: FILE : It is recommended that the attached resolution providing for the appointment of an equity study commission for the purpose of recommending changes to the Occupational License rates in Chapter 31 be approved. Background_: Section 205 of the Florida Statutes regulates the assessment of municipal occupational licenses and had frozen the rates at the 1981 level. Section 205 was amended by the state legislature in 1993 to allow for a reclassification and a ten percent (10%) increase in the tax. To effectuate these changes the City Commission must appoint an Equity Study Commission whose members must be a representative of the City Of Miami business community. Currently the Occupational License tax generates $4.2 million in revenue. The ten percent (1.09,5) increase would result in $420,000 of additional revenue. Additionally, the change in the state law allows a five percent (5%) increase every other year. Also, by reclassifying and changing the current ordinance certain inequities in the assessment and inefficiencies in administration could be eliminated. The Equity Study Commission was created by Resolution 93-418 and by Ordinance 11130. Appointment of members is now necessary to meet a September 1995 deadline imposed by the state legislature. 95-- 30 (;�-/
