HomeMy WebLinkAboutR-95-0002J-95-37 12/29/94 RESOLUTION NO. 9 5 A RESOLUTION AUTHORIZING THE PAYMENT OF PARKING FEES, FOR THE STORAGE OF SEIZED VEHICLES, IN THE GOVERNMENT CENTER PARKING GARAGE #5, AT A COST NOT TO EXCEED $15,000, AND ALLOCATING FUNDING THEREFOR FROM THE LAW ENFORCEMENT TRUST FUND, SUCH EXPENDITURE HAVING BEEN APPROVED BY THE CHIEF OF POLICE AS COMPLYING WITH FLORIDA STATE STATUTES, CHAPTER 932.7055, AS AMENDED. WHEREAS, Florida State Statute 932.7055, as amended, authorizes the expenditure of forfeiture proceeds for law enforcement purposes not considered normal operating expenses; and WHEREAS, the Police Department utilizes the top two floors of the Government Center Parking Garage #5 to store vehicles seized pending investigation; and WHEREAS, at any given time there are approximately 90 vehicles being stored in this garage; and WHEREAS, at any given time a portion of these 90 vehicles are being held in storage pending forfeiture litigation, at a cost of $30.00 per vehicle, per month; and WHEREAS, the Chief of Police has recommended adoption of this Resolution and has certified that the expenditure proposed complies with Florida State Statute 932.7055, as amended; and WHEREAS, funds to cover the necessary expenses required for this storage are available in the City of Miami Law Enforcement Trust Fund; 'imn COMMISsrolf MEETING OF Resolutign Nq.. 9s� z NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth iti this Section. Section 2. The payment of parking fees, for vehicles seized pending forfeiture and stored in the Government Center Parking Garage #5 is hereby authorized with funds therefor, in an amount not to exceed $15,000 hereby allocated from the City of Miami Law Enforcement Trust Fund, Project No. 690001, Index Code 290904-610, such expenditure having been certified by the Chief of Police as complying with Florida State Statutes, Chapter 932.7055, as amended. BACKGROUND: The Miami Police Department utilizes the top two floors of the Government Center Parking Garage for the storage of vehicles being held for investigations. At any given time, approximately 90 vehicles are stored in this garage. A portion of these 90 vehicles will be held pending forfeiture litigation, at a cost of $30.00 per vehicle, per month, not to exceed $15,000. It is, therefore, recommended that the Resolution authorizing the payment of $15,000, for the storage of seized vehicles in the Government Center Parking Garage, be approved.
