ORDINANCE NO. 1132.5
AN EMERGENCY ORDINANCE AMENDING CHAPTER 35,
ARTICLE VI, OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, ENTITLED "MOTOR
VEHICLES AND TRAFFIC/PRIVATE PARKING LOTS",
THEREBY REQUIRING THAT PARKING LOT OPERATORS
PROVIDE UNIFORMED SECURITY FOR SPECIAL
EVENTS USING A MINIMUM OF ONE CITY OF MIAMI
OFF -DUTY POLICE OFFICER AS UNIFORMED
SECURITY, FOR LOTS WITH A CAPACITY FOR ONE
HUNDRED AND TWENTY-FIVE (125) OR MORE
VEHICLES IN THE AGGREGATE; MORE PARTICULARLY
BY AMENDING SECTION 35-115, ENTITLED
"REVOCATION OF LICENSE FOR VIOLATIONS," AND
ADDING NEW SECTION 35-117, ENTITLED
"TEMPORARY USE FOR SPECIAL EVENTS," TO SAID
CHAPTER; CONTAINING A REPEALER PROVISION AND
A SEVERABILITY CLAUSE; PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Chapter 35, Article VI, of the Code of the
City of Miami, Florida, as amended, is hereby amended in the
following particulars:l/

remaining provisions are now in effect and remain unchanged.

MOTOR VEHICLES AND TRAFFIC
ARTICLE VI. PRIVATE PARKING LOTS
Sec. 35-115. Revocation of license for violations.
Conviction of the violation of any of the
provisions of sections 35-111 through 35- 46 35-117
shall subject the violator to the revocation of his
license by a majority vote of the city commission, upon
charges preferred by the City Manager.
Sec. 35-117. Temporary use of parking lots for
special events.
All permit holders or affiliated entities
operating one (1) or more narking lot (s) servicincx
special events at arenas, stadiums or other similar
facilities must provide uniformed security for one (1)
hour prior to such events and for a minimum of forty-
five (45) minutes after the event has concluded. A
minimum of one City of Miami off -duty police officer
must be used as uniformed security by those permit
holders and their affiliated entities operating one or
more parking lot(s) which, in the aggregate, have
capacity for one hundred and twenty-five (125) or more
vehicles during special events."
Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the

preservation of peace, health, safety, and property of the City
of Miami.
Section 5. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 6. This Ordinance shall become effective
immediately upon its adoption.
PASSED AND ADOPTED BY TITLE ONLY this 16th day of
November 1995.

It is recommended that a resolution -be passed amending the City code, Section 35-115,
entitled "Revocation of License for Violations," of Chapter 35, "Article vi, Private
Parking Lots," and creating a new Section 35-117 entitled "Temporary use for Special
Events," requiring parking lot operators to provide a minimum of one uniformed security
for special events by using off -duty City of Miami police officers as uniformed security
for lots with a capacity for one hundred and twenty-five (125) or more vehicles in the
aggregate.
As a result of a situation we are experiencing with privately owned parking lots around
the Miami Arena and out of concern for the safety and public welfare of the City of
Miami, it is respectfully recommended that the City Commission approve this ordinance
on an Emergency Basis. The parking and traffic congestion generated by parking lots is
creating a safety and circulation problem. On nights of special events, the parking lots
require security personnel responsible to provide safe access to and from the parking area
and to direct ingress and egress of traffic. It has been deemed that this Amendment will
require the necessary uniformed personnel to assist and alleviate any safety and
circulation concerns.
