HomeMy WebLinkAboutO-11323J-95-709 9/13/95 ORDINANCE NO. 11323 AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING SECTION 401, "SCHEDULE OF DISTRICT REGULATIONS," TO MODIFY THE LIMITATIONS FOR LAUNDRY AND DRY CLEANING FACILITIES WITHIN C-1 RESTRICTED COMMERCIAL ZONING DISTRICTS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of July 19, 1995, Item No. 8, following an advertised hearing, adopted Resolution No. PAB 40-95, by a vote of seven to zero (7-0), RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by amending the text of said Ordinance as follows:l/ i� Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. 11323 "ARTICLE 4. ZONING DISTRICTS Sec. 401. Schedule of district regulations. C-1 Restricted Commercial. Permitted Principal Uses: 8. Post -secondary public and private educational facilities, business and trade schools, except those with external evidence of activities of an industrial nature. 9. Service establishments, including photographic studios, interior decorators, letter, photostating or duplicating services, locksmiths, barber and beauty shops; shoe repair; tailoring; dressmaking, millinery and drapery fabrication, except where products are for off -premises sale; coin operated laundry and dry cleaning facilities with rated capacity limited to twenty five (;25 ) one thousand (1000) pounds total for laundry, and one hundred (100) pounds total for noncoin- operated dry cleaning, laundry and dry cleaning agencies or establishments,, 3 maehine9l=fnited--as—€ei f . l 10. Driving school agencies. Conditional Principal Uses: 21. Sales of used automobiles by Special Exception only. 22. Coin -operated laundry and dry cleaning facilities with rated capacity over one thousand (1000) pounds total for laundry, and 2 11323 over one hundred (100) pounds total for dry_ cleaning, laundry and dry cleaning agencies or establishments, by Special Exception. * * * if Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 5. Schedule of District Regulations in order to modify the limitations for laundry and dry cleaning facilities within the C-1 Restricted Commercial Zoning District. PLANNING Approval. RECOMMENDATION BACKGROUND AND The requested amendment to the text of Zoning Ordinance 11000 is in order to ANALYSIS increase the capacity of laundry and dry cleaning establishments in the C-1 district up to 1000 pounds and 100 pounds respectively, and to allow increased capacities beyond that by Special Permit. There is currently no limitation on the size of any other type of retail or service use within the district and to impose the current limitations is first of all not consistent with the industry standards, and, more importantly, it does not make sense to pose such strict limitations on a use which is so necessary within many of the city's neighborhoods.
