AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING SECTION 401, "SCHEDULE OF DISTRICT REGULATIONS," TO ALLOW, AS A CONDITIONAL PRINCIPAL USE IN PR -PARKS AND RECREATION ZONING DISTRICTS, CAMPING FACILITIES BY SPECIAL EXCEPTION WITH CITY COMMISSION APPROVAL ONLY AND SUBJECT TO CERTAIN EXCEPTIONS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of July 19, 1995, Item No. 5, following an advertised hearing, adopted Resolution No. PAB 37-95, by a vote of nine to zero (9-0), RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by amending the text of said Ordinance as follows:l/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. 11322 "ARTICLE 4. ZONING DISTRICTS Sec. 401. Schedule of district regulations. PR Parks, Recreation and Open Space. * * * Conditional Principal Uses: 3. City of Miami administrative offices (including authorities and agencies thereof) and conference activities not exceeding 3,000 square feet in net floor area or ten (10) percent of the net area of the park, whichever is less, by Special Exception with city commission approval only. 4. Camping Facilities by Special Exception with City Commission approval only; said special exception may be waived by the Director of the Planning, Building and Zoning Department if the proposed camping facility was the result of a "Request for Proposals" (RFP) or "Unified Development Proposal" (UDP) process in which public hearings were conducted with referrals and input from appropriate departments and/or agencies• however, any modifications to such camping facilities after approval by RFP or UDP process shall be permitted by Special Exception only with City Commission approval. Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. - 2 - 11322 Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 5. RECOMMENDATION BACKGROUND AND The requested amendment to the text of Zoning Ordinance 11000 is in order to allow ANALYSIS Camping Facilities within the "PR" Zoning District, by Special Exception, with City Commission approval, unless the proposed camping facility was part of an RFP or UDP Process in which public hearings, with referrals to appropriate agencies, were conducted. The camping facility use is consistent with the intent of the "PR" Zoning District and the special permit and/or hearing processes which are required, will ensure that appropriate conditions are attached to each proposal on a case by case basis.
