HomeMy WebLinkAboutO-11319J-95-737 8/10/95 I ORDINANCE NO. 11319 AN ORDINANCE AMENDING CHAPTER 54 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED: "STREETS AND SIDEWALKS" BY AMENDING SECTION 54-104 ENTITLED:"NONSTANDARD STREET WIDTHS", BY MODIFYING THE WIDTHS OF A CERTAIN STREET; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE , AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Article V of Chapter 54 of the Miami City Code establishes base building line locations for all public streets within the City of Miami; and WHEREAS, Northwest 1st Street between North Miami Avenue and Northwest 1st Avenue Is a fully developed 50 foot wide roadway and many of the structures on private property were constructed abutting the property line established by a 50 foot wide right of way; and WHEREAS, the City Administration's review of this transportation corridor reveals that the current 50 foot wide developed roadway adequately serves the present and future transportation needs of the public and the Central Business District; and WHEREAS, for the adjacent landowners to enjoy full use of their property to enhance and sustain the Central Business District, the zoned street width of this section of Northwest 1st Street must be reduced from 70 feet to 50 feet; and 11319 WHEREAS, the Police, Fire Rescue and inspection Services and Solid Waste Departments have evaluated the effects of the reduction of the zoned street width of this section of Northwest 1st Street on their operations and have no substantial objections; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 54-104 of the Code of the City of Miami, Florida, as amended, is hereby further amended in the. following particulars: 1/ "CHAPTER 54 STREETS AND SIDEWALKS ARTICLE V. BASE BUILDING LINES Sec. 54-104. Nonstandard street widths. Base building lines shall be located from the centerline as specified for each of the following streets: i at street, • •> Section 2. All Ordinances, or parts of Ordinances Insofar as they are InconsIstant or In conflict with provisions of this Ordinance are hereby repealed. Asterisks Indicate omitted and unchanged material. - 2 - 11319 Section 3. If any section, part of section,. paragraph, clause, phrase or word of this Ordinance is declared Invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. BACKGROUND: The owners of City National Bank of Florida, located at 25 West Flagler Street, are currently contemplating developing a new parking structure on the south side of N.W. 1 Street at the rear of the bank. Since the zoned right of way width of N.W. 1 Street reserved for future street widening is wider than the currently dedicated 50 feet of right of way width, the owners are prevented form developing the parking lot to Its full capacity. The City National Bank owners have requested that the City consider the reduction of the zoned width of N.W. 1 Street between North Miami Avenue and N.W. 1 Avenue. This request prompted the Public Works Department to undertake a complete review to assess the necessity for continuing the protection of the additional zoned street width for the N.W. 1 Street corridor between North Miami Avenue and N.W. 1 Avenue with the following results and recommendations. The original platted subdivisions that created N.W. 1 Street within the described limits dedicated a right of way width of 50 feet. The road was subsequently developed with pavement curb and gutter and sidewalk conforming to the 50 foot wide right of way and many of the structures on private property were constructed abutting the property line established by a 50 foot wide roadway. N.W. 1 Street is currently a fully developed roadway within the established Downtown Central Business District that conforms to the City's Comprehensive Plan. Page 1 of 2 Honorable Mayor and Members of the City Commission Prior to Comprehensive Zoning Ordinance 6871, the City of Miami Commission, by Ordinance, established a zoned base building line width of 70 feet for this roadway thereby reserving additional property in anticipation of future roadway widening. None of the additional reserved private property has been dedicated for street purposes. N.E. 1 Street eastward to Biscayne Boulevard is currently zoned 50 to 55 feet wide. The Public Works Department's review of this transportation corridor reveals that the current 50 foot wide developed roadway adequately serves the transportation needs of the public and the business district and aligns with the existing N.E. 1 Street. The existing and future planned development within the district Is consistent with the City's Zoning Ordinance and Comprehensive Plan and the protection of the additional property is no longer necessary for this transportation facility. It is respectfully recommended to the City of Miami Commission that the zoned base building line width of N.W. 1 Street between North Miami Avenue and N.W. 1 Avenue be reduced from 70 feet wide to the original developed 50 foot right of way width to conform with current and future regulated development and permit the adjacent landowners to enjoy full use of their property to enhance the business district.
