AN EMERGENCY ORDINANCE AMENDING SECTION
1 OF ORDINANCE NO. 11205, ADOPTED NOVEMBER
17, 1994, AS AMENDED, THE CAPITAL
IMPROVEMENTS APPROPRIATIONS ORDINANCE,
THEREBY INCREASING APPROPRIATIONS FOR THE
CAPITAL IMPROVEMENT PROJECT ENTITLED:
"MIAMI RIVERSIDE CENTER ACQUISITION",
PROJECT NO. 311045, IN THE AMOUNT OF $93,752;
APPROPRIATING FUNDS IN SAID AMOUNT FOR SAID
PROJECT FROM SPECIAL OBLIGATION BONDS,
SERIES 1995; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 11205 on November
17, 1994 to establish appropriations for capital improvements, continue previously
approved capital improvement projects, and establish new capital improvement projects
to begin during fiscal year 1994-95; and
WHEREAS, on September 14, 1995 the City Commission passed Ordinance No.
11297 establishing a new capital project entitled "Miami Riverside Center Acquisition"
and appropriating funds for said project in the amount of $15,700,000; and
WHEREAS, an increase in the appropriation for the "Miami Riverside Center
Acquisition" project in the amount of $93,752 is now necessary to cover architectural
design services; and
WHEREAS, funds for the increase are available from Special Obligation Bonds,
Series 1995;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this
Ordinance are hereby incorporated by reference thereto and adopted herein as if fully set
forth in this Section.
Section 2. Section 1 of Ordinance No. 11205, adopted November 17, 1994, as
amended, is hereby further amended in the following particulars:'
Section 1. The herein appropriations are hereby made for
implementation of all municipal capital improvements of the City of
Miami, including new capital improvement projects scheduled to begin
during fiscal year 1994-1995. The herein appropriations which are hereby
designated by reference to descriptive project title and number also include
appropriations for previously approved scheduled projects as well as
reappropriations of prior fund appropriations. The source of revenues to
support the herein appropriations is hereby identified by fund and project
with the project appropriations with revenues therefor being set forth for
seven program (I - VII) areas based upon use or functional category within
said areas, as follows:

Section 3. All ordinances or parts of ordinances insofar as they are inconsistent
or in conflict with the provisions of this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph, clause, phrase or word of
this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be
affected.
Section 5. This Ordinance is hereby declared to be an emergency measure on
the grounds of urgent public need for the preservation of peace, health, safety, and
property of the City of Miami and upon the further grounds of the necessity to make the
required and necessary purchases and payments and to generally carry out the functions
and duties of municipal affairs.
Section 6. The requirements of reading this Ordinance on two (2) separate days
is hereby dispensed with by a vote of not less than four -fifths of the members of the
Commission.
Section 7. This Ordinance shall become effective immediately upon its
adoption.

It is respectfully recommended that the City Commission adopt the attached ordinance
amending Ordinance No. 11205 by appropriating additional funds in the amount of $93,752 for
the Miami Riverside Center Acquisition, Capital Improvement Project No. 311045.
BACKGROUND
On September 14, 1995 the City Commission adopted Ordinance No. 11297 establishing a new
capital improvement project and appropriating funds in the amount of $15,700,000 for the
purchase of the Miami Riverside Center (FPL Building).
It is now necessary to appropriate additional funds to cover the architectural design services
required to prepare the interior of the building for City offices. Funding in the amount of
$93,752 is available from Special Obligation Bonds, Series 1995. The new total appropriation
for this capital project will be $15,793,752.
This ordinance is declared to be an emergency measure due to the need to expedite the move of
City offices to the new location without interruption to municipal services.
