ORDINANCE NO.
AN ORDINANCE AMENDING ORDINANCE NO. 11000,
AS AMENDED, THE ZONING ORDINANCE OF THE CITY
OF MIAMI, BY AMENDING SECTION 609, "SD-9
BISCAYNE BOULEVARD NORTH OVERLAY DISTRICT,"
BY ADDING AND MODIFYING REGULATIONS
REGARDING ONSITE SIGNS ABOVE A HEIGHT OF
FIFTEEN (15) FEET ABOVE GRADE; AND BY
AMENDING SECTION 926.16, "LIMITATIONS ON
ONSITE SIGNS ABOVE A HEIGHT OF FIFTY (50)
FEET ABOVE GRADE," TO ADD A CLAUSE
REFERENCING DIFFERENCES FOR THE SD-9 SPECIAL
DISTRICT; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of June 14, 1995, Item No. 8, following an advertised hearing,
adopted Resolution No. PAB 27-95 by a vote of seven to zero
(7-0), RECOMMENDING APPROVAL of amending Ordinance No. 11000 as
hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
Ordinance No. 11000 as hereinafter set forthy
NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, is hereby amended by

"ARTICLE 6. SD SPECIAL DISTRICTS GENERAL PROVISIONS
Sec. 609. SD-9 Biscayne Boulevard North Overlay
District.

Sec. 609.8. Limitations on signs:
Sign limitations shall be as for C-1 districts,
except as provided below:
Sec. 609.8.1 General limitations:
Sec. 609.8.1.1 Signs more than fifteen (15) feet above
grade.
a) Signs more than fifteen (15) feet above
grade, but less than fifty (50) feet above
rade. Signs erected with their lowest
portions more than fifteen (15) feet above
grade shall be limited to those identifying
the building and the nature of the
establishments it contains. Except as
provided below, only one (1) such sign, not
exceeding fifty (50) square feet in area for
every one hundred fifty (150) feet of length
of building wall oriented toward the street,
shall be permitted. In addition to the Class
II Special Permit required for such signs
referral to the Urban Development Review
Board shall be mandatory for signs fifteen
(15) feet above grade that exceed the
allowable fifty (50) square feet of sign
area. Area of such signs shall in no case
exceed 1.5 square feet for each lineal foot
of building wall frontage on a street

be regulated generally by the limitations of

Section 926.16. of this zoning ordinance
(including the criteria stated therein)
except for the limitations on the sizes of
the letters which shall be as follows:
1. Letters of signs_ on buildings with a
height of 100 feet or more shall be
permitted up to a height of eight feet (81-
0"); and
2. Letters of signs on buildings with a
height of 150 feet or more shall be
permitted up to a height of eight feet

In addition to the Class II Special Permit
required for such signs, referral to the
Urban Development Review Board shall be
mandatory.
ARTICLE 9. GENERAL AND SUPPLEMENTARY REGULATIONS
Sec. 926.16. Limitations on onsite signs above a
height of fifty (50) feet above grade.
Except as otherwise provided in Section 609 of
this zoning ordinance the following regulations
shall apply to all onsite signs above a height
of fifty (50) feet above grade:
1. Building sign content shall be limited to
the name of the building or the names of up
to two (2) major tenant(s) of the building
occupying more than five (5) percent of the
gross leasable building floor area.
Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 3. If any section, part of this section,
paragraph, clause, phrase or word of this Ordinance is declared
invalid, the remaining provisions of this Ordinance shall not be
affected.

Section 4. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

PETITION Consideration of amending the text of Ordinance 11000, as amended, the Zoning
Ordinance of the City of Miami, by amending Article 6, Section 609. "SD-9 Biscayne
Boulevard North Overlay District"; and Article 9, Section 926.16. "Limitations on
onsite signs above a height of fifty (50) feet above grade"; in order to modify the
regulations for allowed signs over fifty feet in height in the SD-9 District.

RECOMMENDATION
BACKGROUND AND The requested amendment to the text of the Zoning Ordinance is for the purpose of
ANALYSIS allowing 8 ft. letters for signs on buildings with a height of 100 feet or more,
and 10 ft. letters for signs on buildings with a height of 150 feet or more, within
the SD-9 Biscayne Boulevard North Overlay District. At the June 1, 1995 City
Commission meeting, a motion was passed instructing the Planning Division to study
and make recommendations on the sign ordinance for the SD-9 District in order to
stimulate the relocation of businesses to major structures on Biscayne Boulevard.
The proposed amendment is in response to that request by increasing the allowed
size of the letters on new signs as specified above. All requests for signs will
still require Class II Special Permits with mandatory referrals to the Urban
Development Review Board.
