ORDINANCE NO. 11306
AN ORDINANCE MAKING APPROPRIATIONS FROM THE
DOWNTOWN DEVELOPMENT DISTRICT AD VALOREM TAX
LEVY AND OTHER MISCELLANEOUS INCOME FOR THE
DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF
MIAMI, FLORIDA, FOR THE FISCAL YEAR BEGINNING
OCTOBER 1, 1995 AND ENDING SEPTEMBER 30, 1996;
AUTHORIZING THE DOWNTOWN DEVELOPMENT AUTHORITY
TO INVITE OR ADVERTISE REQUIRED BIDS; PROVIDING FOR
BUDGETARY FLEXIBILITY; PROVIDING THAT THIS
ORDINANCE BE DEEMED SUPPLEMENTAL AND IN
ADDITION TO THE ORDINANCE MAKING APPROPRIATIONS
FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1995 AND
ENDING SEPTEMBER 30, 1996 FOR THE OPERATIONS FOR
THE CITY OF MIAMI; CONTAINING A REPEALER PROVISION,
SEVERABILITY CLAUSE AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Board of Directors of the Downtown Development
Authority of the City of Miami, Florida has approved and submitted to the
City Commission a Budget Estimated of the expenditures and revenues
of the Downtown Development Authority for the Fiscal Year beginning
October 1, 1995 and ending September 30, 1996, as prepared by the
Executive Director of the Downtown Development Authority, copies of
such estimates having been made available In the newspapers of the
City; and
WHEREAS, the City Commission has reviewed the Downtown
Development Authority's Budget;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to
this Ordinance are hereby adopted by reference thereto and incorporated
herein as if fully set forth in this Section.
Section 2. The following appropriations for Fiscal Year 1995-1996
are hereby approved for the maintenance and for the purpose of
financing the operations and other legal and proper purposes of the
Downtown Development Authority of the City of Miami, Florida:

Section 3. Said appropriations are the anticipated expenditure
requirements for the Downtown Development Authority for the period
October 1, 1995 to September 30, 1996, but are not mandatory should
efficient administration of the Downtown Development Authority or

altered economic conditions indicate that a curtailment in certain
expenditures is necessary. The Board of Directors of the Downtown
Development Authority is specifically authorized to withhold any of these
appropriated funds from encumbrance or expenditure should such action
appear advantageous to the economical and efficient operation of the
Downtown Development Authority.
Section 4. The Downtown Development Authority is hereby
authorized to make transfers between the detailed accounts comprising
any of the amounts appropriated by Section 2 hereof, in order that the
available and required balance in any such account may be used for
other necessary and proper purposes.
Section 5. The Downtown Development Authority is hereby
authorized to invite or advertise for bids for the purpose of any material,
equipment or services embraced in the aforementioned appropriations,
for which formal bidding is required, such bids to be returnable as
required by law.
Section 6. This Ordinance shall be deemed supplemental and in
addition to the ordinance making appropriations for the Fiscal Year
beginning October 1, 1995 and ending September 30, 1996, for
operations of the City of Miami.
Section 7. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisions of this Ordinance are
hereby repealed.

Section 8. If any section, part of this section, paragraph, clause,
phrase or word of this Ordinance is declared invalid, the remaining
provisions of this Ordinance shall not be affected.
Section 9. This Ordinance shall become effective thirty (30) days
after final reading and adoption thereof.

ENCLOSURES:
It is respectfully requested that the City Commission adopt the attached Ordinance making
appropriations for the Downtown Development Authority for the Fiscal Year beginning
October 1, 1995 and ending September 30, 1996.
Background
Chapter 14 of the City of Miami Code authorizes the City Commission to levy an
additional ad valorem tax on all real and personal property within the Downtown
Development Authority District for the purpose of financing the operations of the
Downtown Development Authority.
The proposed DDA Budget for Fiscal Year 1995-1996 is based on an estimated increase
in revenues of $82,783 (14.6%).
Attached is an Ordinance for City Commission approval which makes appropriations for
the Downtown Development Authority for the Fiscal Year beginning October 1, 1995 and
ending September 30, 1996.

A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF
MIAMI, FLORIDA, APPROVING THE ANNUAL BUDGET OF THE
DOWNTOWN DEVELOPMENT AUTHORITY FOR THE FISCAL
YEAR BEGINNING OCTOBER 1, 1995 AND ENDING SEPTEMBER
30, 1996; REQUESTING THAT THE MIAMI CITY COMMISSION
ESTABLISH THE MILLAGE AND ALLOCATE OTHER FUNDS TO
SUPPORT THE FINANCIAL REQUIREMENTS OF THE BUDGET;
AUTHORIZING THE EXECUTIVE DIRECTOR AND TREASURER OF
THE DOWNTOWN DEVELOPMENT AUTHORITY TO EXPEND
FUNDS UNDER THE NEW BUDGET; DIRECTING THE EXECUTIVE
DIRECTOR TO FILE A DETAILED STATEMENT OF THE
PROPOSED EXPENDITURES AND ESTIMATED REVENUES FOR
THE FISCAL YEAR BEGINNING OCTOBER 1, 1995 AND ENDING
SEPTEMBER 30, 1996 WITH THE CITY CLERK OF THE CITY OF
MIAMI AFTER ADOPTION AND ESTABLISHMENT OF THE
MILLAGE BY THE MIAMI CITY COMMISSION; AND FURTHER
PROVIDING THAT A COPY OF THIS RESOLUTION BE FILED
WITH THE CITY CLERK OF THE CITY OF MIAMI.
WHEREAS, the Downtown Development Authority of the City of Miami, Florida has
prepared a budget for the Fiscal Year beginning October 1, 1995 and ending September
30, 1996; and
WHEREAS, the Board of Directors of the Downtown Development Authority has
reviewed said budget, said budget being based on the Estimated Tax Roll provided by
Metro Dade County; and
WHEREAS, The Board of Directors of the Downtown Development Authority finds

that the proposed budget is necessary in order to further the objectives of the Downtown
Development Authority, as authorized by City Ordinance.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI, FLORIDA:
Section 1. The budget of the Downtown Development Authority, as submitted by
the Executive Director, is made part of this Resolution and is hereby approved and shall
be known as the "Annual Budget of the Downtown Development Authority: Fiscal Year
October 1, 1995 through September 30, 1996."
Section 2. The following appropriations for the Fiscal Year beginning October 1,
1995 and ending September 30, 1996, are hereby made for the maintenance and for the
purpose of financing the operations and other legal and proper purposes of the Downtown
Development Authority of the City of Miami, Florida, to wit:

Section 3. The Commission of the City of Miami is requested to adopt said
budget and establish the millage, authorized by law, to support the financial requirements

of this budget.
Section 4. The Executive Director and the Treasurer of the Downtown
Development Authority are authorized to expend funds, including new salary rates, as
provided in said budget, after adoption and establishment of the millage by the Miami City
Commission, upon the first day of the 1995-1996 Fiscal Year, October 1, 1995.
Section 5. The Executive Director of the Downtown Development Authority is
directed to prepare and file with the City Clerk of the City of Miami, a detailed statement
of the proposed expenditures and estimated revenues for the Fiscal Year 1995-1996 which
shall be entitled "Annual Budget of the Downtown Development Authority: Fiscal Year
October 1, 1995 through September 30, 1996."
Section 6. A copy of this Resolution and the attachment shall be filed with the
City Clerk of the City of Miami, Florida after adoption of the millage by the City of Miami
Commission.
