ORDINANCE NO. 1 1
AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF
ORDINANCE NO. 11205, AS AMENDED, THE CAPITAL
IMPROVEMENTS APPROPRIATIONS ORDINANCE,
THEREBY INCREASING APPROPRIATIONS TO CAPITAL
IMPROVEMENT PROJECT NO. 322059, ENTITLED;
"OVERTOWN SHOPPING CENTER RENOVATIONS", IN
THE AMOUNT OF $79,893.00; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, on November 17, 1994, the City Commission adopted
Ordinance No. 11205 to establish appropriations for capital
improvements, continue previously approved capital improvement
projects, and establish new capital improvement projects for the
1994-95 Fiscal Year; and
WHEREAS, the City of Miami has awarded a contract to
Venecon, Inc. for the Overtown Shopping Center renovations in the
amount of $213,320.00; and
WHEREAS, additional funds are required to cover the cost of
the build -out of the Overtown Neighborhood Enhancement Team (NET)
Office in the Overtown Shopping Center; and
WHEREAS, funds in the amount of $41,182.00 are being
provided by Republic National Bank, as prepaid rent for the
Revocable permit between the City of Miami and Republic National
Bank, dated March 31, 1995; and
WHEREAS, funds in the amount of $38,711 are available in
Community Development Block Grant Funds; and

WHEREAS, it is necessary to provide additional
appropriations in an amount not to exceed $79,893.00 for said
project by appropriating $38,413.00 in available funds from
Community Development Block Grant Funds and $41,182.00 from
Republic National Bank;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Section 1 of Ordinance No. 11205, as amended,
adopted November 17, 1994, is hereby amended in the following
particulars:l/
Section 1. The herein appropriations are hereby made for
implementation of all municipal capital improvements of the City
of Miami, including new capital improvement projects scheduled to
begin during Fiscal Year 1994-1995. The herein appropriations
which are hereby designated by reference to descriptive project
title and number also include appropriations for previously
approved scheduled projects as well as reappropriations of prior
fund appropriations. The source of revenues to support the herein
appropriations is hereby identified by fund and project with the
project appropriations with revenues therefor being set forth for
seven program (I-VII) areas based upon use or functional category
within said areas, as follows:

remaining provisions are now in effect and remain unchanged.
Asterisks indicate omitted and unchanged material. All
figures are rounded to the nearest hundred dollars.

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies and to generally carry on the functions and
duties of municipal affairs.

Section 6. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon its adoption.
PASSED AND ADOPTED BY TITLE ONLY this 14th day of
