HomeMy WebLinkAboutO-11298J-95-566 6/30/95 ORDINANCE NO. 11298 t AN ORDINANCE AMENDING SECTIONS 35-91, 35-92 AND 35-93 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY CHANGING RATES AT CERTAIN ON -STREET PARKING METERS AND CERTAIN OFF-STREET LOTS; CHANGING THE RATES AT MUNICIPAL PARKING GARAGES; PROVIDING FOR SAID RATE CHANGES TO BECOME EFFECTIVE OCTOBER 1, 1995; RATIFYING AND CONFIRMING ALL ACTS OF THE OFF-STREET PARKING BOARD AND ITS EXECUTIVE DIRECTOR AS TO RATES HERETOFORE CHARGED; FURTHER AUTHORIZING THE OFF-STREET PARKING BOARD TO DEVELOP EXPERIMENTAL RATE STRUCTURES AND TO INITIATE RATES FOR NEW FACILITIES DURING THE FISCAL YEAR; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Off -Street Parking Board of the City of Miami, on May 26, 1995, instructed the Executive Director to submit an ordinance to the City Commission to reflect rate changes in certain on -street parking meters and off-street parking lots, and municipal parking garages, to become effective October 1, 1995; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sections 35-91, 35-92 and 35-93 of the Code of the City of Miami, Florida, as amended, are hereby amended in the following particulars:l/ Words and/or figures stricken through shall be deleted. The experimental rates may only be initiated based upon unexpected variations in utilization or changes in environmental factors not expected at the time of approval of this Ordinance. A monthly report will be made to the City Manager regarding any rate established pursuant to this Provision. At no time shall the rates be adjusted higher than the rates set by the City Commission. Section 3. All acts of the Off -Street Parking Board and its Executive Director as to rates heretofore charged are hereby ratified and confirmed. Section 4. The provisions of this Ordinance shall become effective October 1, 1995. Section 5. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 6. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. This Ordinance shall be operative and provisions thereof, unless indicated herein, shall become effective in accordance with City Charter provisions. -12- 11298 Section 7. CLARK, MAYOR -13- ��98 TO: Honorable Mayor and Memebers of the City Commission DATE: JUN 2 1995 29 FROM: Cesa SUBJECT: Parking Rate Ordinance/1st • City a Reading REFERENCE: For City Commission Meeting of July 13, 1995 RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Ordinance amending the City Code by establishing rates at on -street parking meters, off-street lots and municipal garages; providing for an effective date of October 1, 1995; and, authorizing the Off -Street Parking Board, and its Director to initiate rates for new facilities during FY 95/96. BACKGROUND On May 26, 1995, the Off -Street Parking Board of the City of Miami instructed its Executive Director to submit an Ordinance to the City Commission that parking rates be changed in certain on -street parking areas, off-street parking lots and municipal parking garages. Findings of a survey of privately operated lots and garages near Department of Off -Street Parking operated facilities indicated that the rates at many municipal facilities are significantly lower than those of comparable private facilities. The attached rate Ordinance has been prepared to reflect rate changes necessary to keep pace with market conditions, while keeping with the Department's philosophy to offer the best parking value, at rates slightly below those of the market. The recommended parking rate ordinance, the first rate increase since November 1989, contains all necessary rate changes city-wide. However, the Department of Off -Street Parking plans to implement only one change in FY 95/96 at Lot No. 10 located at N.W. 18t Avenue between N.W. 4th & 5th Street adjacent to the State Plaza Metromover Station. The balance of the recommended changes would be implemented in FY 96/97 to fulfill the requirements of the departmental Five Year Plan that includes the redevelopment of Garage 1, doubling its capacity to approximately 1,100 parking spaces, to provide additional parking to the downtown business and visitor community.
