ORDINANCE NO. 11297
AN EMERGENCY ORDINANCE AMENDING SECTION 1
OF ORDINANCE NO. 11205, AS AMENDED, THE CAPITAL
IMPROVEMENTS APPROPRIATIONS ORDINANCE,
THEREBY ESTABLISHING NEW CAPITAL PROJECT
NO.311045, ENTITLED "MIAMI RIVERSIDE CENTER
ACQUISITION" AND APPROPRIATING FUNDS, IN THE
AMOUNT OF $15,700,000.00, FOR SAID PROJECT;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, on November 17, 1994, the City Commission adopted Ordinance
No. 11205 to establish appropriations for capital improvements, continue previously
approved capital improvement projects, and establish new capital improvement projects
to begin during Fiscal Year 1994-95; and
WHEREAS, on July 13, 1995, the City Commission adopted Resolution
No. 95-527 approving the purchase of the "Miami Riverside Center", owned by the
Florida Power and Light Company and located at 400 Southeast 2nd Avenue, Miami,
Florida; and
WHEREAS, it is now in order to establish appropriations for a capital
improvement project, entitled "Miami Riverside Center Acquisition", in the amount of
$15,700,000.00, as time is of the essence due to the upcoming closing of the purchase
of said property scheduled for October 2, 1995;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this
Ordinance are hereby adopted by reference thereto and incorporated herein as if fully
set forth in this Section.
Section 2. Section 1 of Ordinance No. 11205, adopted November 17, 1994,
as amended, is hereby amended in the following particulars:''-'
Section 1. The herein appropriations are hereby made for
implementation of all municipal capital improvements of the City of Miami,
including new capital improvement projects scheduled to begin during Fiscal
Year 1994-1995. The herein appropriations which are hereby designated by
reference to descriptive project title and number also include appropriations for
previously approved scheduled projects as well as reappropriations of prior fund
appropriations. The source of revenues to support the herein appropriations is
hereby identified by fund and project with the project appropriations with
revenues therefor being set forth for seven program (I-VII) areas based upon
use or functional category within said areas, as follows:

Section 3. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisions of this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph, clause, phrase or word of
this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not
be affected.
Section 5. This Ordinance is hereby declared to be an emergency measure
on the grounds of urgent public need for the preservation of peace, health, safety, and
property of the City of Miami, and upon the further grounds of the necessity to make the
required and necessary payments to its employees and officers, payment of its debts,
necessary and required purchases of goods and supplies and to generally carry on the
functions and duties of municipal affairs.
Section. 6. The requirement of reading this Ordinance on two separate days is
hereby dispensed with by an affirmative vote of not less than four -fifths of the members
of the Commission.
Section 7. This Ordinance shall become effective immediately upon its
adoption.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached ordinance
amending Ordinance No. 11205 and establish a Capital Improvement Project entitled "Miami
Riverside Center Acquisition".
BACKGROUND
On July 13, 1995 the City Commission passed Resolution No. 95-527 approving the purchase of
the real property located at 400 SW 2nd Avenue, commonly known as the Miami Riverside
Center and owned by the Florida Power and Light Company (FPL), in the amount of
$15,600,000 plus $100,000 for related expenses.
Resolution No. 95-527 also allocated funds for this purchase from the City of Miami Special
Obligation Bonds Series 1995. Therefore, funds in the amount of $15,700,000 need to be
appropriated in the Capital Improvement Appropriations Ordinance under new CIP No. 311045.
This ordinance is declared to be an emergency measure due to the upcoming closing and
finalization of the purchase of said property by the City of Miami from FPL on October 2, 1995.
