HomeMy WebLinkAboutO-11284J-95-405 4/14/95 ORDINANCE NO. 11284 AN ORDINANCE AMENDING ORDINANCE NO. 11205, ADOPTED NOVEMBER 17, 1994, AS AMENDED, THE CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE, BY ESTABLISHING A NEW CAPITAL IMPROVEMENT PROJECT ENTITLED "JEFFERSON STREET PAVING PROJECT PHASE II" IN THE AMOUNT OF $60,000; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 11205 on November 17, 1994, to establish appropriations for capital Improvements, continue previously approved capital Improvement projects, and establish new capital Improvement projects to begin during fiscal year 1994-95; and WHEREAS, the Dade County School Board is contributing $60,000 to the City for the construction of Jefferson Street between Washington Avenue and Charles Avenue; and WHEREAS, said street is to be reopened In order to allow a safer and more efficient traffic pattern for school buses travelling to and from George Washington Carver Middle School; and WHEREAS, It is now in order to establish a new capital Improvement project to begin In fiscal year 1994-95 in the program area of Transportation and Physical Environment; and 11284 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1 of Ordinance No. 11205, as amended, adopted November 17, 1994, is hereby further amended in the following particulars: 1/ "Section 1. The herein appropriations are hereby made for implementation of all municipal capital Improvements of the City of Miami, including new capital Improvement projects scheduled to begin during fiscal year 1994-95. The herein appropriations which are hereby designated by reference to descriptive j project title and number also Include appropriations i for previously approved scheduled projects as well as reappropriations of prior fund appropriations. BACKGROUND: In order to allow a safer and more efficient traffic pattern for school buses travelling to and from George Washington Carver Middle School the Department of Public Works recommends the reopening and construction of Jefferson Street between Washington Avenue and Charles Avenue. This request Is supported by the Dade County School Board which has agreed to fund the physical reopening of Jefferson Street In the amount of $60,000. It is respectfully recommended that the City Commission accept the contribution from the Dade County School Board and amend the Capital Improvement Appropriations Ordinance, to establish a new capital Improvement project entitled "Jefferson Street Paving Project -Phase 1111, Project No. 341202, so that the City can complete this important roadway link. Lee Assistant City Manager ENCLOSURES: Department of Public Works At the May 11, 1995 City Commission meeting, a resolution was adopted and an ordinance enacted (items 44 and 45) that authorized the City to accept a $60,000 donation from the Dade County School Board and allocate the same amount in the Capital Improvement Ordinance for the reopening .of Jefferson Street in Coconut Grove to serve George Washington Carver Middle School (please see attached map). In addition, this legislation was conditioned upon the repairing and repaving of Brooker Street which extends between Oak Avenue and Thomas Avenue. However, the City's jurisdiction for Brooker Street is only between Grand Avenue and Thomas Avenue as the remainder of Brooker Street lies within the City of Coral Gables. At the south end of Brooker Street, there is a paved private driveway that continues to Charles Terrace. This driveway appears to be an extension of Brooker Street but is, in fact, private property. At the May 11, 1995 Commission meeting we were left with the impression that this private driveway was to be included in the requested paving as a condition of the legislation. Since only public funds can be used to pave Brooker Street, please advise if the City would be allowed to pave the "private driveway extension" of Brooker Street between Thomas Avenue and Charles Terrace.
