HomeMy WebLinkAboutO-112761' J-95-653 7/12/95 ORDINANCE NO. 7 AN EMERGENCY ORDINANCE AMENDING THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TO: (1) CHANGE THE PAYMENT OF WASTE FEES FROM A SEMI-ANNUAL BASIS TO ANNUALLY, BASED UPON A METHOD DEEMED APPROPRIATE BY THE CITY MANAGER, AND (2) INCREASE THE GENERAL FEE FOR EACH PERMIT APPLICATION FOR OBSTRUCTING OR CLOSING STREETS OR SIDEWALKS OR IMPEDING TRAFFIC; MORE PARTICULARLY BY AMENDING SECTIONS 22-26 AND 54-3; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 22-26 of the Code of the City of Miami, Florida, as amended (the "Code"), sets forth the requirement for a semi-annual payment schedule for collection of solid waste fees; and WHEREAS, the City Manager has determined that an annual billing method for said fees will prove to be more cost- effective; and WHEREAS, Section 54-3 of the Code sets forth the fees for permits required in order to obstruct/close streets or sidewalks or impede traffic; and WHEREAS, said permit fees have not been increased since 1982; and WHEREAS, the City Commission, after careful consideration of said matters deems it advisable and in the best interest of the general welfare of the City of Miami to amend the City Code as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 22-26 of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars:l� "Sec. 22-26. Payment of Waste Fees. (a) All payment of waste fees shall be payable in advance ex a semiannual basis annually based on the method deemed most appropriate and cost-effective by the City Manager. In the event that payment of said waste fee is made by check made payable to the City and said check is returned by the bank due to insufficient funds or for any other reason not the fault of the bank or the City, a charge of twenty dollars ($20.00) shall be added to the waste fee due to cover the administrative costs incurred by the City. In addition, late charges and interest on past due accounts shall be charged as provided in this chapter. * * * * * * it Section 3. Section 54-3 of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars: I/ Words and/or figures stricken through shall be deleted. Permit required to obstruct or close street or sidewalk or impede traffic; fees; waiver of fees. (d) (1) General. A fee of one - hundred dollars ($100.00) shall accompany each permit application to the police department, to be retained by the City regardless of action taken in the grant or denial of the permit. i Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. i Section 6. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and, upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 7. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. - 3 - 11276 ry�ti Section 8. BACKGROUND The City Code requires an application fee of thirty dollars ($30) for each permit application seeking permission to obstruct or close a street or to impede traffic. This fee was established on December 9, 1982 and has never been increased. We are proposing to increase it to one -hundred dollars ($100.00). Based on the number of permits issued in 1994, we collected $24,420. An increased fee of $100 would have generated $81,400. Solid waste bills are presently mailed twice yearly to approximately 54,000 accounts. Administrative and mailing costs are very expensive. This initiative to reduce mailing expenses is part of our overall strategy to streamline City operations and reduce costs.
