AN EMERGENCY ORDINANCE AMENDING CHAPTER 38 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, RELATED TO PARK FEES FOR USE OF VIRGINIA KEY PARK ("PARK"); PROVIDING FOR ADJUSTMENTS TO SAID PARKS ESTABLISHED FEE SCHEDULE AND SUBSEQUENT ANNUAL ADJUSTMENTS, IF NECESSARY, BY THE CITY MANAGER TO SAID FEE SCHEDULE; MORE PARTICULARLY BY AMENDING SECTION 38-9 AND ADDING NEW SECTION 38-10 TO SAID CODE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City of Miami Parks and Recreation Department is preparing Virginia Key Beach for full operation during the 1995 summer season; and WHEREAS, in order to adequately staff and maintain said facility, modifications to the existing park fee structure are required as no changes have been implemented since 1986; and WHEREAS, said park fees should be reviewed and established annually, beginning April 1, 1996, by the City Manager to assure ongoing adequate staffing and maintenance of said Park; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11273 Section 1. Section 38-9 of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars: 1/ "Sec. 38-9. Park Fees for use of Virginia Key Park. (1) Daily pass: (a) ate Three dollars (fie S3.00) for city_ residents and five dollars (85,00) for nonresidents per automobile or van (a passenger -carrying vehicle designed for a capacity of not more than sixteen (16) passengers). (b) One dollar ($1.00) for city residents and two dollars (82,001 for nonresidents per individual /walk-in. (This shall also allow entry of a person on a nonmotorized vehicle, such as a bicycle.) New Section 38-10 is hereby added to the Code of the City of Miami, Florida, as amended, in the following particulars:2/ "Sec 38 10 Annual review and adjustment of Virginia Key Park Fees, Beginning April 1 1996, park fees for use of Virginia Key Park shall be adjusted annually, if necessary, by the city manages prior to the first day of April and shall become effective the first day of May, conditioned upon the following criteria: 7) Operating expenses 2) Reserve for improvements and major maintenance 3) Other city financial needs," Section 3. All ordinances or parts of ordinances insofar as i they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. i Section 4. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. i Section 5. Section 6. The requirement of reading this Ordinance on two (2) separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Section 7. BACKGROUND ' The Parks and Recreation Department is preparing Virginia Key Beach for full operation during the 1995 summer season. In order to adequately staff and maintain this facility, we have prepared the attached legislation to modify our existing park fee structure. It should be noted that these fees have not been modified since 1986. The following modifications to the fee structure are proposed: 1. Increase the daily pass fee per automobile or van (a passenger -carrying vehicle designed for a capacity of not more than sixteen passengers) from $2.00 to $3.00 for city residents and to $5.00 for nonresidents. 2. Establish for city residents a $1.00 per individual walk-in fee and a $2.00 per individual walk-in fee for nonresidents. (This shall also allow entry of a person on a nonmotorized vehicle, such as a bicycle.) 3. Increase the daily pass fee per bus or recreational vehicle (a passenger -carrying vehicle designed for a capacity of more than sixteen persons) from $6.00 to $10.00. 4. Authorize the City Manager to establish fees for the use of designated picnic areas by groups. 6. Authorize the City Manager to negotiate and establish terms, fees and conditions for the use, by park permit only, of the southern park area. Beginning April 1, 1996, the City Manager will annually establish the Virginia Key Park fees, effective May 1st, contingent on certain criteria: operating expenses; reserve for improvements and maintenance; other city financial needs. We are presenting this Ordinance as an emergency measure so that _ the modified fees can be in place immediately_ for the operation of the beach.
